This decision was based on the Supreme Court&#8217;s landmark ruling \u2064from last year.<\/p>\n<p>Under the federal statute\u2064 known as 18 U.S.C. \u00a7 922(g)(3),\u2064 individuals classified as &#8220;unlawful users of or addicted to any controlled substance,&#8221; <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-does-damage-control-after-firing-staffers-for-past-marijuana-use\/\" title=\"White House does damage control after firing staffers for past marijuana use\">including marijuana<\/a>, could be banned from owning firearms. Violating this\u200b law could result in up to 10 years in prison.<\/p>\n<p>The recent ruling only\u2064 applies\u2064 to Texas,\u2063 Louisiana, and Mississippi. However, it has a direct impact on\u2064 the case of Patrick Daniels, who challenged the law. Daniels, who was convicted \u200bin July 2022, will now have\u200b his conviction overturned. He had been sentenced to nearly four years in prison and three years of probation after being\u2062 arrested in April 2022. Law enforcement officers found marijuana and two loaded firearms in his \u200ccar.<\/p>\n<p>The case, known\u200c as U.S. v. Daniels,\u2062 was written by Judge Jerry Smith, with Judges Stephen Higginson and \u200dDon Willett joining. They concluded that the law \u2064violated the Second Amendment and did not align with the Supreme Court&#8217;s test established in Bruen v. New York Rifle &#038; Pistol Association. This test states that firearms \u200claws must adhere to \u2063the nation&#8217;s &#8220;historical tradition of firearm \u200bregulation.&#8221;<\/p>\n<blockquote>\n<p>&#8220;Just as there was no historical justification for disarming a citizen \u200dof sound mind, there is no tradition that supports disarming\u2063 a sober citizen who is not currently under an impairing influence,&#8221; Smith wrote. \u200d&#8221;Indeed, it is helpful to compare the tradition surrounding the insane\u2064 and \u200bthe tradition surrounding the intoxicated side-by-side.&#8221;<\/p>\n<\/blockquote>\n<p>The\u2064 federal statute applied\u200c not only when a person was intoxicated but\u2062 also when they were sober and in possession of a controlled substance.<\/p>\n<p>The opinion further suggests that while the \u200cfounders &#8220;institutionalized the \u200dinsane and stripped them of their guns,&#8221; they allowed alcoholics to possess firearms while sober.<\/p>\n<p>This ruling by the 5th Circuit marks the \u200bfirst\u2062 time \u2063an appellate court has declared two separate \u2062federal laws invalid under the Bruen test. Previously, \u200dthe court voided a federal statute\u2064 that\u2062 made it\u2063 a crime for someone subject to\u2062 a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-gun-law-used-in-hunter-biden-case-voided-by-appeals-court\/\" title=\"Appeals court nullifies federal gun law in Hunter Biden case.\">domestic\u200b violence restraining order<\/a> to\u200b possess a firearm. This ruling is\u200d currently being appealed and is awaiting oral arguments at the Supreme Court.<\/p>\n<p>Judge Higginson, who agreed with the outcome of the Daniels decision, \u2062expressed concerns about the\u200c scope of the Bruen test. He believes that the Supreme Court&#8217;s decision on the domestic\u200d violence statute will likely impact the result of this case.<\/p>\n<blockquote>\n<p>&#8220;Uncertainty and upheaval resulting from best efforts to apply Bruen now extend far beyond our dockets. Myriad and obvious public safety laws, some over a century old, face\u200c inconsistent invalidation,&#8221; Higginson wrote.<\/p>\n<\/blockquote>\n<p>Higginson also highlighted the inconsistencies in how lower courts have interpreted the Bruen test. Some courts, like the\u200b 5th\u200d Circuit,\u200c have taken it to its far reaches, while others have been cautious \u200dabout its application to existing \u200dfirearms regulations.<\/p>\n<p>It\u2063 is worth noting that Hunter Biden, President Joe Biden&#8217;s son, is currently negotiating a \u2062plea deal with prosecutors in Delaware under the same federal statute that was struck \u2062down by the appeals court.<\/p>\n<p>Brandon Beck, an assistant professor of law at Texas Tech University, described 18 U.S.C. \u00a7 922(g)(3) \u200das &#8220;garbage.&#8221; He argued that the language \u2062of the statute could potentially \u200bmake even users of \u2064Adderall liable.<\/p>\n<blockquote>\n<p>&#8220;This statute is garbage. It has been since \u2063it was enacted in 1986. And people that\u2064 work in this area know it, but this is the first time\u200b the judges are just kind of finally saying, &#8216;Oh, maybe there is something wrong here,'&#8221; Beck said.<\/p>\n<\/blockquote>\n<p>While the ruling in Daniels is seen as \u2062a victory for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nra-mothers-day-tweet-of-little-girl-holding-a-rifle-sparks-backlash\/\" title=\"NRA Mother\u2019s Day Tweet Of Little Girl Holding A Rifle Sparks Backlash\">gun rights advocates<\/a>, Judge Higginson&#8217;s language in the opinion serves as a warning.\u2063 He cautions against any\u2062 further reductionism of the Bruen precedent,\u200c as it\u200c could lead \u200bto the dismantling of \u2064laws that have protected the country for generations.<\/p>\n<blockquote>\n<p>&#8220;This state of affairs will be nothing less than a Second Amendment caricature, \u200da right turned inside out, against freedom and security in our State,&#8221; Higginson\u200d added.<\/p>\n<\/blockquote>\n","protected":false},"excerpt":{"rendered":"<p>The 5th Circuit Court of Appeals nullified a federal law that prohibited illegal drug users from owning firearms.
