Westcott had also been battling Huntington\u2019s disease since 2015, the documents state.<\/p>\n<\/blockquote>\n<h3>Refusal to Back Out<\/h3>\n<blockquote>\n<p>Westcott tried to back out of the sale days later when he said the influence \u200bof the painkillers wore off, but Perry and Bloom refused his request and threatened to sue if he did not go through with the\u200d sale.<\/p>\n<\/blockquote>\n<h3>Heading to \u2064Trial<\/h3>\n<blockquote>\n<p>The case will head to trial this month, the outlet noted.<\/p>\n<\/blockquote>\n<h3>Unintentional Sale<\/h3>\n<blockquote>\n<p>Westcott\u200c claims \u2064he never listed the home for\u2064 sale or enlisted the services of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/airbnb-to-ban-landlords-who-evicted-tenants-during-coronavirus-from-listing-properties\/\" title=\"AirBnB To Ban Landlords Who Evicted Tenants During Coronavirus From Listing Properties\">real estate professional<\/a> with the intention to sell. He said he purchased the 9,285 square-foot, eight-bedroom, 11-bathroom home in May\u200c 2020, just two months before selling it to Perry and\u200c Bloom. Westcott \u200bsaid he\u2062 had intended to live there \u201cfor the rest of his life.\u201d<\/p>\n<\/blockquote>\n<h3>Unsound Mind<\/h3>\n<blockquote>\n<p>Westcott had back surgery\u200d in \u200dJuly 2020 and three days later signed the paperwork after being presented with a written offer from Perry and Bloom for more money than he\u200d paid for the property in May.<\/p>\n<\/blockquote>\n<blockquote>\n<p>\u201cUpon discharge from the hospital, Mr. Westcott was prescribed at least two opiates in pill form that he was to continue taking for \u2062pain, which he took as prescribed several\u2064 times each day,\u201d the complaint \u2063says,\u200c per Daily Mail. <\/p>\n<\/blockquote>\n<h3>Mental Incapacity<\/h3>\n<blockquote>\n<p>The veteran\u2019s \u200dlawyers argue he was \u201cunable to understand the nature and \u200cprobable consequences of his\u2064 actions\u201d due \u200bto being on pain medication. They say their client is \u201cin the final years of his life and cannot sell his home.\u201d<\/p>\n<\/blockquote>\n<h3>Legal Obligation<\/h3>\n<blockquote>\n<p>A\u200c representative for Perry and Bloom sent a\u2062 letter following Westcott\u2019s request to rescind the documents, saying he\u2063 was legally obligated to complete the sale \u200bof the home.<\/p>\n<\/blockquote>\n<h3>Family Battle<\/h3>\n<blockquote>\n<p>Westcott will not attend\u200b the trial because he is mentally incapacitated and bedridden, leaving his family \u200dto fight the celebrity couple over who \u2063should be the rightful owners of the estate.<\/p>\n<\/blockquote>\n<h3>Perry&#8217;s Previous Property\u2062 Dispute<\/h3>\n<blockquote>\n<p>Perry has been involved in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/katy-perry-and-orlando-bloom-headed-to-court-for-property-dispute-over-15m-santa-barbara-estate\/\" title=\"Katy Perry and Orlando Bloom in court over M Santa Barbara property dispute.\">high-profile property dispute<\/a> before. \u2062In 2015, she fought two Roman Catholic nuns over the sale of a\u200b Los Angeles convent sold\u200b to the singer \u200dby Archbishop Jose\u2063 Gomez.
