While\u200c the \u200cmeasure was only temporary and set to\u200d expire in 2022, the San Francisco Board \u200cof Supervisors voted in October 2021 to make the \u200cchange permanent.<\/p>\n<p>Following last \u200cyear\u2019s <a href=\"https:\/\/thefederalist.com\/2022\/02\/16\/east-coast-west-coast-it-turned-out-everyone-was-mad\/\" target=\"_blank\" rel=\"noreferrer noopener\">historic recall election<\/a> that resulted \u2062in San Francisco voters\u2063 ousting three leftist school board \u2064members, the U.S. Justice \u2063Foundation and California Public \u2062Policy Foundation filed a lawsuit against the city, arguing the measure constituted a violation of the Constitution of \u200cCalifornia.\u200b The Superior Court of San Francisco ultimately agreed, <a href=\"https:\/\/www.sfexaminer.com\/news\/politics\/state-court-backs-sf-law-allowing-noncitizens-right-to-vote\/article_90c188c0-363e-11ee-a9bf-6734c3c79516.html\" target=\"_blank\" rel=\"noreferrer noopener\">ruling<\/a> in July \u20622022 that the measure runs \u201ccontrary to the California \u2062constitution and state statutes and thus \u2062cannot stand.\u201d<\/p>\n<p>While California\u2019s constitution\u200b <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/codes_displayText.xhtml?lawCode=CONS&#038;division=&#038;title=&#038;part=&#038;chapter=&#038;article=II\" target=\"_blank\" rel=\"noreferrer noopener\">states<\/a> that \u201cA United States \u200bcitizen 18 years of age\u200d and\u200b resident in this State \u2064may vote,\u201d the California Court of Appeal used legal gymnastics to justify its decision to uphold San Francisco\u2019s\u2062 non<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/rnc-sues-nyc-over-noncitizen-voting-rights-law-american-elections-should-be-decided-by-american-citizens\/\" title=\"RNC Sues NYC Over Noncitizen Voting Rights Law: \u2018American Elections Should Be Decided By American Citizens\u2019\">-citizen voting law<\/a>. According\u200c to the <a href=\"https:\/\/www.sfexaminer.com\/news\/politics\/state-court-backs-sf-law-allowing-noncitizens-right-to-vote\/article_90c188c0-363e-11ee-a9bf-6734c3c79516.html\" target=\"_blank\" rel=\"noreferrer noopener\">Examiner<\/a>, \u2064the court\u2019s majority claimed the state constitution \u201c\u2018affirmatively\u2019 lays out who is eligible\u2062 to\u2062 vote, but does not expressly prohibit\u2064 cities\u200c from expanding that right.\u201d<\/p>\n<p>For\u200d a party that loved to feign outrage about <a href=\"https:\/\/thefederalist.com\/tag\/russian-collusion-hoax\/\" target=\"_blank\" rel=\"noreferrer noopener\">nonexistent Trump-Russia collusion<\/a> and \u201cforeign interference\u201d in\u2064 the elections process \u2064after the 2016 presidential contest, Democrats throughout the country seem awfully eager to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/oklahoma-senate-moves-to-ensure-only-u-s-citizens-are-voting-in-state-elections\/\" title=\"Oklahoma Senate Moves To Ensure Only U.S. Citizens Are Voting In State Elections\">grant illegal aliens<\/a> \u2064the ability to influence U.S. electoral processes.<\/p>\n<p>Leftist-controlled cities\u2063 such as Washington, D.C., have <a href=\"https:\/\/thefederalist.com\/2023\/06\/07\/house-republicans-shine-a-light-on-foreign-interference-in-d-c-elections\/\" target=\"_blank\" rel=\"noreferrer noopener\">adopted<\/a> measures in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-court-greenlights-foreign-interference-in-san-franciscos-school-board-elections\/\" title=\"California court approves foreign interference in SF school board elections.\">recent years permitting foreign nationals<\/a> to \u2063vote in local elections.\u2062 Unsurprisingly, Republican-backed efforts to <a href=\"https:\/\/www.foxnews.com\/politics\/democrats-vote-against-motion-condemning-illegal-immigrant-voting\" target=\"_blank\" rel=\"noreferrer noopener\">condemn<\/a> \u2014 or, in\u2063 the case of Washington, D.C.,\u200c <a href=\"https:\/\/thefederalist.com\/2023\/07\/14\/over-70-nonprofits-call-on-congress-to-pass-republicans-election-integrity-bill\/\" target=\"_blank\" rel=\"noreferrer noopener\">repeal<\/a> \u2014 such \u2062measures have been met with \u2062resistance from Democrats.<\/p>\n<hr>\n<p>Shawn\u2062 Fleetwood is a staff writer for The Federalist and a graduate of \u200cthe University \u200cof Mary Washington.
