A 2019 Rasmussen poll<\/span> <a href=\"https:\/\/www.rasmussenreports.com\/public_content\/lifestyle\/social_issues\/most_oppose_transgender_athletes_on_opposite_sex_teams\"><span>reveals<\/span><\/a> <span>that only 28% of American adults favor allowing transgender students to participate alongside the opposing sex in school sports. Indeed, over the past several years, many parents and teachers grew uneasy and upset as biological men<\/span> <a href=\"https:\/\/www.dailywire.com\/news\/5-times-transgender-athletes-dominated-womens-sports\"><span>set<\/span><\/a> <span>new<\/span> <span>state records in weightlifting, sprinting, and outperformed biological females in other activities.&nbsp;<\/span><\/p>\n<p><span>As a result, many state governments are pursuing policies that would prevent biological males from competing against females in school sports.<\/span><\/p>\n<p><span>Though the measures cite the innate biological differences between the sexes and protect female students accordingly, LGBTQ advocacy organizations like the<\/span> <a href=\"https:\/\/www.hrc.org\/news\/these-are-the-states-trying-to-stop-trans-kids-from-playing-sports\"><span>Human Rights Campaign<\/span><\/a> <span>dismissed such efforts as discriminatory and hurtful.<\/span><\/p>\n<p><span>\u201cYou\u2019re 13. You want to play soccer. You sign up for your school\u2019s team, practice hard, and make friends,\u201d writes the group. \u201cThen a state lawmaker introduces legislation that would ban you from playing sports because you\u2019re transgender.\u201d<\/span><\/p>\n<p><span>In part in response to the executive actions of President Biden, and mounting pressure from the LGBTQ movement, here are four states pushing legislation to keep men from participating in women\u2019s sports.&nbsp;<\/span><\/p>\n<p><strong>South Dakota<\/strong><\/p>\n<p><span>A bill introduced by South Dakota lawmakers would enforce the distinction between the sexes in sporting events, while also granting legal recourse to females harmed by violations.<\/span><\/p>\n<p><span>State Rep. Rhonda Milstead (R-SD)<\/span> <a href=\"https:\/\/mylrc.sdlegislature.gov\/api\/Documents\/218120.pdf\"><span>proposed<\/span><\/a> <span>the \u201cAct to promote continued fairness in women\u2019s sports,\u201d which mandates that \u201cany athletic team or sport that is sponsored or sanctioned by a public school\u2026 must be expressly designated as being a male team or sport; a female team or sport; or a coeducational team or sport.\u201d The bill includes a line emphasizing that \u201ca team or sport designated as being female is available only to participants who are female, based on their biological sex.\u201d<\/span><\/p>\n<p><span>Every year, schools must obtain a written statement verifying a student\u2019s biological sex according to birth and confirming that the student has not taken performance-enhancing hormones. If a school suspects that any information in the statement is false, they are able to remove the student from an athletic team.<\/span><\/p>\n<p>Under the bill, any biological female placed at a disadvantage after competing against a biological male has a pathway to legal<span>&nbsp;recompense: \u201cIf a student suffers direct or indirect harm, as a result of this Act being violated, that student has a private cause of action for injunctive relief, damages, and any other relief available under law, against the violating entity.\u201d<\/span><\/p>\n<p><span>Students are also granted protection from retaliation that could arise from reporting violations of the bill.<\/span><\/p>\n<p><strong>Mississippi<\/strong><\/p>\n<p><span>In early March, both chambers of Mississippi\u2019s state legislature passed a<\/span> <a href=\"https:\/\/legiscan.com\/MS\/text\/SB2536\/2021\"><span>bill<\/span><\/a> <span>to defend women\u2019s sports.<\/span><\/p>\n<p><span>The legislation instructs all athletics departments sponsored by public primary and secondary schools<\/span> <span>\u2014<\/span> <span>as well as teams affiliated with collegiate leagues such as the NCAA<\/span> <span>\u2014<\/span> <span>to expressly classify teams according to biological sex. Acceptable categories are \u201cmales,\u201d \u201cfemales,\u201d and \u201ccoed.\u201d<\/span><\/p>\n<p><span>The bill likewise shields schools from backlash by stating that no entity shall \u201centertain a complaint, open an investigation, or take any other adverse action against a primary or secondary school or institution of higher education for maintaining separate interscholastic or intramural athletic teams or sports for students of the female sex.\u201d<\/span><\/p>\n<p><span>\u201cWith the things that are going on across the country and the things that are even going on in the State of Mississippi, it\u2019s very wise for Mississippi to have a clear policy to protect biological females in their capacity as athletes,\u201d<\/span> <a href=\"https:\/\/onenewsnow.com\/sports\/2021\/03\/04\/mississippis-fairness-act-soon-to-become-law\"><span>said<\/span><\/a> <span>bill sponsor and State Sen. Angela Hill (R-MS), who once worked as a science teacher.<\/span><\/p>\n<p><span>Now, Gov. Tate Reeves (R-MS) plans to sign the measure into law.<\/span><\/p>\n<p><span>\u201cI will sign our bill to protect young girls from being forced to compete with biological males for athletic opportunities, he<\/span> <a href=\"https:\/\/twitter.com\/tatereeves\/status\/1367533188147519488\"><span>remarked<\/span><\/a> <span>on Twitter. \u201cIt\u2019s crazy we have to address it, but the Biden E.O. forced the issue.\u201d<\/span><\/p>\n<p><strong>Tennessee<\/strong><\/p>\n<p><span>Tennessee lawmakers approved legislation to align sports participation with the sex listed on students\u2019 birth certificates.<\/span><\/p>\n<p><span>House Bill 3<\/span> <a href=\"https:\/\/legiscan.com\/TN\/text\/HB0003\/2021\"><span>recognizes<\/span><\/a> <span>that \u201cparticipation, recruitment, and scholarships can be directly and negatively affected by new school policies permitting boys who are male in every biological respect to compete in girls\u2019 athletic competitions if they claim a female gender identity.\u201d Allowing biological males to participate in female sports \u201cdiscriminates against girls by regularly resulting in boys displacing girls in competitive events.\u201d<\/span><\/p>\n<p><span>These disparities are attributable to \u201chaving more skeletal muscle mass than girls and more upper-body and lower-body strength, which can result in injury to girls if girls participate in contact sports with boys.\u201d As with other states\u2019 measures, the Tennessee legislature therefore mandates that school districts separate the two sexes in sporting events.<\/span><\/p>\n<p><span>However, dubbing it \u201chateful,\u201d the<\/span> <a href=\"https:\/\/www.wgnsradio.com\/article\/66703\/aclu-statement-on-bill-excluding-transgender-student-athletes-passing-tennessee-senate\"><span>ACLU<\/span><\/a> <span>was not thrilled with the legislation\u2019s passing.<\/span><\/p>\n<p><span>\u201cAttempting to embed discrimination against transgender girls into state law, Tennessee senators voted today to ban transgender girls from participating in school sports,\u201d commented ACLU of Tennessee Executive Director Hedy Weinberg. \u201cProtecting women\u2019s sports is important, but transgender girls do not threaten them.\u201d<\/span><\/p>\n<p><span>The left-leaning legal nonprofit announced an intention to fight the bill in court upon passage.<\/span><\/p>\n<p><strong>Texas<\/strong><\/p>\n<p><span>A similar bill in Texas<\/span> <a href=\"https:\/\/capitol.texas.gov\/tlodocs\/87R\/billtext\/pdf\/HB01458I.pdf#navpanes=0\"><span>declares<\/span><\/a> <span>that \u201conly students of the same biological sex\u201d may compete in sports leagues together.<\/span><\/p>\n<p><span>Specifically, House Bill 1458 says that \u201ca biologically male student may not participate in an athletic team\u2026 that is designated for participation by only biologically female students.\u201d Students can bring action for relief if they are \u201cdeprived of an athletic opportunity\u2026 as a result of a violation\u201d of the bill by an \u201cinstitution of higher education.\u201d&nbsp;<\/span><\/p>\n<p><span>State Rep. Valoree Swanson (R-TX)<\/span> <a href=\"https:\/\/www.texastribune.org\/2021\/01\/30\/texas-republicans-transgender-students-sports\/\"><span>lamented<\/span><\/a> <span>that \u201cthis bill is a common sense measure that is sadly necessary in a world where male athletes are robbing women of both championship trophies and educational opportunities.\u201d<\/span><\/p>\n<p><span>State Sen.
