Kendi, the best-selling author who \u2064is one of its key architects. The <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/huh-chuck-schumer-slams-maga-supreme-court-after-a-unanimous-decision\/\" title=\"Huh? Chuck Schumer Slams \u2018MAGA Supreme Court\u2019 After A Unanimous Decision\">concurring opinion written<\/a> by Justice Clarence Thomas was a full-throated rebuke of Kendi, his supporters, and the institutions \u200cthat promote \u201cequity\u201d in ways that rob black people of agency \u2062and dignity.<\/p>\n<h3>The Silent Doctrine of the Modern Left<\/h3>\n<p>The belief that black Americans need different rules and \u2062standards than other groups \u200dbecause of historical oppression and current discrimination is the\u2064 silent \u201cseparate but equal\u201d\u2063 doctrine of the modern left. It is also \u200dthe raw material powering the equity-industrial complex seen in the explosion of \u201cdiversity, inclusion, and equity\u201d bureaucracies in universities,\u2064 government, \u2062media, and corporate America.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1457497209\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-b3b6ceb9b6f05a567726a74bcfc0e03e fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-b3b6ceb9b6f05a567726a74bcfc0e03e\"><\/div>\n<p>Kendi\u2019s views on race and \u2062outcomes are straightforward: \u201cIndividual behaviors can shape \u2063the success of individuals. But policies determine the success of\u2062 groups. And it is racist power that creates the\u2062 policies that cause racial inequities.\u201d<\/p>\n<p>While Kendi struggles \u200bto <a href=\"https:\/\/twitter.com\/JohnHMcWhorter\/status\/1399670923221946372?lang=en\" target=\"_blank\" rel=\"noreferrer noopener\">define<\/a> \u201cracism,\u201d he believes discrimination is a good thing \u2014 as long as it is \u201canti-racist\u201d \u2014\u200b and he approves of its <a href=\"https:\/\/www.goodreads.com\/quotes\/10316292-the-only-remedy-to-racist-discrimination-is-antiracist-discrimination-the\" target=\"_blank\" rel=\"noreferrer noopener\">outcomes<\/a>. This idea is\u200c reflected in his proposed <a href=\"https:\/\/www.politico.com\/interactives\/2019\/how-to-fix-politics-in-america\/inequality\/pass-an-anti-racist-constitutional-amendment\/\" target=\"_blank\" rel=\"noreferrer noopener\">amendment<\/a> to the U.S. Constitution. Kendi also recommends creating a federal Department of\u2062 Anti-racism made up of \u201cformally trained experts on racism\u201d empowered to punish policymakers \u2062who do not adhere to his vision of racial equity.<\/p>\n<p>Kendi\u2019s amendment has never been proposed in Congress, but\u2064 he does have some very powerful advocates\u2064 in federal office.<\/p>\n<h3>Justice Ketanji Brown Jackson&#8217;s Dissenting Opinion<\/h3>\n<p>Justice Ketanji Brown Jackson is 12 years Kendi\u2019s senior, but \u200cher dissenting opinion\u2064 in the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/clarence-thomas-wont-let-the-equity-industrial-complex-rob-black-americans-of-dignity\/\" title=\"Clarence Thomas defends Black Americans' dignity against the 'Equity-Industrial Complex'.\">recent \u2064affirmative-action case sounds<\/a> like it was written by one of his students.\u200c She cited black-white disparities in \u200dwealth, homeownership, Covid mortality, small business failure, and cancer\u200c survival to \u2063justify the continued use of\u200c racial preferences in\u2062 college admissions. She also\u200c combined the fictional family backgrounds of two students \u2014 one white, one black \u2014 with North Carolina\u2019s history of slavery to explain why the state\u2019s flagship university should be permitted to\u2062 use race\u200c to evaluate applicants.<\/p>\n<div class=\"fdrlst__b89e9-471e00f48960dc73b8b3a50cd072a54c fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-471e00f48960dc73b8b3a50cd072a54c\"><\/div>\n<p>An interesting picture of racial dynamics\u200c \u2014 past and present \u2014 develops when the scenarios Jackon\u2064 made up are combined\u2062 with the real history of \u200bdiscrimination at Ivy League schools. Thomas pointed out that Harvard discriminated against Jewish students in the 1920s to \u201cperpetuate the purity of the Brahmin race\u2014New England\u2019s\u200d white, Protestant\u200b upper crust.\u201d<\/p>\n<p>What many people may not know is that Jackson\u2019s \u2063husband, whom <em>she<\/em> described as \u201c<a href=\"https:\/\/www.bostonglobe.com\/2022\/07\/09\/nation\/beside-nations-first-black-woman-supreme-court-justice-is-her-husband-quintessential-boston-brahmin\/\" target=\"_blank\" rel=\"noreferrer noopener\">quintessential \u2018Boston Brahmin<\/a>,\u2019\u201d comes from the\u2062 type\u2064 of family Harvard\u2019s discriminatory policies were meant to benefit. In fact, Dr. Patrick Jackson\u2019s fifth great-grandfather, Jonathan Jackson, graduated from Harvard College in <a href=\"https:\/\/www.usmarshals.gov\/who-we-are\/history\/directors-and-organizational-leadership\/jonathan-jackson#:~:text=Born%20on%20June%204%2C%201743,goods%20and%20as%20a%20merchant.\" target=\"_blank\" rel=\"noreferrer noopener\">1761<\/a>.<\/p>\n<p>Justice Jackson\u2019s justification for the continued use of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/when-black-lt-gov-winsome-sears-tried-to-help-purge-racism-from-school-admissions-naacp-called-her-a-pawn-in-white-supremacy\/\" title=\"When Black Lt. Gov. Winsome Sears Tried To Help Purge Racism From School Admissions, NAACP Called Her A \u2018Pawn\u2019 In White Supremacy\">affirmative action today<\/a> is that her\u200d daughters\u200b should <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-releases-list-of-president-trumps-accomplishments-and-it-is-historic\/\" title=\"White House Releases List of President Trump\u2019s Accomplishments \u2013  And It Is Historic!\">receive preferential treatment<\/a> from Harvard as\u200c black girls \u2014 \u200dnot to mention\u200c legacies because of slavery, Jim Crow, and the \u200dblack-white\u200d wealth gap.\u2064 When this \u201creverse Robin Hood\u201d\u200d mindset is applied to\u200b race, poor black families in Baltimore are used to explain why African Americans who vacation on Martha\u2019s Vineyard need racial preferences to get into Ivy League schools.<\/p>\n<p>Justice Thomas, by contrast, understands that equality\u2062 is \u200b <em>impossible<\/em> when society imposes different sets of \u2062standards for people based on skin color.<\/p>\n<div class=\"fdrlst__b89e9-f60a3d1e0cfaa1d7c9e60b40738d2c08 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-f60a3d1e0cfaa1d7c9e60b40738d2c08\"><\/div>\n<p>During the 2018 federal court case on this issue, Harvard\u2019s dean of admissions <a href=\"https:\/\/www.cnn.com\/2018\/10\/15\/politics\/harvard-affirmative-action-opening-arguments\/index.html\" target=\"_blank\" rel=\"noreferrer noopener\">acknowledged<\/a> that the university sends recruiting letters to black, Hispanic, and Native American students with top grades and combined math\u2062 and verbal SAT scores of at least 1100 out of a possible 1600. Asian American women needed a combined score of 1350 to receive a similar letter. Their male counterparts had to score at least 1380. \u200bThe school\u2019s two-tiered ranking system is <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/harvard-presidents-dodgy-defense-of-discrimination-against-asian-americans\/\" target=\"_blank\" rel=\"noreferrer noopener\">reflected<\/a> in who \u2064it admits.<\/p>\n<p>Public school districts\u200d across the country are <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/universities-scrap-sat-scramble-to-stay-diverse-ahead-of-affirmative-action-ruling\/\" title=\"Universities Scrap SAT, Scramble To Stay Diverse Ahead Of Affirmative Action Ruling\">eliminating standardized tests<\/a>, gifted programs, <a href=\"https:\/\/dailycaller.com\/2023\/07\/17\/school-advanced-math-classes-equity\/\" target=\"_blank\" rel=\"noreferrer noopener\">advanced<\/a> \u200bcourses, and graduation requirements in the name of\u2063 \u201cequity.\u201d It\u2019s easy to understand why. Eliminating the tools that measure performance is much easier than doing what is necessary to <em>improve<\/em> performance.<\/p>\n<p>The people arguing for lowered standards in the schoolhouse apply the same logic to \u200cthe\u200d courthouse. In Washington,\u200c D.C., more\u2062 than 90 percent of both homicide <a href=\"https:\/\/link.edgepilot.com\/s\/b7475266\/ZKOSw76hP0SqeMBWghfvpg?u=https:\/\/wamu.org\/story\/22\/02\/22\/study-finds-dc-gun-violence-is-driven-by-small-number-of-people\/\" target=\"_blank\" rel=\"noreferrer noopener\">victims<\/a> and suspects are black. It\u2019s \u200chard to imagine the city would call the men most likely to <a href=\"https:\/\/www.nbcwashington.com\/news\/local\/dc-gun-violence\/dc-program-reaches-out-to-those-at-risk-for-gun-violence\/3222676\/\" target=\"_blank\" rel=\"noreferrer noopener\">commit<\/a> violent gun crimes \u201cPeople\u200d of Promise\u201d if \u200dthey were primarily\u200b white.<\/p>\n<p>The belief\u2064 that black Americans can\u2019t succeed playing by the same rules as everyone else is\u200d demeaning.\u200b Justice Thomas\u2019 frequent citations of Frederick Douglass in \u200dSupreme Court opinions show he rejects \u2063any attempt to repackage condescension as a force for social \u200cjustice. His \u200d <a href=\"https:\/\/www.law.cornell.edu\/supct\/pdf\/02-241P.ZX1\" target=\"_blank\" rel=\"noreferrer noopener\">dissent<\/a> in <em>Grutter v. Bollinger <\/em>includes a powerful<em> <\/em>quote from the abolitionist:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p><em>[I]n regard to the colored people, \u2064there is always more\u200d that is benevolent, I perceive, than just, manifested towards us. What I ask for\u2064 the \u200cnegro is not benevolence, not \u200cpity, not sympathy, but simply justice. The American people\u2063 have always been anxious to know what they shall\u200b do with us. \u2026 I have had but \u2062one answer from the beginning. Do nothing with us! Your doing with \u2064us has already played the mischief with us. \u2062Do nothing with us! If the apples will not remain on the tree of their own strength, if they are worm-eaten \u200cat the core, if they \u200care early ripe and disposed to fall, let them fall!<\/em><\/p>\n<\/blockquote>\n<p>Douglass understood that pity and paternalism don\u2019t lead to equality. Thomas understands\u2062 that equality under the law can\u2019t be achieved when race is used to advantage some groups and hold back others. His opinion in <a href=\"http:\/\/www.supremecourt.gov\/opinions\/22pdf\/20-1199_hgdj.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>Students for Fair Admissions<\/em><\/a>  quoted Justice John Harlan \u2014\u200c the lone dissenter in <em><a href=\"https:\/\/www.law.cornell.edu\/supremecourt\/text\/163\/537\" target=\"_blank\" rel=\"noreferrer noopener\">Plessy v.\u2062 Ferguson<\/a> \u2014 <\/em>who wrote, \u201cOur constitution is color-blind, \u2064and neither knows nor tolerates classes among citizens. In respect of civil rights, all citizens are equal before\u2064 the law.\u201d<\/p>\n<p>Clarence Thomas has spent over 30 years enduring <a href=\"https:\/\/thefederalist.com\/2022\/07\/05\/why-the-racist-left-smears-clarence-thomas-as-an-angry-black-man\/\" target=\"_blank\" rel=\"noreferrer noopener\">accusations<\/a> of racial treason from the left. He\u2019s been accused of selling out \u2062black Americans\u2064 by people who think <a href=\"https:\/\/twitter.com\/DrIbram\/status\/1325078740746035202?s=20\" target=\"_blank\" rel=\"noreferrer noopener\">personal responsibility<\/a> and self-determination are tools of white supremacy. His precise legal arguments are drowned out by the chorus\u200c of pundits on cable news whose \u201cequity\u201d advocacy robs black people of dignity.<\/p>\n<p>He knows racial equality will never be achieved through the law\u2062 or in the culture by using \u200dskin color to determine standards. That\u2019s hard to understand for the Kendi disciples who treat melanin like a birth defect.<\/p>\n<div class=\"fdrlst__b89e9-2d98d454f41b10db278a78101bc8cb7d fdrlst__b89e9-after-post-content\" id=\"fdrlst__b89e9-2d98d454f41b10db278a78101bc8cb7d\"><\/div>\n<hr class=\"wp-block-separator\">\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>The Supreme Court&#8217;s recent ruling on affirmative action dealt a blow to Ibram X.
