Version: 4.0.47--><h2>Federal Court\u200d Rules on Biden&#8217;s\u2063 Pistol Brace Crackdown: &#8216;Huge Win for Peaceable\u200d Gun Owners&#8217;<\/h2>\n<p>A federal\u200d appeals court ruled \u2063this week that a Biden administration regulation\u200d cracking down on stabilizing braces for firearms \u200dis likely illegal and sent \u2062the case back to a judge for review.<\/p>\n<p>Stabilizing braces, also known as pistol braces,\u200b provide surface\u2063 area \u200cthat allows the\u200c weapon to\u200c be fired from the shoulder, according\u200d to\u2064 the website of the Bureau of\u2062 Alcohol,\u200c Tobacco, Firearms and Explosives.<\/p>\n<p>In January, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-rules-on-bidens-pistol-brace-crackdown-huge-win-for-peaceable-gun-owners\/\" title=\"Federal court rules in favor of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/newsom-challenges-supreme-court-on-abortion-with-new-gun-ban-bill\/\" title=\"Newsom Challenges Supreme Court On Abortion With New Gun Ban Bill\">peaceable gun owners<\/a> in Biden&#8217;s pistol brace crackdown.&#8221;>agency targeted \u200dguns equipped<\/a> with the \u200dbraces, reclassifying such firearms as rifles and thus\u2062 imposing\u200d harsher restrictions on their ownership.<\/p>\n<p>Americans who own pistol \u200cbraces were\u200c given several options: register \u2064their weapon, modify\u2063 or destroy the weapon, permanently \u2062remove and dispose\u2063 of the brace,\u2064 hand the firearm over to the\u2063 ATF, or become \u200bcriminals.<\/p>\n<p>The\u200b ATF\u2019s decision was \u200dchallenged by a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/expert-warns-biden-has-launched-four-prong-attack-against-second-amendment-advises-how-to-respond\/\" title=\"Expert Warns Biden Has Launched \u2018Four-Prong Attack Against\u2019 Second Amendment, Advises How To Respond\">gun rights group<\/a>, and \u2064on\u200b Tuesday the\u200b 5th U.S. \u2064Circuit Court of Appeals ruled in favor of gun owners, Reuters reported.<\/p>\n<p>The \u2062court ruled \u200d2-1 that the ATF targeted stabilizing braces without giving the public the chance to \u2064weigh in on the regulation.<\/p>\n<p>Under the Administrative Procedure Act, agencies\u200d are \u2064required to provide\u2064 public notice of proposed decisions and allow people \u2063with an interest in those\u200b decisions to offer\u2062 feedback.<\/p>\n<p>Judge Jerry Smith\u2062 noted that the ATF did provide a public comment period\u200b on the proposed rule \u200cin 2021, but that the final regulation was so different from the proposal that it\u200b amounted to \u201ca rug-pull on the public.\u201d<\/p>\n<p>Judge Don Willett agreed and added that the rule might violate Americans\u2019\u200d Second\u2063 Amendment\u200d right to \u2062bear arms.<\/p>\n<p>Judge Stephen Higginson, who \u2063dissented, \u200cargued that the regulation did not need\u2064 public comment because it \u201cmerely interpreted a law \u2062passed by Congress,\u201d Reuters reported.<\/p>\n<p>The legal challenge \u200cwas filed by a gun rights group called the \u200dFirearms \u200bPolicy \u2064Coalition. Cody Wisniewski, the group\u2019s attorney, praised\u200b the ruling as \u201ca huge\u200c win\u200c for\u200d peaceable gun owners across the nation.\u201d<\/p>\n<p>Neither\u2062 the ATF nor the Department\u2063 of Justice commented on the court\u2019s decision, according \u2064to \u200dReuters.<\/p>\n<p>The Fort Worth \u2062Star-Telegram reported that the panel \u2062extended a temporary block of \u200bthe restrictions on pistol\u200d braces and sent the case back\u200d to U.S. \u2063District Judge Reed\u2063 O\u2019Connor, who refused to block the \u200dregulation in\u200c March.<\/p>\n<p>O\u2019Connor will decide whether the \u200crule can be enforced while \u2064the case moves forward.<\/p>\n<p>Higginson, the dissenting \u200bjudge in Tuesday\u2019s decision, was appointed to the bench by former President Barack Obama.
