Bowers was convicted of 63 counts, including 11 counts of obstruction of free exercise of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tree-of-life-synagogue-shooter-convicted-on-all-charges-could-face-death-penalty\/\" title=\"Synagogue shooter found guilty on all counts, may face death penalty.\">religious beliefs resulting<\/a> in death.<\/p>\n<p>Two weeks ago, during the first phase of the sentencing portion of the\u2062 trial, the jury found Bowers to be eligible for the death penalty. Jurors then heard\u200d testimony and arguments \u2062from both prosecutors and defense attorneys as to whether he deserved to be put to death\u200c for\u200c the killings.<\/p>\n<p>On June 16, the jury found him guilty on all counts. His\u2064 defense lawyers did not dispute that he planned and carried out the \u2063attack, but argued that he suffered from life-long mental illness and was delusional.<\/p>\n<p>Jurors heard\u200b testimony from some of the survivors of\u2064 the attack \u200dand\u200b were shown evidence of Bowers&#8217;s \u2063anti-Semitism, including multiple posts attacking Jews made on a far-right website in the \u2063months \u2063leading up \u200cto \u2062the attack.<\/p>\n<p>In federal capital cases, \u200ba unanimous \u2063vote by jurors in a separate penalty phase of the\u200c trial is \u2062required\u200d in order to \u2064sentence a defendant to death, and the judge cannot reject the jury&#8217;s vote. Had the jury\u200b been unable to reach a unanimous decision, Bowers \u200bwould have instead been sentenced to life in prison without the possibility of release.<\/p>\n<p>U.S. \u200cDistrict Judge Robert Colville is due to formally sentence \u200bBowers to death at a hearing on Thursday morning, during\u200c which some relatives of Bowers&#8217;s victims are expected to address the court, the Times reported.<\/p>\n<p>The jury&#8217;s\u2062 decision on Wednesday marks the first time since President Joe Biden, a Democrat, \u200dtook office in January 2020 that federal prosecutors have successfully sought and won the death penalty.<\/p>\n<p>It\u200c is\u2062 not clear when, if ever, Bowers\u200d will be\u200d executed: The U.S. Department of Justice has \u200binstated a moratorium on carrying out federal executions while it reviews the death penalty, which Biden pledged to abolish\u200b when he was running for the presidency.<\/p>\n<h3>Sentencing Phase Arguments<\/h3>\n<ul>\n<li>Prosecutors\u2062 argued that\u200d Bowers had\u2063 the necessary intent and premeditation to qualify\u2064 for\u2063 the death penalty.
