Turley warned that this indictment poses a threat to \u200cthe First Amendment by granting the government \u2064unprecedented power to \u200dcriminalize false statements.<\/p>\n<p>Turley pointed out that \u200cTrump was\u200c not charged with inciting violence or insurrection,\u2062 but rather for spreading false claims about election fraud. He argued\u2064 that in \u200dorder to secure convictions for this, Special Counsel Jack Smith would need to\u200c disregard not \u2063only the First Amendment but also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mississippi-supreme-court-strikes-down-voter-approved-medical-marijuana-initiative\/\" title=\"Mississippi Supreme Court Strikes Down Voter-Approved Medical Marijuana Initiative\">existing case law<\/a> that protects even false statements.<\/p>\n<p>According to Turley, the government insists that Trump must have known his \u200dstatements were false and engaged in fraudulent behavior to obstruct or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/turley-raises-questions-about-case-against-trump-jack-smith-would-need-to-bulldoze-first-amendment-to-convict\/\" title=\"Turley questions Trump's case: Smith would trample First Amendment to convict.\">challenge electoral results<\/a>. However, Turley highlighted a problem with this argument &#8211; if Trump genuinely believed he did not lose the election, the indictment collapses. Turley also noted that \u200dmany people, including himself, tried to\u2064 convince\u2062 Trump that his \u2064stolen election claims were false, but he chose to listen to a small group of lawyers who assured him of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/live-stream-video-georgia-oversight-committee-holds-hearing-on-election-fraud\/\" title=\"LIVE STREAM VIDEO: Georgia Oversight Committee Holds Hearing on Election Fraud\">massive election fraud<\/a>.<\/p>\n<p>Turley emphasized that Trump, like any individual, has the freedom to seek\u2062 out &#8220;enablers&#8221; who tell him what he\u200d wants\u2062 to hear. \u2064He pointed\u2063 out that even President Joe Biden has done this, citing an executive order \u2063on an eviction moratorium that was later\u200b blocked by the \u200cSupreme Court. Turley \u2062also mentioned \u2063Democrats, such as Hillary Clinton and \u2063Jamie \u2064Raskin,\u200c who made false claims about Trump&#8217;s 2016 election \u200bvictory\u2064 but\u200c were protected by the Constitution.<\/p>\n<p>Even if\u200d Trump knew his claims were false, Turley argued \u2063that it would still be controversial to link his statements to the actions of those\u200b who challenged the election. He referenced the Supreme Court case\u2064 United\u200c States v. Alvarez, which ruled that it \u200cis unconstitutional to criminalize lies.
