This designation \u2064provides \u2062a measure of independence from the Justice\u200c Department. Weiss has been investigating Biden&#8217;s taxes and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-calls-travel-lid-for-wednesday-an-hour-after-bobulinski-interview-airs\/\" title=\"Biden Calls Travel Lid for Wednesday an Hour After Bobulinski Interview Airs\">foreign business dealings<\/a> since 2018,\u200d but both he \u200cand Garland \u200chave \u200cfaced\u2062 scrutiny\u2063 over what Republicans claim is a favorable treatment for the embattled first son.<\/p>\n<p>In June, Weiss agreed\u2063 to a plea deal\u200d with Biden on two misdemeanor charges for failure\u2062 to pay taxes. However, this \u200bplea deal fell apart during a July hearing, leading to an impasse\u2062 between prosecutors and Biden&#8217;s \u200clegal team. In a motion filed in federal court \u2063on Friday, Weiss stated, &#8220;A trial is \u2062in order.&#8221;<\/p>\n<p>This announcement marks\u200b a stunning turnaround\u2064 for\u2062 Garland, who had \u2062previously resisted \u2064Republican calls for a special counsel to handle \u200bthe politically charged investigation. Republicans remain skeptical of Weiss&#8217;s ability to lead an impartial investigation, citing his previous &#8220;sweetheart plea deal&#8221; with\u2064 the president&#8217;s son.<\/p>\n<p>&#8220;David Weiss can&#8217;t be trusted, and this is just a new way to \u200bwhitewash the Biden family&#8217;s corruption,&#8221; Republicans on the House Judiciary Committee said in a statement.<\/p>\n<p>Two IRS whistleblowers have accused Weiss\u2064 and\u2063 the Justice Department of being lenient in \u2064the investigation\u2063 for \u200dpolitical reasons. \u200bOne of the whistleblowers, Gary \u200cShapley, claimed that Weiss initially \u2063wanted to \u2062charge Hunter Biden with felony tax crimes and \u2062had\u200d <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-bombshell-whistleblowers-say-irs-recommended-felony-tax-charges-against-hunter-biden-the-doj-overruled\/\" title=\"Whistleblowers claim IRS suggested felony tax charges for Hunter Biden, but DOJ disagreed.\">sought special counsel status<\/a> \u2064last year.\u200c Republicans \u200dhave also criticized Weiss for \u2062not \u200dcharging Biden with\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/garland-appoints-special-counsel-to-oversee-hunter-biden-probe\/\" title=\"Garland assigns special counsel for Hunter Biden investigation.\">violating\u200b foreign agent laws\u200c related<\/a> \u2063to\u2063 his work in China, Ukraine, and \u200bRomania.<\/p>\n<p>&#8220;Weiss \u2063advised me that in his\u200d judgment his investigation \u2063had reached \u2063a stage \u2064at which \u200bhe should continue his\u2062 work as a special counsel, and he asked to be so appointed,&#8221; Garland said on Friday.<\/p>\n<p>In his motion, Weiss also requested to\u2063 move\u2064 Biden&#8217;s criminal tax case from Delaware\u200b to the\u2064 Central District\u2063 of California or to the District \u2064of Columbia, where the alleged offenses\u2064 took place. This \u200brequest could explain why Garland granted\u2064 Weiss special counsel status. IRS whistleblower \u2062Shapley testified before Congress in June that prosecutors appointed \u200dby Joe Biden in California and \u200cWashington, D.C., had rejected Weiss&#8217;s requests\u200c in 2022 \u200cto charge the first son in\u2062 their jurisdictions. Shapley claimed that these\u200c moves had\u2062 prevented \u200cWeiss from bringing more severe charges\u200b against Hunter Biden.<\/p>\n<p>However, in a July letter to Senate Judiciary ranking member \u2062Lindsey Graham, Weiss rejected Shapley&#8217;s \u2063accusations, stating that he had &#8220;never been denied \u2063the authority to bring charges in any jurisdiction.&#8221;<\/p>\n<p>Shapley&#8217;s attorney, Tristan Leavitt, offered a more sinister explanation for Weiss&#8217;s \u200cappointment,\u200c calling it\u200d a\u2062 &#8220;strategy to forestall congressional investigations.&#8221;<\/p>\n<p>Weiss&#8217;s motion indicates that additional charges\u200b against Hunter Biden could also be\u2062 considered. &#8220;The government, \u2064in the exercise of its prosecutorial discretion, is considering what tax charges to bring in another\u200c district \u200cand may elect to bring \u2063the same \u2064charges set forth in the instant information or\u2062 different ones,&#8221; Weiss said in the motion.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>&#8220;A trial is necessary,&#8221; stated U.S. attorney David Weiss in a court filing on Friday.
