Does the First Amendment still exist?\u201d<\/p>\n<figure class=\"wp-block-image size-large\"><\/figure>\n<\/blockquote>\n<p>U.S. District Court Judge \u2064Beryl Howell, an Obama-appointee, \u200dfined the social media \u2064platform $350,000 for missing the deadline to comply with the\u200b warrant.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt is outrageous what they did,\u201d Mike Davis, founder and president of the Article III \u200cProject, told One America News.<\/p>\n<\/blockquote>\n<p>Court documents <a href=\"https:\/\/www.cadc.uscourts.gov\/internet\/opinions.nsf\/64C651B4E1AD395485258A06005B09BD\/%24file\/23-5044-2011549.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">show<\/a> \u2063that \u2063Smith applied for, and \u2063received, a search warrant on Jan.\u2063 17,\u2064 2023. Smith also obtained a nondisclosure agreement which prohibited Twitter from \u201cdisclosing the existence or contents of the search warrant to \u2062any \u200bperson.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhy was this all done in secret,\u201d Davis asked. \u201cWhy didn\u2019t they let \u2063President \u200dTrump \u2062know that they\u2019re trying to obtain his Twitter accounts?\u201d<\/p>\n<\/blockquote>\n<p>Twitter ultimately resisted complying with\u2063 the\u2062 warrant\u2062 four \u200cdays after the deadline, arguing that the \u201cnondisclosure \u200dorder was facially invalid under the First Amendment.\u201d <\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[Beryl Howell] grants this \u2063secret search warrant Twitter files of appeal \u2062to the DC circuit,\u201d said Davis. \u201cAnd you had these two \u200bBiden appointed\u2063 judges, \u200dalong with an Obama appointed judge,\u2064 bless\u200c this secret warrant for President Trump\u2019s Twitter accounts when he was the president of the United\u200c States.\u201d<\/p>\n<\/blockquote>\n<p>Davis points\u2062 out that the United States Court of Appeals for the Second Circuit in 2019 ruled that Trump\u2019s Twitter account \u200dwas a \u201cpublic forum.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis is after a separate appellate court,\u200d the Second Circuit, \u200bsaid that Trump\u2019s Twitter account was a public\u2062 forum,\u201d said Davis.\u2062 \u201cSo you \u200bhave \u2062to ask why didn\u2019t the Biden Justice Department raise the\u2063 question \u200dof presidential immunity? But\u200d Davis says the situation \u201cstinks \u2063to high hell.\u201d<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWhat evidence do they have that [Trump\u2019s] \u200c going to \u200bgo in and delete his tweets,\u201d Davis said. \u201cThe tweets are public. Or\u200d if there \u2063are [direct messages], why wouldn\u2019t they\u2063 be \u2063able to get those direct messages from the other party with whom he\u2019s communicating?\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis is bizarre what the Biden Justice Department is doing \u200chere,\u201d Davis\u2062 continued. \u201cIt\u2019s very chilling that they\u2019re going to run over \u2062the presidential immunity and run over the First Amendment here.\u201d<\/p>\n<\/blockquote>\n<p>Howell was the same judge who ruled that Trump deliberately and knowingly misled his \u200bown attorneys\u200b about his retention of classified documents.
