Responding To 10+ Homeless Tent Fires A Day\">gun control law<\/a> that \u2062restricts firearm \u2062sales to individuals\u2062 aged 21 and older. The judge, Phillip Brimmer, who presides \u200cover the U.S. District of Colorado, sided with a firearms advocacy\u2064 group, Rocky\u200b Mountain \u200cGun Owners, which filed a lawsuit to prevent the \u2062enforcement of Senate Bill 169.<\/p>\n<p>The law, which went into effect on Monday, was halted\u200b by Judge Brimmer,\u2064 who\u200c determined\u200d that it contradicted a recent Supreme\u200d Court decision, \u200cBruen v. New York \u200cRifle &#038; Pistol\u2062 Association, from 2022.<\/p>\n<h3>Gun \u200cRights Group Challenges Age Limit Law<\/h3>\n<p>Rocky Mountain Gun \u2064Owners not only contested the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-halts-colorado-gun-law-citing-supreme-court-bruen-precedent\/\" title=\"Federal judge stops Colorado gun law, citing Supreme Court Bruen ruling.\">age limit law<\/a> but also challenged another\u200b provision \u200bthat would\u200b establish a waiting\u200b period for all\u2064 firearm\u2062 purchases in\u200c the state. Judge Brimmer\u2064 has yet to rule\u200d on the waiting period measure, which is set\u2064 to\u200b take effect in October.<\/p>\n<p>In his 44-page order, Judge \u200dBrimmer referenced the Bruen decision, stating, &#8220;The Court\u2063 has made clear that individual \u200drights enumerated in the Bill of Rights and made applicable against the States\u2062 through\u2062 the Fourteenth Amendment\u200d have the same scope as against the Federal \u2064Government.&#8221; He further noted that the historical understanding of the Second Amendment at\u200c the time\u2064 of the 14th Amendment&#8217;s adoption remains\u200d an &#8220;open\u2064 question,&#8221; but the state failed to present evidence that a complete ban on \u2062gun sales \u2063was ever consistent with the right to bear arms.<\/p>\n<p>Earlier \u2062this year, Democrats\u200d in the Colorado legislature passed\u200b several gun control measures, including regulations on ghost guns and expanding the eligibility\u200c criteria for <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/reports-red-flag-laws-result-in-66-firearm-confiscations\/\" title=\"Reports: Red flag laws result in 66 firearm confiscations\">extreme risk protection orders<\/a> under existing red flag laws.<\/p>\n<p>Taylor Rhodes, the executive director\u200c of Rocky Mountain\u200c Gun Owners, had previously stated their \u2062intention \u200dto file lawsuits\u200b against any laws they deemed \u200cto violate Second Amendment rights,\u2064 particularly in light of \u2062the increased scrutiny on gun control\u200d measures \u200cfollowing\u2063 the \u200cBruen decision. Rhodes remarked, &#8220;Today, our crystal ball became a reality,&#8221; after the\u2064 judge&#8217;s ruling.<\/p>\n<p>The plaintiffs\u200c in the case are two Colorado residents aged between 18 and 21 \u200cwho \u200csought to own \u2062firearms\u200d for self-defense.<\/p>\n<p>The\u2062 age \u2064restriction law made it a\u2063 Class 2 misdemeanor for individuals under 21 to purchase a gun and for private dealers \u2064to\u200d sell firearms to those under\u2062 21.
