Court Rules For Lubbock.\">federal court dismissed<\/a> former President Donald Trump\u2019s \u2064countersuit against E.\u2064 Jean Carroll, a writer who is accusing the former president of rape\u2064 and other sexual abuse.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>The judge stated that Trump cannot argue that she defamed him\u2064 by continuing to allege she was raped and\u2063 sexually abused.<\/p>\n<p>Carroll had won her\u2062 sexual abuse lawsuit against Trump, however,\u2063 the jury also \u200bdeclared that he did not\u200d rape her, like she claims. Rape and sexual abuse\u200b are classified differently.<\/p>\n<p>The decision also reportedly ends Trump\u2019s efforts\u200b to turn the legal tables on E. Jean\u2062 Carroll, who is now pursuing her own defamation claim against \u200bhim. <\/p>\n<p>Alina\u200d Habba, Trump\u2019s \u2064attorney,\u200b stated that his team will be \u201cchallenging \u200cthe flawed decision.\u201d<\/p>\n<p>Carroll\u2019s lawyer, Robbie Kaplan, \u200bsaid she was delighted with the\u200d dismissal and is looking forward to the trial in January, which involves a series\u200c of statements Trump made in disputing her <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-hypocritical-response-of-progressive-women-on-the-cuomo-sexual-harassment-allegations\/\" title=\"The Hypocritical Response Of Progressive Women On The Cuomo Sexual Harassment Allegations\">sexual assault accusation<\/a>.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cE. Jean Carroll\u2062 looks forward to obtaining additional compensatory and punitive damages\u201d in that trial, Kaplan said.<\/p>\n<\/blockquote>\n<p>Carroll accused Trump of trapping\u200c her\u2064 in a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-dismisses-trumps-counterclaim-against-e-jean-carroll\/\" title=\"Judge dismisses Trump's counterclaim against E. Jean Carroll.\">luxury department store dressing room<\/a> in 1996. \u200dAlthough, she originally admitted that she could not remember the date(s) of the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/protestors-demand-texas-school-district-fire-leadership-over-alleged-sexual-misconduct-incident-involving-group-of-first-graders\/\" title=\"Protesters urge Texas school district to dismiss leaders over alleged sexual misconduct with first-graders.\">alleged sexual misconduct incident<\/a>. <\/p>\n<p>The writer went on to claim that Trump forced her to kiss him, ripped \u200ddown her tights, and then raped her while she tried to push him off.<\/p>\n<p>Trump has adamantly denied\u2064 all allegations, and has even \u200dlabeled the writer as a creative \u201cwhack job\u201d who made up\u2063 \u201ca fraudulent and false story\u201d in order to promote a memoir.<\/p>\n<p>A civil court jury found \u2064this spring that Trump sexually\u2064 mistreated Carroll but rejected her claim \u2063that\u2064 he raped her. Legally, the distinction \u200bwas\u200c determined by the specifics of how, \u2063in the jury\u2019s opinion, he penetrated her against her will.<\/p>\n<p>Trump \u2064then subsequently sued\u2062 Carroll, claiming that her comments were defamatory. He sought a retraction as well as financial payments as retribution.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThese false statements were clearly contrary to the\u200b jury verdict,\u201d attorneys argued\u2064 in court\u200d papers, highlighting that the panel had found that rape \u201cclearly\u200d was not committed\u201d by Trump.<\/p>\n<\/blockquote>\n<p>According to the applicable New York statute,\u2064 rape involves forcible penetration by a penis, whereas sexual abuse involves \u2064forcible penetration\u200d by a finger. Carroll claimed that both rape\u2063 and abuse had occurred.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe difference between Ms. Carroll\u2019s allegedly defamatory statements \u2014\u200d that Mr. Trump \u2018raped\u2019\u200d her as defined in the New York Penal Law \u2014 and the \u2018truth\u2019 \u2014 \u2062that Mr. Trump forcibly digitally penetrated Ms. \u2064Carroll \u2014 are minimal,\u201d said \u200dJudge Lewis A. \u2064Kaplan. \u201cBoth are felonious sex crimes.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed!
