The case has been assigned to U.S. District Judge Tanya Chutkan, who was appointed\u200d by former president Barack Obama.<\/p>\n<p>The <strong>charges<\/strong> stem from Special Counsel Jack \u2064Smith&#8217;s\u2063 sprawling\u200b investigation into allegations <strong>Trump<\/strong> sought to\u200b reverse his loss to Biden. Despite \u200da dizzying and growing array of legal troubles, <strong>Trump<\/strong> has \u2063solidified his status as the front-runner for the\u200d Republican\u200d presidential nomination, according to \u2064<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/psaki-doesnt-deny-bidens-approval-has-declined-sharply-blames-part-of-the-american-public\/\" title=\"Psaki Doesn\u2019t Deny Biden\u2019s Approval Has \u2018Declined Sharply,\u2019 Blames Part Of The American Public\">public opinion polls<\/a>.<\/p>\n<p>Weeks of assertions that the \u200belection had been stolen culminated in a\u2062 fiery <strong>Trump<\/strong> speech on Jan. 6, 2021, as Congress met \u2062to certify the results.\u200c Soon after, his supporters stormed the U.S. Capitol in a bid\u200b to stop\u200d Congress from formalizing Biden&#8217;s victory.<\/p>\n<p>In a brief statement\u200c to reporters, Smith placed the blame for \u2064the violence squarely on\u200d <strong>Trump<\/strong>&#8216;s shoulders.<\/p>\n<p>&#8220;The attack on our nation&#8217;s Capitol on\u2062 Jan.\u2064 6, 2021, was an unprecedented assault on the seat of American democracy. As described \u200din the indictment, it was fueled by lies\u2014lies by the defendant, targeted at obstructing\u200c the bedrock function of the U.S. government,&#8221; Smith \u2064said.<\/p>\n<p>More than 1,000 people have been \u200carrested in connection with the attack.<\/p>\n<h3>Phony Slate of\u2062 Electors<\/h3>\n<p><strong>Trump<\/strong> \u2063 and others organized fraudulent slates \u2064of electors in seven states, all of which he lost, to be certified as official by Congress \u200don Jan. 6, the indictment said.<\/p>\n<p>The indictment\u200c lays out numerous examples of <strong>Trump<\/strong>&#8216;s election falsehoods and notes that close advisers, including \u2064senior intelligence officials, told him repeatedly that the \u200dresults were legitimate.<\/p>\n<p>&#8220;These claims were false,\u200d and the defendant knew that they were false,&#8221; prosecutors \u2063wrote.<\/p>\n<p>When the push to certify the fake electors\u2064 failed, <strong>Trump<\/strong> sought to\u2064 pressure Pence not to allow certification of the election to \u2063go forward, and took advantage of the chaos outside\u200c the \u2062Capitol to do so, according to prosecutors. During the violence, <strong>Trump<\/strong> rebuffed calls from\u200b his advisers \u200bto issue \u2064a calming message.<\/p>\n<p>&#8220;The Defendant attempted to\u2063 use a crowd of supporters that he had gathered in Washington, D.C. to pressure the Vice President to fraudulently alter the election\u200d results,&#8221; the indictment \u2064reads.<\/p>\n<p>In a statement, the <strong>Trump<\/strong> campaign said he had always followed the law and characterized the\u2064 indictment as\u2062 a \u200d&#8221;persecution&#8221; reminiscent of Nazi Germany.<\/p>\n<p>&#8220;President <strong>Trump<\/strong> will not be deterred by disgraceful and unprecedented political targeting!&#8221; it \u200dadded. Later Tuesday, <strong>Trump<\/strong>&#8216;s campaign\u200b sent out\u2062 a fundraising\u2062 email referencing the indictment.<\/p>\n<p>The indictment also includes \u200csix unnamed co-conspirators who have not been charged.<\/p>\n<p>Based on \u200cthe descriptions, they appear to include <strong>Trump<\/strong>&#8216;s former personal lawyer Rudy Giuliani, who called state lawmakers in the weeks following the 2020 election to pressure them not to certify their \u200bstates&#8217; results; former Justice Department official Jeffrey\u200b Clark, who tried to get himself \u2063installed as attorney general so he could launch voter \u2062fraud investigations in Georgia and other swing \u200dstates; and\u200d attorney \u200cJohn\u2063 Eastman,\u2064 who advanced the erroneous \u200dlegal theory that Pence could \u200dblock the electoral certification.<\/p>\n<p>&#8220;Every statement \u200cthat Mayor Giuliani made was truthful and expressing his beliefs,&#8221; his attorney Robert Costello told Reuters. &#8220;He believed there was proof of election \u200bfraud, and I\u2062 have seen the affidavits that back \u200dthat up.&#8221;<\/p>\n<p>Eastman lawyer Charles Burnham said in an email the indictment used\u200d a &#8220;misleading presentation of the record to contrive criminal <strong>charges<\/strong> against Presidential candidate <strong>Trump<\/strong> \u2062and \u200dto \u2062cast ominous aspersions on his close advisors.&#8221;<\/p>\n<p>Clark did not respond to requests for comment.<\/p>\n<p>The most serious charge against <strong>Trump<\/strong> carries a maximum penalty of 20 years in prison, though sentencing is\u2064 based on numerous factors and is subject \u200bto the judge&#8217;s discretion.<\/p>\n<h3>Mounting Legal Woes<\/h3>\n<p><strong>Trump<\/strong> already had become the first former U.S.\u2063 president to face criminal <strong>charges<\/strong>. He has portrayed all of the\u200c prosecutions\u200c as part of a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-faces-federal-charges-for-efforts-to-overturn-2020-election\/\" title=\"Trump charged federally for attempting to overturn 2020 election.\">politically motivated witch hunt aimed<\/a> at\u200b preventing his\u2064 return to power.<\/p>\n<p>Tuesday&#8217;s <strong>charges<\/strong> represent\u200b a second\u2063 round of <strong>federal charges<\/strong> by Smith, who was appointed special counsel in November by \u200bU.S. Attorney\u2062 General Merrick Garland.<\/p>\n<p><strong>Trump<\/strong> pleaded not guilty after a <strong>federal<\/strong> grand jury \u2062in Miami convened by the special counsel charged him in June\u200b in a 37-count indictment over his unlawful retention of classified government documents after leaving office \u2063in 2021\u200d and obstructing justice. Many Republicans\u2014elected officials and voters\u2014have rallied\u200d behind <strong>Trump<\/strong>, portraying the <strong>charges<\/strong> against him as selective prosecution and a Democratic plot to destroy\u2063 him politically.<\/p>\n<p>That pattern largely held on \u200dTuesday, as most\u200c Republicans pivoted to attacks on Biden. House Speaker Kevin \u2064McCarthy, the top Republican in Congress, said on X, the site formerly known as Twitter, that the indictment was an attempt to &#8220;attack the frontrunner for the\u200d Republican nomination.&#8221;<\/p>\n<p>Florida governor Ron DeSantis, \u2062 <strong>Trump<\/strong>&#8216;s leading rival for the Republican nomination, said on X that he had yet to \u200dread the indictment. But he vowed to &#8220;end the weaponization of the <strong>federal<\/strong> government,&#8221; suggesting that the \u200dBiden administration was \u2064using the <strong>charges<\/strong> to target a political enemy.<\/p>\n<p>Strategists said that while the\u200c indictments could help <strong>Trump<\/strong> solidify support within his base and win the Republican nomination, his ability to capitalize on them may be more limited in next year&#8217;s general election, when he will have to win over more skeptical moderate\u2064 Republicans and independents.<\/p>\n<p>Meanwhile, <strong>Trump<\/strong>&#8216;s legal \u200bwoes are \u2064growing. In addition to the three\u200c indictments, <strong>Trump<\/strong> faces a fourth criminal investigation by a county prosecutor \u2064in Georgia into accusations he sought to\u2062 undo his 2020 election loss in that state.<\/p>\n<p>Fulton County district attorney Fani Willis has indicated she plans\u2062 to bring \u2062 <strong>charges<\/strong> in that case within the next three weeks.<\/p>\n<p>Special counsels are sometimes appointed to investigate politically sensitive cases, \u2064and they do their jobs with a degree of independence from the Justice Department leadership.<\/p>\n<p>Before\u200b being appointed by Garland to take over the \u200ctwo <strong>Trump<\/strong>-related investigations, Smith had served as the chief prosecutor for the \u200dspecial court in The Hague, assigned to prosecuting \u2063war crimes in Kosovo, oversaw the Justice Department&#8217;s public integrity \u2062section, and\u2063 worked as a <strong>federal<\/strong> and state prosecutor in New York.<\/p>\n<p>(Reporting by Jacqueline Thomsen and Sarah N.
