There is no smoking \u200dgun,\u201d he said. \u201cThere is no one who is credibly prepared to \u2064testify \u200dthat Donald Trump said to him, \u2018I know personally I lost the election.\u2019<\/p>\n<p>\u201cThere\u2019s \u2063a lot of evidence that people told him he lost the election, but you know \u2062Donald Trump, and you\u200b know that he\u2019s\u2064 going to make up his own mind, and they\u2019re going to have a very <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/one-key-argument-for-michael-sussmanns-defense-has-crumbled-already-2\/\" title=\"One Key Argument For Michael Sussmann\u2019s Defense Has Crumbled Already\">hard time proving<\/a>\u2064 that.\u201d<\/p>\n<p>A \u201chard time proving that\u201d is an understatement.<\/p>\n<p>Even Trump\u2019s worst detractors have to have difficulty\u2063 believing that he\u200d actually thinks he \u200dlost\u200d the 2020 election. Tens of millions of his supporters have trouble \u2064believing it, given the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/harvard-law-professor-declares-jan-6-trump-indictment-is-not-likely-to-survive\/\" title=\"Harvard Law Professor doubts Jan. 6 Trump indictment will hold up.\">hair-breadth margins<\/a> of victory President Joe \u200dBiden recorded in <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-more-votes-than-voters-in-key-swing-states\/\" title=\"Trump: More Votes Than Voters in Key Swing States\">key swing states<\/a>, and \u2064the evident meddling of the <a href=\"https:\/\/www.westernjournal.com\/fbi-official-exposes-twitter-coverup-changed-results-2020-election\/\" target=\"_blank\" rel=\"noopener\">FBI<\/a> \u2062 and the <a href=\"https:\/\/www.westernjournal.com\/2020-election-bombshell-zuckerberg-confesses-helping-fbi-interfering-election\/\" target=\"_blank\" rel=\"noopener\">barons of social media<\/a> \u2014 not to mention the lingering suspicions of \u200d <a href=\"https:\/\/www.westernjournal.com\/informant-appearing-dsouzas-doc-film-2000-mules-details-alleged-ballot-harvesting-operation-worked\/\" target=\"_blank\" rel=\"noopener\">more traditional election fixing<\/a> that haven\u2019t disappeared.<\/p>\n<p>For Trump himself, who has been unfailingly consistent <a href=\"https:\/\/www.westernjournal.com\/trump-demands-redo-2020-election-held-immediately-zuckerbergs-confession-fbi\/\" target=\"_blank\" rel=\"noopener\">in his public statements<\/a> about the vote for the past three years, it\u2019s almost inconceivable.<\/p>\n<p>But, as Dershowitz pointed \u2062out, Smith won\u2019t be bringing his case \u200din a jurisdiction of fair-minded Americans. The case is in Washington, D.C. \u2014 where Biden \u2063took <a href=\"https:\/\/www.270towin.com\/states\/District_of_Columbia\" target=\"_blank\" rel=\"noopener\">more than 90 percent<\/a> of the\u2063 vote.<\/p>\n<p>\u201cNow,\u2063 it\u2019s the District of Columbia,\u200c 90 some-odd percent\u2062 of the jury pool will have voted against\u2062 them so they may actually get \u2063a conviction from a \u2062D.C. jury, but will it survive appellate review and review to the Supreme Court?<\/p>\n<p>\u201cI don\u2019t think so.\u201d<\/p>\n<p>And that, essentially, is where the Smith prosecution \u2063is resting its\u200d case. He has a <a href=\"https:\/\/www.westernjournal.com\/know-doj-special-counsel-terrifying\/\" target=\"_blank\" rel=\"noopener\">history of political prosecutions<\/a> \u2014 including\u2064 a corruption conviction of former Virginia Republican Gov. Bob McDonnell\u200c that was\u200c overturned \u200cby a unanimous Supreme Court \u2064in 2016.\u2064 (It was an 8-0 vote. The seat left open \u200dby the death of Justice Antonin Scalia in February of that\u200c year\u200b was still open \u2014 and Democrats were trying to put\u2062 Merrick Garland in it.)<\/p>\n<p>This \u200disn\u2019t about pursuing \u201cjustice\u201d\u200b in the traditional American understanding \u2063of the word. It\u2019s about shopping a \u2063weak-as-water political prosecution \u200cto the most\u2062 sympathetic jury pool in the \u200bcountry and landing a conviction that would\u200c stand as a public smear against the most popular political opponent of the current president.<\/p>\n<p>It\u2019s a tactic the likes of\u2063 Vladimir Putin would admire (a\u200b guy who\u2019s big on <a href=\"https:\/\/www.westernjournal.com\/nothing-left-lose-imprisoned-russian-activists-group-shows-world-putin-free-time\/\" target=\"_blank\" rel=\"noopener\">jailing the \u200copposition<\/a>).<\/p>\n<p>But \u2064it has nothing to\u2062 do with loyalty to the law.<\/p>\n<p>That\u2019s why, Dershowitz said,\u2062 \u201cthe first motion his lawyers\u200d will make will be a change of venue to northern Virginia, where the jury \u200cpool will \u200bbe fairer \u2026 \u2062and you could \u2062move it further, you could\u2062 move it to southern Virginia, where it\u2019s \u200bmuch more even. You could\u2064 move it to\u200b an adjoining state.\u201d<\/p>\n<p>\u201cRemember, this is a federal indictment.\u200b It doesn\u2019t have to be tried within\u200c the state or the area. You can make a motion for a change of venue.\u201d<\/p>\n<p>It\u2019s a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bombshell-kari-lake-video-of-arizona-signature-verification-process-will-make-your-blood-boil\/\" title=\"Arizona Signature Verification Process Video by Kari Lake is Shocking.\">rock-solid bet<\/a> that Smith would fight a motion like that\u200d tooth and nail\u200b \u2014 probably with plenty of sob stories about how the \u201ctrauma\u201d of the Jan. 6 Capitol \u2062incursion affected\u2064 the D.C. population \u2064in a way unlike anywhere else in\u200b the country, and blah and blah \u200dand blah.<\/p>\n<p>But the real \u200bissue would be that pretty much nowhere else in the country would the deck be so stacked in favor of \u2063Democrats.<\/p>\n<p>\u201cI agree with Professor Dershowitz,\u201d Hannity said. \u201cI believe he can\u2019t get a fair trial in D.C. If the trial is in D.C., it\u2019s \u2062a fait accomplis.\u2062 It\u2064 would be a guilty verdict.\u201d<\/p>\n<p>Dershowitz summed up the \u200cmatter best as he explained why,\u2063 even in the event of a conviction, the case wouldn\u2019t survive a Supreme Court \u200creview.<\/p>\n<p>\u201cWhen you have the\u200b president of the United States\u2019 people going after his opponent in a political election, it has to be \u200dbeyond reproach,\u201d he said. \u201cIt has \u200cto be\u2064 without\u200b any problems.
