The coalition argues that\u2062 this law violates the First\u2062 Amendment.<\/p>\n<\/blockquote>\n<h3>Challenging Texas&#8217;s Age Verification Law<\/h3>\n<blockquote>\n<p>The lawsuit, filed in the Western District of Texas on Aug. 4, seeks to block the implementation\u200b of H.B. 1181, the state&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/pornhub-sues-texas-over-age-verification-law\/\" title=\"Pornhub files lawsuit against Texas over age verification legislation.\">recently passed <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/parents-dont-let-the-chinese-communist-party-protect-kids-from-screens-more-than-you-do\/\" title=\"Parents, Don\u2019t Let The Chinese Communist Party Protect Kids From Screens More Than You Do\">age verification law<\/a><\/a>, which is set to take effect on Sept.\u2064 1. Governor Greg Abbott signed the legislation into law on June 15. While other states have \u200dalso passed similar \u200blaws, Texas is the first to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-equality-act-is-the-greatest-threat-to-religious-freedom-in-our-lifetime-we-must-stand-against-it\/\" title=\"The \u2018Equality Act\u2019 Is The Greatest Threat To Religious Freedom In Our Lifetime. We Must Stand Against It.\">face legal action<\/a> from the industry.<\/p>\n<\/blockquote>\n<h2>Debate: Republican 2024 Field&#8217;s Stance on\u2062 Key Issues<\/h2>\n<p>The coalition argues that the age verification \u200bmethod mandated by Texas is both ineffective\u200d and overly restrictive in achieving\u200b its stated goal of protecting\u200d minors. They point out that minors \u2064can easily bypass the\u200c age \u200bverification by using \u2064virtual private networks (VPNs) to access the websites.<\/p>\n<p>In their lawsuit,\u2062 the\u2063 coalition alleges that \u200cTexas has violated\u2064 multiple constitutional rights, including\u200c the First Amendment right\u2064 to free speech, the due \u200bprocess requirement of the \u200b14th Amendment, and the excessive fines clause of the Eighth Amendment. They\u2064 also assert \u200bthat the websites are\u2064 protected by Section 230\u2064 of the Communications Decency\u200d Act, which shields platforms from being held\u200d responsible for user-generated content.<\/p>\n<p>H.B. 1181 mandates that adult websites display a &#8220;Texas Health and Human Services Warning&#8221; in 14-point font and require users to \u200dverify their age. The warning highlights the potential biological addiction of pornography, its negative impact on brain development, desensitization of brain reward circuits, increased conditioned responses, and \u200cweakened brain function.<\/p>\n<p>Texas is not alone in implementing \u200dage verification requirements. Louisiana was one of the \u200cfirst states to do so in January, requiring users to provide a government-issued ID before accessing pornographic websites.
