J.D. Vance (R., Ohio) is asking the Federal\u200b Trade Commission to\u200d investigate whether elite universities are coordinating their admissions policies in response to the Supreme Court\u2019s\u200c ban on \u200baffirmative action, arguing that a synchronized\u2064 effort to evade the ruling would violate\u2063 antitrust law.\n  <\/p>\n<p>    \u200d  Schools &#8220;may be tempted to jointly adopt new and\u200d experimental policies,\u200b such as preferences for low-income students, assured in \u2062the knowledge that their competitors will not do otherwise,&#8221; Vance <a href=\"https:\/\/freebeacon.com\/wp-content\/uploads\/2023\/08\/Sen.-Vance-Letter-To-FTC-8.10.23.pdf\">wrote in\u200c a letter<\/a> to FTC chair Lina Kahn on Thursday morning. &#8220;For example, it would raise alarms for federal authorities if other elite schools were to copy \u200bColumbia Law School\u2019s recent \u2064(and now rescinded) effort to have applicants submit\u200c a video statement, thus allowing admissions officers to\u2062 observe their race.&#8221;\n  <\/p>\n<p>    Vance&#8217;s letter comes as 17 colleges are <a href=\"https:\/\/www.reuters.com\/legal\/litigation\/students-suing-elite-us-colleges-seek-wealth-favoritism-information-2023-02-09\/#:~:text=The%20prospective%20class%20action%20filed,the%20schools%20to%20dismiss%20it.\">fending off\u200c a lawsuit<\/a> backed by the <a href=\"https:\/\/www.highereddive.com\/news\/justice-department-suggests-continuing-antitrust-lawsuit-against-top-ranked\/626905\/\">Justice Department<\/a> over <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/vance-asks-ftc-to-investigate-universities-over-alleged-admission-policy-collusion-following-affirmative-action-ban\/\" title=\"Vance urges FTC to probe universities for alleged admission policy collusion after affirmative action ban.\">alleged price-fixing<\/a> in their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/princeton-makes-tuition-free-for-most-households-under-100000\/\" title=\"Princeton makes tuition free for most households under 0,000\">financial aid policies<\/a>. The ban on racial preferences could add to those antitrust headaches if universities\u2014seeking \u200cto preserve the demographic \u2064makeup of their classes\u2014agree behind \u2062the scenes \u200cto \u200cadopt the same admissions practices. Like regular corporations, colleges <a href=\"https:\/\/www.highereddive.com\/news\/justice-department-suggests-continuing-antitrust-lawsuit-against-top-ranked\/626905\/\">cannot collude<\/a> in ways that dampen competition and harm consumers.\n  <\/p>\n<p>    \u200b Such collusion\u200d may be happening\u2064 already, Vance&#8217;s letter \u2064suggests. In the wake of the Supreme Court\u2019s decision, Vance pressed the presidents of eight Ivy \u2062League colleges, \u2063as well \u2063as Oberlin and Kenyon, for information\u2064 about their compliance with the ruling. He received replies from every school except Yale\u2014all of which bore an &#8220;uncanny similarity&#8221; in &#8220;substance and structure,&#8221; Vance\u2019s letter to Kahn states.\n  <\/p>\n<p>    \u200c Each was \u2063&#8221;roughly the same length,&#8221; used &#8220;more or less identical phrasing,&#8221; and\u2062 with one exception was signed by\u2064 a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/shock-and-awe-disney-quietly-surrenders-to-desantis-gop\/\" title=\"\u2018Shock And Awe\u2019: Disney Quietly Surrenders To DeSantis, GOP\">government affairs official<\/a> rather than a university president. Most were also sent the same day, July 21, according to copies of the replies reviewed by the <em>Washington\u200d Free Beacon<\/em>, and\u200c pledged to pursue diversity without violating the law.\n  <\/p>\n<p>    &#8220;It is hard to believe that the schools responding to my letter could achieve such remarkable parallels in the absence of coordination or collusion,&#8221; Vance told Kahn. &#8220;It is nearly impossible to believe that they would do so using the same structure, vocabulary,\u200c tone, and brevity.&#8221;<br \/>\n\u2063\n  <\/p>\n<p>    Some passages in the replies are almost indistinguishable from \u200ceach other. Brown said it was committed to &#8220;fostering the diversity that confers educational\u200b benefits for students.&#8221;\u2064 Columbia said that &#8220;diversity is central\u2064 to our identity,&#8221; &#8220;foster[s] meaningful interactions,&#8221;\u2063 and &#8220;prepare[s] students to make a\u2064 difference in \u200bthe world.&#8221; Dartmouth said diversity is a &#8220;critical component of [students\u2019] education&#8221;\u200b that\u2062 &#8220;prepares them for \u200ba lifetime of learning and of responsible leadership.&#8221;\n  <\/p>\n<p>    Those similarities could indicate that the schools are communicating about the best\u2063 way to respond to the Supreme Court\u2019s ruling, Vance\u2019s letter said. He called on the FTC to investigate their potentially &#8220;collusive behavior,&#8221; using its subpoena power to obtain information\u2064 from the schools about their communications with each\u200d other.\n  <\/p>\n<p>    &#8220;Coordinating the \u2064response to a Senator\u2019s\u2064 letter is one \u200bthing,&#8221; Vance wrote. &#8220;Coordinating admissions policies in the wake of the Harvard \u2064College decision is quite another.&#8221;\n  <\/p>\n<p>    \u2063   The nine colleges did not respond to requests for comment.\n  <\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Ohio Senator J.D.
