Parlatore, a former\u200d member of <a href=\"https:\/\/www.westernjournal.com\/proof-setup-trump-1st-potus-40-years-feds-didnt-help-archive-classified-docs-attorneys-say\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s defense team<\/a> \u2063 who is currently working as an attorney for former New York Police Commissioner Bernard Kerik, \u200dsaid that he submitted <strong>absolutely exculpatory<\/strong> documents to the special counsel\u2019s office and was <strong>stunned<\/strong> \u200b by the Tuesday indictment.<\/p>\n<p>Kerik \u2014 who worked alongside former New\u200b York City Mayor Rudolph Giuliani in the weeks following the 2020 election as Trump\u2019s lawyers mounted legal challenges in several states \u2014 had testified in front of the Democrats\u2019 January 6\u200d committee \u2062for eight \u2064hours, according\u200c to \u2062 <a href=\"https:\/\/edition.cnn.com\/2022\/01\/13\/politics\/bernard-kerik-january-6\/index.html\" target=\"_blank\" rel=\"noopener\">CNN<\/a>.<\/p>\n<p>Kerik reportedly turned over thousands of pages of documents to the \u200cspecial counsel\u2019s office on July \u206223. CBS News reported it had\u2064 reviewed the emails \u2063and confirmed they\u2064 were sent.<\/p>\n<p>The \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/attorney-stunned-after-seeing-trump-indictment-says-records-he-handed-over-are-absolutely-exculpatory\/\" title=\"Attorney shocked by Trump indictment, claims evidence provided is 'completely exonerating'.\">documents included sworn affidavits<\/a> from \u200dthose\u2064 who questioned the \u2063integrity of the electoral process during the 2020 election. A source close to\u2063 Kerik told CBS\u200c the papers proved there was a legitimate effort to contest the results of the\u200b 2020 race.<\/p>\n<p>However, on Wednesday \u2014 the day <em>after<\/em> <a href=\"https:\/\/www.westernjournal.com\/jumbo-calendar-shows-suspicious-timing-trump-indictments\/\" target=\"_blank\" rel=\"noopener\">Smith\u2064 indicted Trump<\/a> \u2014 Smith\u2019s \u2062office reached out to Parlatore and asked for \u201cresponsive documents as to which the Trump campaign is no longer asserting a privilege.\u201d\u2062 You know, the ones Kerik already turned\u200c over.<\/p>\n<p>\u201cThey bear directly on the essential element of \u200dwhether Rudy Giuliani, and therefore Donald Trump, knew that their claims of\u2063 election fraud were false,\u201d Parlatore told CBS News.<\/p>\n<p>\u201cGood- \u200dfaith reliance upon claims of fraud, even if they later turn out to be false, is very different from pushing fraud claims that you know to be\u200d false at the time.\u201d<\/p>\n<h3>A Potential Oversight?<\/h3>\n<p>A former <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-ag-barr-authorizes-federal-prosecutors-to-pursue-substantial-allegations-of-voting-irregularities-before-2020-election-is-certified\/\" title=\"BREAKING: AG Barr Authorizes Federal Prosecutors to Pursue \"Substantial Allegations\" of Voting Irregularities Before 2020 Election is Certified\">federal prosecutor<\/a> said that the\u200c <a href=\"https:\/\/www.westernjournal.com\/special-counsel-jack-smith-attempts-boot-mar-lago-lawyer-trial-claiming-divided-loyalties\/\" target=\"_blank\" rel=\"noopener\">special counsel office\u2019s<\/a> apparent neglect of the documents \u201cmay have been an oversight.\u201d<\/p>\n<p>\u201cKerik may \u2062not be a primary witness to\u200b the case,\u201d former federal prosecutor Scott Frederickson told CBS. \u200b\u201cI \u2063tend\u2062 to think they [the special counsel] \u200b are gathering evidence for \u200bdiscovery in this case, and may\u2064 not have been \u2062essential\u2064 to the indictment. Discovery\u200c is a critical stage, and the special counsel wants to\u2064 be sure all materials are shared.\u201d<\/p>\n<p>The special counsel\u2019s office, for its part, declined to comment when reached by CBS News.<\/p>\n<p>However, this isn\u2019t the first \u201coversight\u201d that\u2019s plagued Jack Smith\u2019s office this week. <a href=\"https:\/\/www.westernjournal.com\/jack-smith-forced-inform-court-failed-turn-evidence-trump-legal-team-made-incorrect-representation\/\" target=\"_blank\" rel=\"noopener\">In a \u200bMonday court filing<\/a>, the special counsel\u2019s team admitted \u200dto not handing over all evidence to Trump\u2019s lawyers \u200din the former president\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-asks-supreme-court-to-reject-trump-request-in-fbi-classified-documents-case\/\" title=\"DOJ Asks Supreme Court to Reject Trump Request in FBI Classified Documents Case\">classified documents case<\/a>, in spite of previous\u200d statements it had done so.<\/p>\n<p>Beyond that, Smith\u2019s latest round of charges are easily the most <a href=\"https:\/\/www.nationalreview.com\/2023\/08\/heres-whats-wrong-with-prosecuting-trump-for-stop-the-steal\/\" target=\"_blank\" rel=\"noopener\">constitutionally dubious<\/a> \u2014 and the documents Kerik turned over, if they say what Parlatore \u2064contends they do,\u2064 should have militated against the decision to indict the former president.<\/p>\n<p>Throughout the <a href=\"https:\/\/static.foxnews.com\/foxnews.com\/content\/uploads\/2023\/08\/Trump-indictment.pdf\" target=\"_blank\" rel=\"noopener\">indictment<\/a>, the special counsel\u2019s\u200c office asserts that the \u2062former president knew that Trump\u2019s claims the \u200delection was fraudulent were themselves fraudulent, not just wrong or misguided.<\/p>\n<p>Why? Smith contends that Trump \u200bknew from\u200d an early stage that his <a href=\"https:\/\/www.westernjournal.com\/fried-jack-smith-ignore-damning-facts-undermine-trump-indictment\/\" target=\"_blank\" rel=\"noopener\">allegations of voter irregularities<\/a> were specious \u2014 but at no point does \u200cSmith provide evidence into \u200cthe former president\u2019s state of mind during the weeks between the election and Jan. 6, 2021.<\/p>\n<p>That\u2019s not to say the \u200bevidence won\u2019t be forthcoming \u2014 a prosecutor isn\u2019t required to\u200b reveal all elements of his\u200d case until he absolutely has to, of\u200b course \u2014 \u00a0but prosecuting Trump in\u200d such a way would require convincing not just a jury but appellate court judges that the former president\u2019s actions \u2064aren\u2019t covered under the First Amendment\u2019s rather wide speech protections.<\/p>\n<p>Thus, it\u2019s\u2062 not really a good look when one of the closest\u2064 men \u2062to the \u200bpresident during the weeks \u200dbetween the election \u2063and the Capitol incursion\u200c furnishes your office with thousands of pages of documents that, according to \u2063his lawyer, provide ample exculpatory evidence\u200b for Trump \u2014 and, from\u2064 the looks of things,\u200b Smith\u2019s office <em>didn\u2019t even<\/em> <em>know it had the documents<\/em>.<\/p>\n<p>Naturally, there\u2019s another conclusion the lay observer can draw: That this isn\u2019t about convicting Trump\u2063 at all, \u200dbut merely gumming up the legal system with enough cases at just the right time to smear the front-runner in the GOP presidential race with as much damage as possible.<\/p>\n<p>Just like the regimes of banana republic\u200c dictators do.<\/p>\n<p>The post <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\/attorney-stunned-after-trump-indictment\/\">Attorney Stunned After Seeing Trump Indictment, \u2064Says Records He Handed Over Are &#8216;Absolutely Exculpatory&#8217;<\/a> appeared first\u2062 on <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\">The Western Journal<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A lawyer, once part of Trump&#8217;s legal team and now representing a prominent supporter, claims special counsel Jack Smith failed to review crucial documents before indicting Trump.
