Chutkan, appointed to the bench in\u200c 2013 by then-President Barack Obama, has an established reputation for being the toughest in D.C. when \u200bit comes to\u200b sentencing Jan. 6 defendants.<\/p>\n<p>She\u2019s known \u2064to have worked at the same law firm as President \u200bJoe Biden\u2019s notorious son Hunter Biden \u2014 at the same time\u2062 Hunter\u2064 Biden worked there.<\/p>\n<p>But\u2064 more to the point, she has\u200d already clearly \u200dmade up her mind that Trump is\u200c the man responsible for the events of that day\u2064 \u2014 and she put that opinion in writing\u2062 almost two years ago.<\/p>\n<p>It came in the \u200ccourt battle between Trump and\u200c the\u2062 puppet theater\u2064 known as the House Select Committee to Investigate the January\u200d 6th Attack on the United \u200cStates Capitol. Trump had \u200cexercised a claim of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-complains-about-fox-news-chyrons-regarding-biden-ignoring-networks-own-chyrons-during-trump\/\" title=\"CNN Complains About Fox News Chyrons Regarding Biden, Ignoring Network\u2019s Own Chyrons During Trump\">executive privilege<\/a> over documents related to\u2063 his activities that day.<\/p>\n<p>Chutkan\u2019s ruling was\u200d not in Trump\u2019s \u2062favor.<\/p>\n<p>While \u2063that Nov. 9, 2021, ruling might \u2064have been \u2062justified\u2062 as a matter of\u2063 law (it was upheld by an appeals court \u2064and allowed to stand by the Supreme \u200dCourt, according to The Washington Post), it was what accompanied the decision that\u2064 mattered:<\/p>\n<blockquote>\n<p>A\u200c background summary that effectively convicted Trump of orchestrating the Capitol\u200d incursion, from his\u200b statements prior to\u2064 the election that it could be \u201crigged,\u201d to his court challenges after \u2062the election, to \u200bthe speech \u2062he made on the Ellipse on Jan. \u200c6 itself.<\/p>\n<\/blockquote>\n<p>Her ruling\u200c quoted\u200c Trump saying \u200bin that speech, \u201cWe fight \u2062like hell. And if you don\u2019t fight like hell, you\u2019re not going to have a country anymore,\u201d and \u201cyou\u2019ll \u200dnever take back our country with weakness.\u201d<\/p>\n<p>\u201cShortly thereafter, the crowds surged from the rally,\u201d Chutkan wrote, \u201cmarched along\u200d Constitution Avenue, and commenced their siege of the Capitol.\u201d<\/p>\n<p>It was a blending\u2062 of facts worthy of a novelist \u2014 not a jurist \u2014 implicitly blaming the then-president\u2019s words \u200bfor the \u2062violence that\u200b followed.<\/p>\n<p>And it had \u2062the \u200bpropagandist\u2019s touch, leaving out a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-overseeing-trump-case-has-already-issued-the-ruling-that-matters-and-its-not-for-trump\/\" title=\"Judge's ruling in Trump case favors someone other than Trump.\">crucial \u2063sentence earlier<\/a> in\u200c the Trump speech\u2063 that made it clear he \u200cwasn\u2019t calling for violence: \u201cI \u200dknow that everyone here will soon be marching over to the Capitol building to <strong><em>peacefully and patriotically<\/em><\/strong>  make your \u200bvoices heard.\u201d (Emphasis added.)<\/p>\n<p>Independent\u2064 journalist Julie Kelly published a portion of the \u2062statement to X, the platform formerly known as Twitter, with an\u2064 observation that any <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/catholic-league-condemns-biden-administrations-war-on-men\/\" title=\"Catholic League Condemns Biden Administration\u2019s War on Men\">fair-minded person<\/a> should be able to \u2064agree \u200cwith:<\/p>\n<blockquote class=\"twitter-tweet\">\n<p dir=\"ltr\" lang=\"en\">This statement by Judge Chutkan in her landmark ruling\u200d denying Trump exec privilege protections from \u2062House Democrats J6 committee alone should be disqualifying.<\/p>\n<p>There is no\u2064 way\u200b she can objectively oversee Jack Smith\u2019s J6 case against Trump.\u2063 <a href=\"https:\/\/t.co\/VDIbIQnyJ5\">pic.twitter.com\/VDIbIQnyJ5<\/a><\/p>\n<p>\u2014 Julie Kelly (@julie_kelly2) \u200b <a href=\"https:\/\/twitter.com\/julie_kelly2\/status\/1688238171190968320?\">August 6, 2023<\/a><\/p>\n<\/blockquote>\n<p>The tone of the ruling was clear.\u2062 Even \u2064as Chutkan acknowledged\u200d that the \u201cquestion \u200dof how that day\u2019s events came about and who was responsible for them is not before the court\u201d and the background was \u201cnot \u2063material to the outcome,\u201d she \u200cfelt the need to include \u200cit in her opinion in order to\u2063 offer\u2064 \u201ccontext for the legal dispute here.\u201d<\/p>\n<p>Actually, what she offered was context for the legal case currently being brought by Jack \u200cSmith \u2014 charging Trump with conspiracy to \u2063defraud the United States, conspiracy \u2062to obstruct an <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/cnn-nbc-purchased-video-for-35000-from-man-charged-in-u-s-capitol-riot-court-docs\/\" title=\"CNN, NBC Purchased Video For ,000 From Man Charged In U.S. Capitol Riot: Court Docs\">official proceeding<\/a>, obstruction of and attempt to obstruct an official proceeding,\u2064 and conspiracy against rights.<\/p>\n<p>The \u201cofficial proceeding\u201d Trump allegedly conspired\u2063 to obstruct was the certification of \u2064the 2020 election \u2014 which resulted in the disaster of the Joe\u2063 Biden\u2062 presidency being visited on the nation.<\/p>\n<p>Clearly, Chutkan has made \u2064up her mind that\u200b Trump is guilty of that \u2014 and therefore \u200bthe other charges\u200d that flow \u2062from that. And she went out of her way to put that conviction in \u200bwriting for the whole world\u200c to see. The decision of\u2062 the jury is, even \u200bmore regrettably, practically foregone\u2063 as well.<\/p>\n<p>But a judge is supposed to\u200c be the honest figure in the courtroom.\u2064 The one who\u2019s \u2063there to make sure \u200dthe i\u2019s are dotted and the t\u2019s are crossed, and that partisanship \u2014 even in a\u200b blatantly \u2062partisan prosecution\u200d like the \u200cone Jack Smith is running \u2014 is kept \u2062within the \u200bconfines of the law.<\/p>\n<p>That\u2019s not who Judge\u2063 Tanya Chutkan is. It\u2019s\u2063 not even who\u200c she pretends to be.<\/p>\n<p>She\u2019s made her decision already. She publicized her decision.
