This legal\u2064 fight has the potential to escalate to the Supreme Court, especially after \u200dthe justices ruled against a \u2062previous map that lacked \u200ca second black-majority\u2063 district.<\/p>\n<p>Democrats and activist \u200cgroups have strongly opposed the new\u200d map, which\u200c was passed by the Republican-controlled legislature\u200d last \u200dmonth. On the other hand,\u2063 GOP defenders argue that the high\u2064 court did not explicitly require proportionality or \u200da second <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/texas-republicans-approve-new-congressional-map-that-they-hope-will-blunt-democratic-gains\/\" title=\"Texas Republicans Approve New Congressional Map That They Hope Will Blunt Democratic Gains\">black-majority district<\/a>.<\/p>\n<h3>Challenges \u200dto the Map<\/h3>\n<p>Representative Terri Sewell (D-AL) and members of\u200d the Congressional \u2062Black \u200cCaucus \u200d(CBC) filed a brief on Thursday, asserting \u200dthat the &#8220;redistricting\u200b plan\u200b Alabama legislators approved\u2064 on July 21, \u200bS.B. 5 (&#8216;the Livingston Plan&#8217;), dilutes\u200c the voting strength of Black voters in Alabama and violates \u200bSection 2\u2062 of the\u2063 Voting Rights Act (&#8216;VRA&#8217;).&#8221;<\/p>\n<p>According to Robert Fram, an attorney representing Sewell and CBC members,\u200d the proposal &#8220;<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/alabama-redistricting-democrats-balk-as-republicans-defend-newly-redrawn-map\/\" title=\"Democrats object, Republicans defend Alabama's new redistricting map.\">renders impossible electoral victory<\/a> for any Black-preferred candidate&#8221; and\u200c fails to comply with the recent high court decision against the state&#8217;s 2021 map in\u2062 Allen v. Milligan, \u2064a narrow 5-4 decision.<\/p>\n<p>However, the National Republican Redistricting Trust, the\u2064 party&#8217;s redistricting arm,\u200c argues that the Supreme Court&#8217;s ruling in Milligan \u200d&#8221;maintains an indecipherable status quo&#8221; that will\u2063 require clarity \u2063sooner rather than later.<\/p>\n<h3>The New Map&#8217;s Provisions<\/h3>\n<p>The new map includes changes to the 7th\u200d Congressional\u200d District, which would have a 51% black voting-age\u200d population if approved by \u2063the district court. The 2nd District would also undergo changes, losing Autauga County,\u200d Conecuh \u200bCounty, and parts of Elmore and Covington counties, but gaining\u2063 Lowndes, Macon, and Russell counties. The black\u200c voting-age population in\u200c the 2nd\u2062 District would increase from 32% to approximately 40%.<\/p>\n<p>Before reaching the Supreme Court, the district court&#8217;s earlier \u200bopinion in \u2064the Allen v. Milligan case stated \u2063that &#8220;any remedial plan will \u200bneed to include two districts\u2062 in which Black voters either comprise a voting-age \u200cmajority or something quite close to it.&#8221; However, \u2062the Supreme \u2062Court&#8217;s majority opinion notably excludes\u2063 that quote,\u2063 while Justice Clarence\u200d Thomas&#8217;s dissent references it as\u2064 a \u200d&#8221;thinly\u2062 disguised benchmark.&#8221;<\/p>\n<h3>Debates\u200d and Potential Appeals<\/h3>\n<p>Ilya\u2063 Shapiro, a director of constitutional studies at the Manhattan Institute, argues that the media&#8217;s portrayal of Alabama &#8220;defying&#8221; the Supreme Court\u200b is \u200ba\u200b &#8220;case of gaslighting.&#8221; Shapiro believes that the challengers to Alabama&#8217;s new map are\u200b actually asking the federal\u200b district court to \u200cdefy the justices by ordering racially proportionate redistricting, which \u200dthe Supreme Court \u200chas rejected.<\/p>\n<p>A\u2062 three-judge panel will decide \u200dif\u200d the newly enacted map passed by Republicans \u2064will stand \u2063for the upcoming 2024 election. The trial on the merits will take place after the\u200d hearing scheduled for August 14. The \u200cfinal map must be in place by early October to allow candidates enough time to prepare for the \u200cprimary elections in March.<\/p>\n<p>If the panel rules that the map needs \u2064to \u200dbe redrawn with a second\u2063 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/as-republican-julia-letlow-is-sworn-in-the-democrats-margin-in-the-house-shrinks-to-just-2-votes\/\" title=\"As Republican Julia Letlow Is Sworn In, The Democrats\u2019 Margin In The House Shrinks To Just 2 Votes\">majority-black district<\/a>, a special master may be \u2062appointed to revise the map, potentially \u2064increasing the chances\u2062 of \u2063two Democrats\u200b representing Alabama\u2063 in the \u200cHouse.
