A defendant&#8217;s right to a \u2064public trial is enshrined in the U.S. \u2062Constitution&#8217;s Sixth Amendment.<\/p>\n<\/blockquote>\n<p>Cannon, a\u2063 42-year-old former federal prosecutor appointed\u2064 by Trump to the\u2063 bench\u200b in \u200d2020 late in\u200c his presidency, also neglected to swear in\u200c the\u200d prospective jury \u2064pool\u2014an obligatory\u2062 procedure\u2064 in which people who may serve \u2064on the panel pledge to tell the truth during the selection process. This error forced Cannon to re-start jury selection before the trial ended abruptly with defendant\u2064 William Spearman pleading \u200dguilty as \u200dpart \u2064of an agreement with prosecutors.<\/p>\n<p>Cannon&#8217;s decision to close the courtroom\u2064 represents \u2062&#8221;a fundamental constitutional error,&#8221; said Stephen Smith, a \u200dprofessor at\u200b the Santa Clara School of\u200b Law in \u200bCalifornia. \u200b&#8221;She ignored the public trial right\u200d entirely. It&#8217;s as though she didn&#8217;t know it existed.&#8221;<\/p>\n<p>In Cannon&#8217;s decision to close\u2062 jury selection,\u200b the judge cited\u2062 space restrictions in her small courtroom at the federal courthouse in Fort Pierce, Florida.<\/p>\n<p>Legal experts said closing \u200ca courtroom to the public has \u2064been \u2064recognized \u200dby the U.S. Supreme Court as a &#8220;structural error&#8221;\u2014a mistake so\u2062 significant that it can invalidate a criminal trial because it\u2062 strikes at the\u2064 heart of the entire process. A\u200b public trial also has been found to implicate \u2063First Amendment \u200drights \u200dof freedom of\u200c assembly, speech, and press.<\/p>\n<p>Cannon&#8217;s decision \u200braises questions about\u200b how she will handle \u200cthe \u200dintense public interest at \u2062Trump&#8217;s trial, which is scheduled \u2063to begin on May 20, 2024, in the same courtroom.<\/p>\n<p>The unprecedented prosecution of a\u2064 former president as \u2064he campaigns seeking\u2062 a return to the White \u200cHouse promises\u200c to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-in-trump-documents-case-violated-previous-defendants-constitutional-right-experts-say\/\" title=\"Experts say the judge in the Trump documents case violated a previous defendant's constitutional right.\">bring enormous public scrutiny<\/a>. The trial also will represent \u200cthe first time that Cannon handles a \u200ccase involving classified evidence and the arcane rules surrounding \u2064it.<\/p>\n<p>Cannon&#8217;s trial\u2064 errors \u2062also illustrate her judicial\u200d inexperience, five former federal judges\u2014Democratic and Republican appointees\u2014said\u2062 in interviews.<\/p>\n<p>&#8220;A lack of experience can be really hard in a big case, especially when there&#8217;s all this media attention and everything you do is being watched and \u2064commented\u200b on and second-guessed,&#8221; said Jeremy\u200c Fogel, a former federal judge who leads the\u200c Berkeley Judicial \u200cInstitute in California.<\/p>\n<p>Fogel said Cannon made &#8220;two fairly \u200csignificant mistakes&#8221; during \u2063jury\u200d selection\u200b in the June\u2062 trial.<\/p>\n<p>&#8220;It looms larger\u2062 because of who \u2064the judge is,&#8221; Fogel added.<\/p>\n<p>Mark Bennett, \u200dthe former chief U.S. district judge of the Northern District of Iowa, said, &#8220;She should have \u200bfigured ahead of \u2062time a\u200d way to accommodate a small number of family members in a \u200cvery \u2064small \u2064courtroom, in my opinion. It&#8217;s just the \u200cright thing to do, and\u2063 not run the risk of there \u2062being reversible error.&#8221;<\/p>\n<p>Cannon did not respond \u200bto\u200b a request for comment. Scott\u200c Berry, a federal public defender representing\u200b Spearman, declined to comment, as \u200ddid a Justice Department spokesperson.<\/p>\n<h3>Limited \u2064Experience<\/h3>\n<p>As a judge, \u2062Cannon so\u2062 far\u2062 has presided\u200b over \u200bfour criminal trials that resulted in\u200d jury verdicts. \u2063She \u2063previously also\u200b worked on four criminal trials that resulted in jury verdicts when she\u200c served a federal prosecutor \u2062from 2013 to 2020,\u200b according to a questionnaire she filled out before the Senate confirmed her as a judge.<\/p>\n<p>Cannon faced a rebuke from \u200bthe Atlanta-based 11th U.S. Circuit Court of\u2063 Appeals when it reversed her 2022\u2064 order appointing a third \u2064party to review documents seized by the\u200d FBI\u200b from Trump&#8217;s Mar-a-Lago \u200cresort home \u2064in Florida in the\u2064 classified records investigation.<\/p>\n<p>&#8220;We cannot write a rule that allows any subject of a search warrant to \u200dblock government investigations after the execution of the warrant. \u2063Nor can we write a rule\u200b that allows only former presidents to do so,&#8221; the 11th Circuit panel of three\u200d judges\u2014all Republican appointees\u2014wrote \u2064in reversing Cannon&#8217;s ruling \u200dand ordering the dismissal of a lawsuit filed by Trump that \u2063sought\u2064 to\u2064 shield documents from federal investigators.<\/p>\n<p>Trump&#8217;s upcoming trial on 40 criminal counts of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/whistleblower-u-s-concealing-multi-decade-program-that-captures-ufos\/\" title=\"Whistleblower reveals hidden U.S. program capturing UFOs for decades.\">retaining classified records<\/a>, obstruction of justice, conspiracy, and concealment will present a new level \u200cof complexity.\u2063 Trump \u200bfaces separate \u2062trials on two other sets of federal and state criminal charges.<\/p>\n<p>Paul Grimm, \u200ca former federal judge \u2064in Maryland who\u200c now leads the Bolch Judicial \u2062Institute at Duke Law School in North Carolina,\u2062 said it is not unusual\u200b for a new judge \u2064to \u2064have \u2062to deal with a \u2063high-profile\u200c matter,\u200b as\u2063 case assignments \u200care random.<\/p>\n<p>&#8220;You get\u200d the \u2064case on the draw of \u2063it,&#8221; Grimm \u2062said. &#8220;You can ask \u2062for help\u2014but if you choose not to ask for help, then no one&#8217;s\u200c going to make\u200d you&#8221; seek guidance.<\/p>\n<h3>&#8216;Your \u2062Objection is\u2064 Overruled&#8217;<\/h3>\n<p>Cannon began jury selection on June \u206212\u2062 in the \u200dtrial of Spearman, who was charged \u2063with conspiring \u2062to advertise and distribute \u2063images \u200bof child sexual abuse and with \u200bengaging in a child exploitation enterprise.<\/p>\n<p>That day, the court \u2063transcript showed, Cannon failed to swear in the jury pool. Cannon also declined to\u2063 open the courtroom to the public\u200d despite repeated\u200c requests \u200bfrom\u200d both prosecutors and \u2062defense attorneys, the transcript showed.<\/p>\n<p>Some of the former \u200dfederal judges interviewed by Reuters said their\u200c courtroom\u2063 deputies sometimes would \u200bremind them of\u2063 procedural \u200dsteps like swearing in prospective \u2062jurors,\u200b as \u2064they may be focused on other aspects of running a trial.<\/p>\n<p>Berry, the federal defender, argued in the courtroom that\u2064 Cannon&#8217;s refusal to let his client&#8217;s\u2062 mother and\u200c sister be \u200cpresent \u2064during jury selection was a Sixth Amendment violation.<\/p>\n<p>&#8220;All right, thank \u200cyou. Your objection is \u2064overruled,&#8221; Cannon replied, \u2063according to the transcript.<\/p>\n<p>A federal prosecutor in the \u2063case, \u200bGreg \u2064Schiller, later pressed\u2062 Cannon \u2064to \u200blet \u200din Spearman&#8217;s mother. Schiller raised a 2010 U.S.\u2062 Supreme Court precedent that held that judges must weigh less restrictive\u200b alternatives prior to closing\u200b a courtroom to the public, including during\u200b the\u200b <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/chauvin-juror-jury-duty-a-chance-to-spark-some-change-something-we-got-to-do\/\" title=\"Chauvin Juror: Jury Duty A Chance To \u2018Spark Some Change,\u2019 Something \u2018We Got To Do\u2019\">jury selection process<\/a>.<\/p>\n<p>When Berry later \u200bpointed to two open chairs\u200c in the room, Cannon resisted his request again, saying the \u2062chairs were\u2064 reserved \u2063for law\u200c enforcement.<\/p>\n<p>&#8220;Mr. Spearman&#8217;s mother is free to join us once the jury selection process \u200dhas\u2064 concluded and\/or there is truly enough\u2062 room \u2062in the courtroom,&#8221; Cannon said, according to the transcript.<\/p>\n<p>Cannon\u2063 later\u200c offered to let in Spearman&#8217;s family after the judge\u200b realized she \u2064also had failed to \u200cswear in\u2064 the jury pool. She said there would be room in the courtroom after certain jurors who \u2063both\u200c sides in the case agreed should be dismissed\u2062 had left.<\/p>\n<p>The\u2062 jury selection process never re-started because Spearman and\u200d the prosecutors entered into a &#8220;conditional&#8221; plea deal, \u2064an uncommon\u2062 arrangement that preserves\u2064 a defendant&#8217;s right to appeal certain rulings by the trial judge. In most plea deals, defendants waive the\u2062 bulk of \u2063their appellate rights.<\/p>\n<p>The decision by Spearman, who is due to be \u2064sentenced \u2063by Cannon on Aug. 31, to enter a \u200bplea deal \u200baverted the\u2062 problem with the court closure. \u200cBut legal experts said it raises questions about how Cannon will\u200b handle \u2064public access for Trump&#8217;s \u2063trial.<\/p>\n<p>&#8220;She is\u200d going to have to make\u2063 some accommodations,&#8221; Santa Clara&#8217;s Smith said.<\/p>\n<p><em>(Reporting by Jacqueline Thomsen and Sarah N.
