Dershowitz argued that Smith himself could <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-indictment-could-come-back-to-bite-jack-smith-harvard-law-professor-says\/\" title=\"Harvard Law Professor warns Trump indictment may harm Jack Smith.\">face\u200d indictment based<\/a> on his \u200cown standards.<\/p>\n<p>Smith recently brought a four-count indictment against Trump, accusing him of\u200c attempting to challenge the results \u2064of the 2020 election. This \u2063follows a previous \u200b37-count indictment in June, which alleged Trump&#8217;s mishandling of classified documents.<\/p>\n<p>Trump is scheduled to face arraignment on\u200b the charges \u2064outlined in the new indictment later this\u2062 week.<\/p>\n<blockquote>\n<p>\u201cUnder the\u200c terms\u2063 of this indictment, Jack Smith can be indicted,\u201d Dershowitz stated during an appearance on Fox News.<\/p>\n<\/blockquote>\n<p>Dershowitz pointed to a specific statute that states, \u200d\u201cif two or\u200d more persons conspire to injure and deny somebody the free exercise or enjoyment of any right or privilege secured him by the Constitution.\u201d He\u200b argued that if a court were to \u2063rule \u200cthat Trump had a \u2062First Amendment right to make his Jan. 6 speech and take the actions he did, then Smith would have conspired to deny him that right.<\/p>\n<p>\u201cJack \u200cSmith also in his indictment deliberately, willfully\u2062 and maliciously\u2064 leaves\u200b out the words that \u200bPresident Trump spoke on \u200cJan. 6 in his terrible\u2064 speech,\u200d which I \u2062disagree with, but \u200dwhat he\u2063 said was, \u2062\u2018I want you to assemble peacefully and patriotically,\u2019\u201d Dershowitz added.<\/p>\n<p>Dershowitz further\u200d criticized Smith&#8217;s indictment for targeting Trump&#8217;s Sixth Amendment right to counsel.
