Alberta<\/em> is \u2062expected\u200b to lead to\u200d the withdrawal of charges\u200d against <a href=\"https:\/\/www.jccf.ca\/court-disregards-charter-freedoms-in-pastor-james-coates-trial\/?mc_cid=15345efd14&#038;mc_eid=880d7fa4a1\" target=\"_blank\" rel=\"noreferrer noopener\">individuals<\/a>, <a href=\"https:\/\/www.jccf.ca\/court_cases\/r-v-stephens-stephens-v-ahs-et-al\/?mc_cid=15345efd14&#038;mc_eid=880d7fa4a1\" target=\"_blank\" rel=\"noreferrer noopener\">churches<\/a>, and\u200b <a href=\"https:\/\/www.jccf.ca\/court_cases\/r-v-ty-northcott-northcott-rodeo-inc\/?mc_cid=15345efd14&#038;mc_eid=880d7fa4a1\" target=\"_blank\" rel=\"noreferrer noopener\">other organizations<\/a> \u200d involved in similar cases.<\/p>\n<p>Justice Barbara Romaine ruled \u2062in favor \u200cof \u2062the applicants, highlighting that the Chief \u2062Medical Officer of Health (CMOH) had\u2062 exceeded her authority by delegating\u2063 decisions to \u200dthe cabinet, which was not \u2062permitted under\u200d Canadian \u200claw. The CMOH herself\u200c admitted during\u2064 the trial that she only provided advice and recommendations to politicians,\u2062 without making the decisions herself.<\/p>\n<p>While Justice Romaine acknowledged that the lockdowns violated the \u2064<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/supreme-court-takes-up-mississippi-abortion-ban-case-that-could-limit-roe-v-wade\/\" title=\"Supreme Court Takes Up Mississippi Abortion Ban Case That Could Limit Roe v. Wade\">rights outlined<\/a> in section\u2063 2 of the Canadian \u2063Charter,\u2062 she stated that they would \u2063have been permissible if implemented legally.<\/p>\n<p>&#8220;If \u200cI am \u200dincorrect with respect \u200dto whether\u2064 [the orders were legal], \u200cthese infringements were amply justified as reasonable\u2064 limits in a free and democratic society pursuant to section 1 of the Charter,&#8221; Romaine wrote.<\/p>\n<p>The court action filed by Rebecca \u2062Ingram and the other applicants challenged the lockdowns nine months after the health emergency began, making it the first\u200c of its\u200c kind. However, Canadian courts allowed the Alberta \u2062government to delay presenting evidence until July 2022, allowing them to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/canadian-court-invalidates-covid-lockdowns-due-to-illegal-implementation\/\" title=\"Canadian court declares Covid lockdowns illegal due to improper implementation.\">continue\u200d violating\u200d citizens&#8217; rights<\/a>\u200d without \u200cany oversight.<\/p>\n<p>John Carpay, president of the Justice\u2063 Center for Constitutional Freedoms, expressed his joy at the decision and \u200cits implications for ongoing cases.<\/p>\n<p>&#8220;We are hopeful \u200bthis ruling will \u2062lead to the withdrawal\u2063 of charges against Pastor \u2063James Coates, Fairview Baptist Church, Ty Northcott, and \u2064other courageous citizens who refused to comply with unjust and unscientific measures,&#8221; Carpay\u2064 said.<\/p>\n<p>In a \u2064statement to\u2062 the Federalist, Carpay emphasized the\u2063 significance of\u200d this decision in the legal status of Canadian lockdowns.<\/p>\n<p>Carpay stated, &#8220;Courts have been deferential to the government and have\u2063 not required \u2063them to demonstrate that lockdowns are doing more good than harm or present persuasive evidence&#8230; It&#8217;s a breath of fresh air\u200d to see a\u2064 <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/ohio-supreme-court-throws-out-gop-drawn-congressional-map-that-bolstered-republicans-statewide\/\" title=\"Ohio Supreme Court Throws Out GOP-Drawn Congressional Map That Bolstered Republicans Statewide\">court invalidate<\/a> these measures.&#8221;<\/p>\n<p>The ruling comes at a time when the Canadian\u200d government has been subjecting its citizens to a constant <a href=\"https:\/\/thefederalist.com\/2023\/07\/24\/pastor-exiles-family-to-kenya-to-escape-canadian-persecution-of-christians\/\" target=\"_blank\" rel=\"noreferrer noopener\">stream<\/a> of persecution\u200d and mistreatment, including the persecution of Christians and treating dissent as \u2062terrorism.<\/p>\n<hr>\n<p>Samuel Boehlke is a rising\u2063 senior in\u200c Mass\u200c Communication\/Law and Policy \u2064at Concordia University Wisconsin and a current intern at\u2062 The Federalist.
