The heavy security presence was\u2063 a clear indication that the city was prepared for riots if the jury acquitted Chauvin. The question is,\u200b would \u200byou want to \u200dbe tried before a jury bracing for \u200da\u200b riot if it acquitted you? The Sixth Amendment guarantees a &#8220;fair trial,&#8221; but in Chauvin&#8217;s case, that guarantee was \u200cviolated.<\/p>\n<p>Chauvin is now seeking to\u2063 have\u200b the Supreme Court find his trial unconstitutional and order a retrial in a community\u200d where riots wouldn&#8217;t break out if he were acquitted. The circumstances surrounding his trial were undeniably biased\u200b and prejudiced.<\/p>\n<h3>The Unreported Details<\/h3>\n<p>On May 25, 2020, George Floyd \u200cdied while Chauvin and three other Minneapolis \u2063police officers attempted to arrest him.\u2064 While the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/why-derek-chauvins-trial-should-have-been-moved-out-of-minneapolis\/\" title=\"Derek Chauvin's trial should've been relocated from Minneapolis.\">incident received\u2064 widespread media coverage<\/a>, there were \u200bdetails that were not widely reported. For example, the Minneapolis \u200cPolice Department trained its officers to use the restraint\u2062 technique that Chauvin and the\u2064 other officers used on Floyd. This technique was deemed acceptable by the department.<\/p>\n<p>However, the state objected when Chauvin&#8217;s attorney\u2064 tried to introduce\u2064 a photograph of the technique into evidence, arguing \u200cthat \u200dthere was no evidence Chauvin was trained on it. The court sustained the objection, \u2062but the issue was not whether Chauvin was trained on \u200dthe technique, but \u200drather whether it was an acceptable use of police force. Numerous academic studies\u200d have refuted the \u200cclaim\u200b that placing weight on\u2064 a suspect&#8217;s back can\u200c cause positional asphyxia.<\/p>\n<p><strong>It&#8217;s Not \u2064About the Neck<\/strong><\/p>\n<p>The widely circulated\u2064 narrative that Chauvin choked Floyd to death by placing his \u2062knee on Floyd&#8217;s \u200cneck is false. Both\u2063 the state&#8217;s medical \u2063expert and Chauvin&#8217;s medical expert agreed that \u200cFloyd died of a cardiac arrhythmia, not suffocation.\u2064 The weight of Chauvin&#8217;s knee\u2063 on \u2063Floyd&#8217;s back restricted his chest \u200bfrom expanding \u2063sufficiently for him to breathe in enough oxygen. However, academic studies have \u2062refuted the claim that this technique\u2062 can cause death from positional asphyxia.<\/p>\n<p>Other factors,\u2062 such\u2064 as high blood pressure, blockage in coronary\u2064 arteries, an enlarged\u2064 heart, \u2062recent drug use, and \u2064stress, were contributing factors to Floyd&#8217;s cardiac arrhythmia. These factors\u200b were admitted by \u200bthe state&#8217;s medical experts\u2063 during the trial.<\/p>\n<h3>A\u2064 Trial by Fear<\/h3>\n<p>In order to convict\u2063 Chauvin, the jury had\u2063 to believe\u200c two\u2062 expert\u200d opinions offered by the state: that Chauvin used unreasonable force in restraining Floyd and that this force was\u200d a substantial cause of Floyd&#8217;s death. These opinions were heavily \u200ccontested at trial, yet the jury returned a \u2063guilty verdict\u200c after only\u2064 one day\u200d of\u200d deliberation. This highlights the importance of \u2062the Sixth Amendment&#8217;s guarantee of a trial before an impartial jury.<\/p>\n<p>Excessive pre-trial publicity can violate a defendant&#8217;s right to a fair \u200btrial, and the\u200b Supreme\u200b Court\u200c has recognized this in \u200bnumerous\u200d cases. The potential jurors&#8217; exposure to the overwhelming pre-trial publicity\u200b and its effects in the community could have led them\u2063 to conclude Chauvin&#8217;s guilt before\u200b the trial\u200d even\u200d began. In such cases, the court must move the trial to a location unaffected by\u2064 the alleged crime or <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/california-d-a-drops-efforts-to-restore-death-penalty-against-scott-peterson\/\" title=\"California D.A. Drops Efforts To Restore Death Penalty Against Scott Peterson\">massive pre-trial publicity<\/a>.<\/p>\n<p>It is undeniable that Floyd&#8217;s death, the riots in Minneapolis, \u200cand\u2062 the state charging \u200cChauvin\u2062 generated\u2062 unprecedented pre-trial publicity. The viral video of Chauvin and the\u200b other officers using the restraint technique, along with\u200b the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/changes-in-public-legal-perception-ahead-of-derek-chauvin-trial\/\" title=\"Changes in public, legal perception ahead of Derek Chauvin trial\">extensive media coverage<\/a>, created a biased narrative\u2064 against Chauvin. All 131 potential jurors \u2064examined for the trial\u2063 had been exposed to this \u2064pre-trial \u200bpublicity, and many \u200dwere removed due to their prejudice against Chauvin.<\/p>\n<p>The jurors themselves\u200c lived\u2062 in the\u2064 communities that were\u200d affected by\u2064 the\u200b riots. They knew \u2062that their personal safety\u200d and the safety of their families were at risk if they acquitted Chauvin. The threats and the deployment of soldiers\u2062 to protect the courthouse and\u2062 the \u2064city during the trial were clear indications of \u200cthe potential\u200c danger they \u200cfaced.<\/p>\n<p>The Sixth Amendment prohibits trying a \u200cdefendant before a jury that has such a personal stake in the outcome of the trial. The overwhelming pre-trial publicity and \u200cthe threats\u200b of violence demanded that Chauvin&#8217;s trial be \u2063moved out\u200c of Minneapolis.
