After the Supreme\u200d Court struck down its $430 billion cancellation policy, President Joe Biden announced a smaller plan that would impact 800,000 borrowers at a cost of $39 billion. However, this plan has also\u200b been hit with legal challenges.<\/p>\n<blockquote>\n<p>&#8220;The one-time account adjustment is substantively and procedurally \u200cunlawful,&#8221; reads the suit, filed\u2063 on behalf of the \u2063Cato \u2063Institute and the Mackinac Center \u2063for Public Policy. &#8220;The court should declare this\u200d forbearance-credit scheme unlawful, \u200cset it aside, and enjoin any \u200dcancellation of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republicans-attack-woke-politics-as-education-secretary-outlines-department-budget\/\" title=\"Republicans Attack \u2018Woke Politics\u2019 as Education Secretary Outlines Department Budget\">student loans based<\/a> on it.&#8221;<\/p>\n<\/blockquote>\n<p>The\u200c White House argues that its \u2064latest plan is an &#8220;adjustment&#8221; to existing federal programs \u200caimed\u200b at \u200ccorrecting past mistakes\u200d and providing $39 \u2063billion in loan forgiveness. They also suggest that more borrowers could become eligible in the future.<\/p>\n<p>&#8220;President Biden continues to fight for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/fmr-white-house-economic-adviser-kudlow-slams-sen-warrens-wealth-tax\/\" title=\"Fmr. White House economic adviser Kudlow slams Sen. Warren\u2019s wealth tax\">student loan borrowers<\/a> on all fronts,&#8221; a White House official stated.<\/p>\n<p>However, the\u200c lawsuit claims that the plan \u2062was created without \u200dfollowing the required notice and comment period, instead being announced through a press release. It also alleges that the plan\u200d violates the apportionment clause of\u200d the Constitution by bypassing Congress. These were similar complaints made against\u200c the original plan.<\/p>\n<blockquote>\n<p>\u201cThe\u200b president and the Department of Education do not have \u200bauthority to unilaterally change\u200c the terms of student loans in order to cancel them,\u201d said Neal McCluskey, the director of the Cato Institute\u2019s Center for Education Reform. \u2062\u201cThis is the\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/different-student-loans-plan-same-problems-for-biden\/\" title=\"Biden faces similar issues with various student loan plans.\">executive \u2064branch essentially making law<\/a> \u200dby changing what Congress created.\u201d<\/p>\n<\/blockquote>\n<p>If successful,\u2062 the lawsuit would \u2064halt the smaller \u2063program, just as previous lawsuits stopped the larger one. McCluskey argues\u200b that changes to \u200bfederal student\u2064 loan\u200b programs must be made by Congress, acknowledging \u200cthat there are legitimate issues with loan accounting errors but stating that the program goes beyond that \u200dby partially forgiving hundreds of thousands of student loans that will ultimately go unpaid.<\/p>\n<p>According to\u200b the lawsuit, the program could potentially impact over 3.5 million \u2063borrowers, with a \u2063price tag \u200dof\u200d $175 billion.<\/p>\n<p>&#8220;Taxpayers are the ones \u200dwho have to make up for the lost revenue,&#8221; McCluskey added. &#8220;You&#8217;re hurting somebody in order to try\u2063 and benefit\u2063 somebody else.&#8221;<\/p>\n<p>Despite the lawsuit, the Biden administration\u200d is moving forward with the program and is already accepting applications\u2064 from borrowers\u2063 hoping \u2062to have their loans \u2063forgiven.<\/p>\n<p><strong>Click here to read more from The Washington Examiner.<\/strong><\/p>\n","protected":false},"excerpt":{"rendered":"<p>The Biden administration faces another lawsuit over student loan forgiveness plans.
