But on Tuesday, his announcement of criminal charges against President Trump fell short of even the most basic scrutiny.<\/p>\n<p>Instead of charging Trump with incitement to\u2064 riot or insurrection, Smith presented a\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/piers-morgan-rips-insufferable-woke-brats-upset-over-snow-white-consensual-kiss-controversy\/\" title=\"Piers Morgan Rips \u2018Insufferable Woke Brats\u2019 Upset Over \u2018Snow White\u2019 Consensual Kiss Controversy\">lengthy op-ed<\/a> on why Trump was a &#8220;Bad Orange Man&#8221; during \u200bthe period\u2062 between November \u200d3, 2020, and January 6, 2021. He charged Trump\u200b with a series\u200d of ancillary or \u200dnon-applicable\u200d crimes, lacking the evidence for the\u200c more\u2064 serious \u2064charges.<\/p>\n<p>This \u2064approach sets\u2062 up three dangerous landmines\u2062 for the country:<\/p>\n<ol>\n<li>The expansion of law enforcement power into\u2063 traditionally protected areas of free speech.<\/li>\n<li>The politicization \u200dof \u200cthe Justice Department, further polarizing the nation.<\/li>\n<li>The potential politicization\u2063 of the Supreme Court as these \u2064stretch charges make\u2064 their way \u2063through\u2062 the judicial system.<\/li>\n<\/ol>\n<h3>The Legal Speciousness \u2062of Jack Smith&#8217;s Charges<\/h3>\n<p>The indictment \u2063acknowledges Trump&#8217;s right to free speech\u2063 and his ability to challenge the election legally. However, Smith claims that Trump&#8217;s actions went\u200b beyond \u2064exercising those\u200d rights and\u200c crossed into criminal territory.<\/p>\n<blockquote>\n<p><em>&#8220;The Defendant had a \u2062right, \u200blike every American, to \u2064speak\u2063 publicly about the election and \u2064even to claim, falsely, that there had been outcome determinative \u2064fraud during the election and that he had won. He was\u200d also entitled\u2064 to formally challenge the results \u2064of the election through lawful and \u200cappropriate means&#8230; Shortly after election day, the Defendant \u200calso pursued unlawful means of discounting legitimate votes and subverting the election process.&#8221;<\/em><\/p>\n<\/blockquote>\n<p>But how exactly did Trump&#8217;s activities\u200c violate \u2062the law while evading \u2062the protection of the First Amendment? Smith alleges\u2064 violations \u2062of three \u200bcriminal statutes: \u2063conspiracy to defraud the \u200bUnited States, conspiracy to obstruct the \u200dJanuary 6 congressional proceeding, and conspiracy against the right to vote.<\/p>\n<p>All three charges are massive stretches, novel interpretations of the \u2062law that endanger the very \u200bessence of\u2064 the First Amendment.<\/p>\n<p>The first\u200d charge,\u2062 conspiracy to defraud the United States, \u2063is typically\u2064 reserved for \u2064<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/jack-smiths-indictment-against-trump-is-dangerous-bulls\/\" title=\"Jack Smith's indictment against Trump is highly problematic.\">cases involving swindling victims<\/a>\u200d out of money or tangible property. It is not meant to \u200ccriminalize political rhetoric or hyperbole.<\/p>\n<p>The second charge, obstruction\u200c of justice, is usually \u2063applied to witness tampering or intimidation, not to lobbying the government based on a\u2064 legal theory. His announcement focused\u2064 more on Trump&#8217;s political activities\u2064 than on any actual legal violations.<\/p>\n<h3>The Double Standard<\/h3>\n<p>Conservatives\u2064 are rightly pointing out the \u200cdouble standard in the DOJ&#8217;s treatment of Trump&#8217;s indictment. It\u2064 conveniently comes \u2064on the\u2062 heels of the exposure and cancellation of the DOJ&#8217;s \u200csecret deal with Hunter Biden, overseen\u2063 by Attorney General Merrick Garland,\u200b who works for Joe Biden. This deal shielded Hunter\u2064 Biden from any investigation into his business \u2064corruption, which implicates Joe \u200cBiden.<\/p>\n<p>The blatant double standard is being used to attack Joe\u200c Biden&#8217;s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/josh-hawley-calls-for-ag-garlands-impeachment-after-mar-a-lago-raid\/\" title=\"Josh Hawley Calls For AG Garland\u2019s Impeachment After Mar-a-Lago Raid\">chief political opponent<\/a>, piling on \u200byet another case against Trump. The list of \u2062legal challenges involving Trump seems endless, \u2064creating \u200ba clear path from today to the 2024 \u2062election.<\/p>\n<p>Trump\u2062 will\u2062 be consumed by legal battles throughout the election cycle,\u200d while the media\u200b endlessly covers these issues. Meanwhile, \u200dJoe Biden is likely to escape\u2062 unscathed.\u2062 This appears to be a case of legal \u2062election interference, as Trump claims.<\/p>\n<p>This claim is likely to rally GOP voters \u2063to Trump&#8217;s side, hoping for vengeance \u2064against the Biden DOJ and the media. However,\u2064 as Trump&#8217;s campaign becomes entangled in legal and financial quagmires, that hope may prove empty.<\/p>\n<h3>The \u2063Supreme Court Challenge<\/h3>\n<p>Jack \u2063Smith&#8217;s\u2064 weak indictment is likely to \u200cbe overturned by the\u200d Supreme Court.\u200b As the head \u200dof the DOJ&#8217;s public integrity unit, Smith has a track record of \u2064failed prosecutions, including the overturned case \u2064against \u2064Virginia Governor Bob McDonnell.<\/p>\n<p>If this case ends up before \u200dthe Supreme Court and is overturned by a majority\u2062 vote, the resulting panic on the Left will be\u200b unprecedented. \u2062It will surpass the panic caused by the infamous <em>Bush v. Gore<\/em> case. Chief Justice John Roberts&#8217;\u2063 dream of a \u200crespected Supreme \u2062Court will \u200bcrumble, and Smith will be to blame\u2063 for his baseless\u200c charges.<\/p>\n<p>All \u2062of this could have been avoided. Smith&#8217;s case\u200c against Trump for classified documents charges\u2064 is legally sound, \u2062but he couldn&#8217;t\u200c resist the temptation to put\u200b Trump on trial for January \u200b6. In doing \u200cso, he threatens \u200cthe\u200c First Amendment, the legitimacy of the DOJ, and ultimately, the credibility of the Supreme Court.
