Version: 4.0.47--><h2>Lawyer: Newest Indictment Gives\u200d Trump\u2063 Legal \u2062Power That\u2062 He Never Had \u2062Before<\/h2>\n<p>Former\u200b President Donald Trump \u2062attorney John Lauro sees\u200d at least one silver lining in the\u200d Department of Justice\u2019s latest indictment of his client: Trump \u200cwill get\u2062 to litigate why he\u2064 believes the 2020 \u2064presidential \u200celection was fraudulent.<\/p>\n<p>\u201cIn 2020 \u200dMr. \u200cTrump\u2019s \u2063campaign had a few weeks to\u2064 gear \u2062up and present evidence, and it was \u2064very \u2062difficult,\u201d Lauro told Fox News host\u2064 Bret Baier Tuesday \u2062night\u2063 after special counsel Jack Smith <a href=\"https:\/\/www.westernjournal.com\/nightmare-brewing-trump-gets-assigned-judge-latest-case\/\" target=\"_blank\" rel=\"noopener\">announced<\/a> \u200cthe <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/big-tech-censorship-left-wing-violence-in-national-spotlight\/\" title=\"Big Tech censorship, left-wing violence in national spotlight\">45th president<\/a> was being\u200d indicted in relation to his questioning of the integrity of the 2020\u2064 election.<\/p>\n<p>\u201cWe now\u2063 have the ability in this case\u2064 to issue our own subpoenas, and\u2064 we will re-litigate every\u2064 single issue in the 2020 election in the context of this litigation,\u201d Lauro added. \u201cIt gives President\u2063 Trump an opportunity that he \u2064has never had before,\u200d which\u2062 is \u200bto have subpoena\u2062 power\u200c since January\u200c 6 in a way that can\u2063 be exercised in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-court-is-fast-tracking-sidney-powells-request-for-a-forensic-exam-of-dominion-voting-machines\/\" title=\"Federal Court Is Fast-Tracking Sidney Powell\u2019s Request For A Forensic Exam Of Dominion Voting Machines\">federal court<\/a>.\u201d<\/p>\n<div class=\"firefly-embed\">\n<\/div>\n<h3>Charges and Allegations<\/h3>\n<p>In his latest <a href=\"https:\/\/s3.documentcloud.org\/documents\/23893920\/trump-indictment-2020-election.pdf\" target=\"_blank\" rel=\"noopener\">indictment,<\/a> Smith charges Trump \u2062with four crimes: conspiracy to defraud the \u200cUnited States, conspiracy \u200bto obstruct an official proceeding, obstruction of and attempt to obstruct \u2063an official proceeding, \u2064and conspiracy against rights.<\/p>\n<p>Trump created \u201cwidespread mistrust\u201d in his attempt to \u201coverturn the legitimate results of\u200c the 2020 election,\u201d Smith alleged.<\/p>\n<p>Further, the former <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/watch-psaki-grilled-over-whether-biden-ignored-advice-on-afghanistan-if-he-lied-to-americans\/\" title=\"WATCH: Psaki Grilled Over Whether Biden Ignored Advice On Afghanistan, If He Lied To Americans\">president knew<\/a> that his\u200b allegations of election fraud were false \u200cwhen he made them, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/lawyer-newest-indictment-gives-trump-legal-power-that-he-never-had-before\/\" title=\"New indictment empowers Trump with unprecedented legal authority, says lawyer.\">special\u200b counsel added<\/a>.<\/p>\n<p>Lauro refuted \u200bthat Trump knowingly made \u2064false statements about \u2062the election, but\u2064 even if he did, it is\u200b still <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/roger-stone-pleads-the-fifth-in-deposition-before-jan-6-committee\/\" title=\"Roger Stone pleads the Fifth in deposition before Jan. 6 committee\">protected free speech<\/a> under the First Amendment.<\/p>\n<p>\u201cIt\u2019s not just issues of\u200b fraud. It\u2019s also the fact that procedures were changed, undeniably so, that procedures at the state\u200c level were changed without\u200b the ability of the legislature \u200bto\u2064 weigh in,\u201d\u2064 Lauro explained.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/trump-sends-message-directly-supporters-morning-indictment-never-much-support-anything\/\" target=\"_blank\" rel=\"noopener\">Trump\u2019s<\/a> intention \u2062on Jan. 6, 2021, was to pressure Congress not to certify the <a href=\"https:\/\/www.westernjournal.com\/mike-pence-announces-whether-reject-electoral-college-votes\/\" target=\"_blank\" rel=\"noopener\">Electoral College<\/a> vote, so the state legislatures could have one last chance to review and weigh in \u2064on how the elections in their\u2062 states had been \u200cconducted.<\/p>\n<p>\u201cThe\u200c reality \u200dis that the state legislatures in every state\u2063 have the ultimate responsibility for qualifying electors. \u200cSo what Mr. Trump did was exactly, constitutionally precise and in order. There was nothing \u200cillegal\u200c about that,\u201d Lauro argued.<\/p>\n<p>Article II, section 1, clause 2 of the Constitution<a href=\"https:\/\/constitution.congress.gov\/browse\/article-2\/section-1\/#:~:text=Each%20State%20shall%20appoint%2C%20in,Profit%20under%20the%20United%20States%2C\" target=\"_blank\" rel=\"noopener\"> provides<\/a>, \u201cEach State shall appoint, in such Manner as the Legislature thereof may \u200bdirect, a Number of Electors, \u200cequal to the whole\u2063 Number \u2063of Senators and Representatives \u200dto which the State may\u200b be entitled \u200bin the Congress.\u201d<\/p>\n<p>Trump \u201cwas required to take steps, as\u200c president of the \u200bUnited States, to ensure that that election was \u2062held \u200cin\u2064 a valid way,\u201d Lauro said. \u201cAll of that, now, is being criminalized.\u201d<\/p>\n<p>Baier countered Lauro\u2019s assertions, saying, \u201cThe states did that. Each\u200c individual state\u200b certified the elections. They\u200d were signed by the governors \u2014\u2064 many of them Republican \u200cgovernors, and many of\u200b them Republican \u200dsecretaries of state, that signed off\u2064 and certified those election results before they\u2063 came to Washington, D.C., and we \u2063had what was January 6.\u201d<\/p>\n<p>\u201cSo what you\u2019re talking about was \u200ddone. It was\u200d certified,\u201d Baier reiterated.<\/p>\n<p>Trump and the <a href=\"https:\/\/www.westernjournal.com\/hunter-bidens-sweetheart-plea-deal-now-investigated-house-republicans\/\" target=\"_blank\" rel=\"noopener\">Republicans<\/a> were not challenging\u2064 election results in all 50 states, but <a href=\"https:\/\/rollcall.com\/2020\/12\/16\/electoral-votes-are-in-but-congressional-count-may-hold-another-round-of-drama\/\" target=\"_blank\" rel=\"noopener\">swing states<\/a> that \u2064flipped from\u200c Trump wins in 2016 to Democrat Joe Biden \u2064victories in 2020.<\/p>\n<p>Of those states, only Georgia had a\u200c Republican governor\u2063 and secretary of state.\u2062 Pennsylvania, Michigan and \u200bWisconsin\u2062 all had <a href=\"https:\/\/www.washingtonpost.com\/politics\/2020\/12\/04\/how-trump-allies-congress-can-launch-one-more-challenge-bidens-win-january\/\" target=\"_blank\" rel=\"noopener\">Democrats<\/a> in both those <a href=\"https:\/\/ballotpedia.org\/Wisconsin_Secretary_of_State\" target=\"_blank\" rel=\"noopener\">positions<\/a>.\u200b Further, while Arizona had a Republican governor, the secretary of\u200b state overseeing the election was a Democrat.<\/p>\n<p>Lauro concluded, \u201cIt\u2019s never been presented to \u200dthe states.\u2064 Now what we\u2019re going to have is,\u200d not just a civil trial, but a criminal trial\u200b exercising his right to \u200cspeech.\u201d<\/p>\n<p>The U.S. \u200cSupreme Court ultimately <a href=\"https:\/\/www.westernjournal.com\/ap-supreme-court-rejects-texas-led-election-lawsuit-seeking-overturn-biden-win\/\" target=\"_blank\" rel=\"noopener\">dismissed<\/a> Texas\u2019 case, \u200dconcluding that the Lone Star State \u2063lacked standing to sue over \u2063how Pennsylvania \u2064and other\u200c states conducted \u200ctheir elections.<\/p>\n<p>The post <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\/lawyer-newest-indictment-gives-trump-legal-power-never\/\">Lawyer: \u200dNewest Indictment Gives Trump \u2063Legal Power That He \u200bNever Had Before<\/a> appeared first on <a rel=\"nofollow\" href=\"https:\/\/www.westernjournal.com\">The Western Journal<\/a>.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Former President Trump&#8217;s attorney, John Lauro, finds a positive aspect in the recent indictment by the Department of Justice.
