(Photo by Chip Somodevilla\/Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/daniel-baldwin\">Daniel Baldwin<\/a><br \/>12:18 PM \u2013 Wednesday, August 2, 2023<\/h2>\n<p>Legal experts called the latest indictment \u2062of\u2063 45<sup>th<\/sup> President \u2063Donald Trump \u201ca noncrime\u201d and\u200c dismissed it as the latest \u2063attempt by Special Counsel Jack Smith to stop \u200cTrump from\u2062 retaking the\u200b White House.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cJack Smith\u2019s latest indictment in DC\u200c is just another bogus indictment for another noncrime, this time for the noncrime of objecting to a presidential election, which\u200c is allowed\u2063 by the Electoral Count Act of \u200c1887,\u201d said \u2062Mike Davis, the founder \u2063and president \u2063of the Article III Project. \u2064\u201cIt\u2019s also allowed under \u2062the First Amendment to the United \u2062States Constitution. \u2062It\u2019s only illegal to object to\u200b elections in third\u2062 world Marxist Hellholes.\u200d Otherwise,\u200b Democrats would \u200dbe imprisoned\u200b for objecting to Republican\u200d presidential wins in\u2062 1968, 2000,\u2064 2004, and 2016.\u201d<\/p>\n<\/blockquote>\n<p>A federal grand jury indicted\u2063 Trump on four counts Tuesday afternoon of Conspiracy to Defraud the United States;\u2063 Conspiracy \u2063to Obstruct an Official \u2063Proceeding; Obstruction of, and Attempting to\u2062 Obstruct, an Official Proceeding; and Conspiracy Against Civil Rights. <\/p>\n<p>Davis\u2062 says President Joe\u200d Biden\u2019s Department of \u200dJustice levied this indictment \u200bon \u200cTrump \u2064out of fear.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cJack\u200d Smith is a political \u2063hitman sent in by Biden and [AG Merrick] Garland to take out President Trump before the November 2024 presidential election,\u2064 because they fear they can\u2019t beat Trump politically,\u201d said \u200dDaivs. \u201cSo they\u2019re simply gonna run lawfare against him.\u201d<\/p>\n<\/blockquote>\n<p>U.S. District Judge\u200d Tanya Chutkan was appointed as the judge \u200dto\u2063 oversee the case. An Obama-appointed judge, Chutkan\u200d was \u200cthe only federal judge in Washington, \u2063DC., who \u200chas sentenced Jan. 6 defendants to sentences longer than the government had requested.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWith this DC Obama judge and\u200d this DC \u2063jury pool that\u2019s like 95% Democrat and 99%\u200c Trump deranged,\u201d said Davis. \u201cThere is zero chance that President Trump \u2064will get a fair trial. They will almost \u200ccertainly find \u2062him guilty. This judge will convict him.\u200b The DC circuit, which is Obama\u2064 stacked,\u200d will affirm the conviction and this will have to\u200b be overturned by the Supreme Court several years\u2062 from now.\u201d<\/p>\n<\/blockquote>\n<p>Davis \u200battacked Smith\u2019s track record as a prosecutor, arguing \u200bSmith \u2064has a history of over-prosecuting \u2064people. He specifically highlighted the DOJ, during Smith\u2019s tenure there, convicting then-Virginia Republican Gov. Bob McDonnell of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-gives-pardons-to-73-individuals-and-commutes-another-70-sentences-steve-bannon-is-included\/\" title=\"BREAKING: President Trump Gives Pardons to 73 Individuals and Commutes Another 70 Sentences \u2013 Steve Bannon Is Included\">honest services fraud<\/a> and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/davis-j6-indictment-will-propel-trump-back-to-white-house\/\" title=\"Davis predicts J6 indictment to boost Trump's return to White House.\">illegally accepting gifts<\/a>.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cJack \u200bSmith is used\u2063 to\u2064 getting overturned by the Supreme Court,\u201d said \u2063Davis.\u2064 \u201cHe was overturned unanimously by the Supreme Court when Jack Smith brought bogus\u200c corruption charges against former Virginia Governor Bob McDonnell, \u2062a likely 2016 \u2063presidential candidate.\u201d<\/p>\n<\/blockquote>\n<p>The Supreme Court overturned Smith\u2019s prosecution \u2062via a unanimous \u200c8-0 \u200bvote. But that \u2062decision came two years after the conviction.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[Jack Smith] took \u2064out a potential\u200c Republican presidential candidate,\u201d said Davis. \u201cAnd\u200b the Supreme Court didn\u2019t fix it for several years after that. \u2064That is the same play that Joe\u200c Biden, Merrick Garland and Jack Smith are running with this Trump indictment.\u201d<\/p>\n<\/blockquote>\n<p>Davis argued that Attorney\u2062 General Merrick picked Smith, because\u2063 of that very track record.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cJack Smith is a political\u2062 hitman,\u201d Davis said.\u2063 \u201cHe is a scud missile. He is reliable for the Democrats. He \u2063will do his \u200cduty, which \u200cis to \u200cserve as \u2064a Democrat \u2063operative to take out \u200cRepublican \u200dpresidential candidates like\u200b he did with Bob McDonnell.\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe good news is \u2062that\u2062 we\u2019re \u2063on to Jack Smith\u2019s game,\u201d\u200b Davis continued. \u201cAnd so \u2063it\u2019s not going to work this time.\u201d<\/p>\n<\/blockquote>\n<p>Davis concluded by asserting these indictments will propel the 45<sup>th<\/sup> \u2062president back to the White House.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAlvin Bragg\u2019s \u2064indictment of Trump \u200cfor the noncrime of a businessman settling a\u2062 nuisance\u2063 claim won the nomination for \u200bTrump,\u201d said Davis. \u201cJack Smith\u2019s first indictment of Trump for the noncrime \u2062of a former president having\u2063 his presidential records in the Office of former President, \u2064which \u200bis allowed by the\u200d Presidential Records Act, I think\u200c helped President Trump\u2063 squeak by and win the general\u2064 election.\u201d<\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThis latest\u2062 indictment \u200dby Jack Smith for the\u2062 noncrime of objecting to\u2063 a presidential election, I think, \u2063is\u200d going to really anger \u2062the American people,\u201d Davis\u200b continued. \u201cBecause they understand that it\u2019s not going to be a DC prosecutor, \u2063a DC\u2064 judge, and \u200ca DC jury\u2064 who gets to \u2062pick the next president \u2062of the United\u200b States.\u2062 The American \u200dpeople get\u200b to pick the \u200dpresident of the\u200d United States. I think the American people correctly \u2063see that this is political lawfare by Democrats against President \u200dTrump, and it\u2019s not going to fly.\u200c The American people, I think, are going\u200b to put President Trump back\u2063 in the White\u200b House on November 5th, 2024.\u201d<\/p>\n<\/blockquote>\n<p>Stay informed!
