That\u200d includes Trump, who\u2063 has said repeatedly (and recently) that the 2020 election was stolen. He\u2019ll probably keep saying it until his dying day, <em>and he has every \u2063right to do so<\/em>.<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1771946829\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-302116c46d7ccf345f27678890bdae44 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-302116c46d7ccf345f27678890bdae44\"><\/div>\n<p>The idea that\u200b our Justice Department \u200dcan indict someone, \u2062especially the \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-last-time-inflation-was-this-high\/\" title=\"The Last Time Inflation Was This High\">sitting president\u2019<\/a>s main\u200d political rival, over speech that\u2019s protected by the First \u2064Amendment is simply insane. It\u2062 puts us firmly into \u200cbanana\u2062 republic territory, where tinpot dictators\u2063 jail their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-enlists-nuclear-disarmament-proponents-to-study-icbm-alternatives\/\" title=\"Biden Enlists Nuclear Disarmament Proponents To Study ICBM Alternatives\">political opponents ahead<\/a> of election day to \u200bensure \u2063their \u201creelection.\u201d<\/p>\n<p>Simply put,\u2064 this indictment is nothing\u200b more than a declaration \u200cof war against American voters \u2062and\u2062 their constitutional right \u200bto free\u2062 speech. As <\/p>\n<h3>Jonathan Turley<\/h3>\n<p> <a href=\"https:\/\/threadreaderapp.com\/thread\/1686502727717666816.html\" target=\"_blank\" rel=\"noreferrer noopener\">noted on Twitter<\/a>, \u201cIf you \u2064take a \u2063red pen to all of the material presumptively protected by the \u2062First Amendment,\u200d you can reduce much of the indictment to\u2062 haiku.\u201d<\/p>\n<p>Consider \u200bwhat\u2019s alleged, and what isn\u2019t, \u2062by DOJ \u2063Special Counsel \u2062Jack Smith (who, let\u2019s not\u200c forget, was once\u200d rebuked by \u200da unanimous Supreme Court after he <a href=\"https:\/\/www.reuters.com\/article\/us-usa-court-mcdonnell-idUSKCN0ZD1XS\" target=\"_blank\" rel=\"noreferrer noopener\">tried\u200b to put a GOP governor in prison<\/a> during the Obama administration). The charges against\u2063 Trump \u2062do <em>not<\/em> include incitement to \u200cviolence on Jan. 6, 2021. You might\u2063 be surprised\u2063 to hear that\u2062 after Smith\u2019s\u2062 hyperbolic press conference Tuesday, in which he went on and on \u2064about the Jan. \u20646 Capitol riot and how horrible it was.<\/p>\n<p>Instead, the charges are that Trump committed \u200dconspiracy to obstruct an official proceeding, obstruction of and an\u200b attempt to \u200dobstruct an official proceeding, and conspiracy against rights. Sounds scary, but\u2062 what it amounts \u2062to is the criminalization of opinions \u2063with\u2064 which\u200c Jack Smith \u200dand the Biden\u2064 Justice Department \u2062happen to disagree. <\/p>\n<div class=\"fdrlst__b89e9-90e2a5123a538da40e704eef12fdc404 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-90e2a5123a538da40e704eef12fdc404\"><\/div>\n<p>Crucially, Smith\u2019s indictment alleges that Trump\u2019s claims about the 2020 election were false and that <em>he knew they were false<\/em>. As evidence, Smith cites a bunch of Trump officials and federal bureaucracies \u2062that told him there was \u2064no evidence \u2063of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/youtube-bans-trumps-full-cpac-speech-unless-users-add-countervailing-viewpoints-about-election-claims\/\" title=\"YouTube Bans Trump\u2019s Full CPAC Speech Unless Users Add \u2018Countervailing Viewpoints\u2019 About Election Claims\u00a0\">widespread election fraud<\/a>. He even cites the infamous Department of Homeland Security\u2019s Cybersecurity and\u200c Infrastructure Security Agency, which we now know, <a href=\"https:\/\/thefederalist.com\/2022\/12\/19\/6-huge-takeaways-from-the-sixth-dump-of-twitter-files\/\" target=\"_blank\" rel=\"noreferrer noopener\">thanks to the \u201cTwitter Files,\u201d<\/a> directly \u200cinterfered in the\u200d 2020 election by censoring Americans by proxy. <\/p>\n<p>Yet despite the likes of CISA telling him otherwise, Trump kept claiming the\u2063 election was stolen, so he must have been \u2064lying. Or so goes the reasoning here.<\/p>\n<p>I know, I know. You\u2019re probably \u200dthinking this can\u2019t be \u2064real, \u2062that no one would be so stupid as to hang charges on \u2062the \u2063idea that Trump secretly believed he\u2019d lost the election because a bunch of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/doj-indictment-of-trump-is-a-declaration-of-war-against-american-voters\/\" title=\"DOJ's Trump Indictment: A War on American Voters\">deep-state\u200c officials told<\/a>\u2063 him so, but\u200c lied about it in hopes \u200dof\u2064 pulling off a grand \u201cconspiracy.\u201d<\/p>\n<p>But it doesn\u2019t matter. Whether Trump knew he lost the \u2063election and lied \u2064about it\u2062 is a political matter, not a legal one. \u200cIt\u2019s precisely the kind of thing that can only be settled by voters, not by DOJ thugs in the Biden \u2062administration. <\/p>\n<div class=\"fdrlst__b89e9-cb60c5ad0533e254fbeb9ee101f63af9 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-cb60c5ad0533e254fbeb9ee101f63af9\"><\/div>\n<p>Think of it this way. \u200dIf Smith can\u200c indict \u200dTrump for speaking \u200cout about the election, for arguing that it was stolen or rigged, then \u200drest assured the DOJ under\u200b Biden could indict every\u2064 one \u2062of the millions of Americans who agree with Trump about 2020\u2064 and \u2063have said so \u200dpublicly. Hell, Smith could probably\u2064 indict me for writing\u2064 this article (and especially <a href=\"https:\/\/thefederalist.com\/2020\/11\/16\/republicans-have-good-reason-not-to-trust-the-election-results\/\" target=\"_blank\" rel=\"noreferrer noopener\">this one<\/a>).<\/p>\n<p>Forget about Trump for a minute. This indictment sets a terrifying precedent that puts all Americans \u200dat \u2064risk. \u200dIf the prosecution of Trump succeeds, it means the First Amendment is a dead letter in America. It means\u200b you\u2019re not allowed \u2063to have opinions that contradict the Justice Department\u2019s official narrative \u2064\u2014 and if you do, you\u2019d better not have the \u2064temerity to run for\u2062 high office.<\/p>\n<p>Seen in that light, this \u2063latest indictment\u2062 of Trump \u2014 who \u200bhas now been charged with <a href=\"https:\/\/www.pbs.org\/newshour\/politics\/trump-has-been-indicted-for-a-3rd-time-heres-where-all-the-investigations-stand\" target=\"_blank\" rel=\"noreferrer noopener\">more than 75 crimes<\/a>, many of them by the Biden DOJ\u200d \u2014 is an exercise\u200d in raw power. It\u2019s \u200cnot \u2064that Democrats are playing some kind of 4D chess in hopes of\u2062 ginning \u2064up \u2064support for Trump among the base to ensure he\u2019s the \u200bnominee because \u2063they think they can beat him\u200c in the\u2063 general election.<\/p>\n<p>No, they just want to put him in prison. They think Trump\u2019s a criminal for opposing them, and they think the same\u2064 thing\u2062 about his supporters. The left wants to criminalize dissent.\u200d They\u200c don\u2019t really \u200cthink you should get a vote, much less an opinion. That\u2019s what this indictment\u200d is about.
