Twitter went to \u200ccourt, but in \u200bFebruary the \u200dDistrict Court sided with Smith and\u2064 imposed a\u200d $350,000 fine against Twitter for not complying fast enough.<\/p>\n<p>The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/u-s-navy-fined-for-software-piracy\/\" title=\"U.S. Navy Fined for Software Piracy\">appellate court sided<\/a> against Twitter as well and agreed that\u2062 the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/facebook-bans-gop-account-allows-inflammatory-dnc-ads\/\" title=\"Facebook bans GOP account, allows inflammatory DNC ads\">social media giant<\/a> should be fined $350,000 \u200cas the District court had ordered.<\/p>\n<p>The ruling added a footnote about the initial thought process of U.S. District\u2064 Court Beryl Howell, who heard the initial case \u2064but stepped down in March, when she agreed that Trump\u200b should not be\u2064 told what Smith was doing.\u00a0 Howell was appointed by former President Barack Obama, according to the \u2064 <a href=\"https:\/\/dailycaller.com\/2023\/08\/10\/dc-judge-trump-twitter-flee-prosecution\/\" target=\"_blank\" rel=\"noopener\">Daily Caller<\/a>.<\/p>\n<blockquote>\n<p>\u201cThe district court also found reason to believe that the former \u2062President \u2062would \u2018flee from prosecution,\u2019\u201d the\u2064 ruling\u200c said in a footnote.<\/p>\n<p>\u201cThe government later acknowledged, \u2063however, that it\u200d had \u2018errantly included flight from prosecution as\u200b a predicate\u2019\u2062 in its application. \u2026 The district court\u2063 did not \u200crely on risk of flight in its ultimate analysis,\u201d the footnote in the ruling said.<\/p>\n<\/blockquote>\n<p>The appellate <a href=\"https:\/\/www.westernjournal.com\/problem-trump-will-not-qualify-gop-debates-sticks-convictions\/\" target=\"_blank\" rel=\"noopener\">court ruling<\/a> \u2064did\u200b not provide further \u200ccontext. At the time, Trump faced\u200b no charges. The <a href=\"https:\/\/themessenger.com\/politics\/trump-flight-risk-federal-judge-ruling-indictments\" target=\"_blank\" rel=\"noopener\">Messenger<\/a> reported that Howell never withdrew her flight risk concerns, even if they were never\u200d acted upon.<\/p>\n<p>The ruling did note that\u200b \u201cthe district court found that there \u200cwere \u2018reasonable grounds to believe\u2019 that disclosing the warrant to \u200bformer \u200bPresident Trump\u2063 \u2018would \u200bseriously jeopardize the ongoing investigation\u2019 by\u2063 giving him \u2063\u2018an\u200c opportunity to destroy evidence, change\u2064 patterns of behavior, [or] notify confederates.\u2019\u201d<\/p>\n<p>The appellate court \u200bnoted that the nondisclosure order stayed in effect for\u2063 180 days, which is\u2062 why \u200ba case decided in February is just making the news now.<\/p>\n<p>In examining the secrecy surrounding \u200dthe probe \u200cof Trump\u2019s Twitter account and the allegation of being a flight \u200brisk, legal scholar Jonathan Turley\u2064 of George Washington University Law School said on his <a href=\"https:\/\/jonathanturley.org\/2023\/08\/10\/federal-court-declares-trump-a-flight-risk-in-secret-subpoena-decision\/\" target=\"_blank\" rel=\"noopener\">website<\/a> that \u201cNeither seems\u2062 warranted in this case even assuming\u200b that the subpoena was in other\u200d respects warranted.\u201d<\/p>\n<p>\u201cThe court found that Trump might change his course of conduct\u2062 but\u2064 that seems unlikely. If anything\u200d Trump has been most consistent in his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gop-congressman-sees-opening-in-north-carolina-attorney-general-race-as-focuses-shift-to-state-politics\/\" title=\"GOP congressman eyes opportunity in NC attorney general race as attention turns to state politics.\">social media practices<\/a>. Indeed, while some of us have criticized\u2063 him for his posting, he has remained entirely undeterred,\u201d\u2063 Turley wrote.<\/p>\n<p>As for <a href=\"https:\/\/www.westernjournal.com\/interviewer-kicked-off-trumps-plane-face-45-one-laughing-now\/\" target=\"_blank\" rel=\"noopener\">destroying evidence<\/a>, Turley noted, \u201cIt\u2062 is not clear how Trump\u200b would destroy the \u200devidence in possession of Twitter, particularly after\u2064 the company is informed that it \u200bmust preserve and disclose the meta data.\u201d<\/p>\n<p>Turley then turned to\u200c the supposed concern from Howell that Trump might flee.<\/p>\n<p>\u201cProcess that for a second. Trump has 24\/7 security. So\u2063 Howell agreed that he might shake his sizable security detail, evade them, and\u2062 go on the lam.\u2064 He is one of \u2062the most recognized figures in the world. He would have\u200c to go to Mars to live \u2063incognito,\u201d he wrote.<\/p>\n<p>\u201cIt is facially absurd. Trump has been\u2062 sued and criminally charged across the\u2062 country. He has never made a break for it. Where\u2062 would he go? Cuba?\u201d Turley wrote.<\/p>\n<p>The flight risk finding \u201cundermines the credibility of the court\u2019s\u2063 order. This is not to question the ability to force the release of the\u2062 information.
