This \u2062law creates a 100-foot buffer zone around abortion clinics, prohibiting protesters and sidewalk counselors from being \u2063within 8 feet of anyone in\u2063 the buffer zone.<\/p>\n<p>The proposed amendment \u2063would not completely repeal the law, but rather remove the 8-feet provision. According to board \u200bdocuments, the legislators believe this provision is &#8220;difficult\u200b to enforce&#8221; and unnecessary for ensuring access to abortion clinics.<\/p>\n<p>This reconsideration comes after the 2nd Circuit Court of Appeals recently ruled that the \u200cbuffer zone was constitutional, citing a precedent \u2063set by the U.S. Supreme Court in Hill \u200cv. Colorado. \u200cIn that case, the court upheld a nearly identical ordinance in 2000.<\/p>\n<p>However, the litigants in the current case are now appealing to the Supreme Court, hoping \u2063to overturn the Colorado precedent. Joe Davis, \u2062a counsel for the Becket Fund for Religious Liberty, a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/westchester-new-york-scrambles-to-update-abortion-clinic-law-afraid-of-the-supreme-court\/\" title=\"Westchester, NY rushes to revise abortion clinic law amid Supreme Court fears.\">nonprofit\u200d legal \u2063organization representing<\/a> the plaintiffs, claims that the county board is attempting \u200bto amend the law out of fear that the Supreme Court will take the case and\u200b establish a \u2063new national precedent.<\/p>\n<blockquote><p>&#8220;The county is afraid of our lawsuit and afraid of the Supreme Court,&#8221; Davis stated in an interview\u200d with the Washington \u200bExaminer.\u2064 &#8220;They know that this law is about \u2062to be struck down and Hill v. Colorado is about to be overruled when this \u200bcase gets back to the court.&#8221;<\/p><\/blockquote>\n<p>Davis believes that \u2064the county&#8217;s efforts, supported\u200b by local Planned Parenthood, are a \u2063&#8221;desperate gambit&#8221; to prevent the overturning\u200c of\u2063 the Colorado precedent. However,\u2062 he \u2064predicts that their \u2063attempt will\u2063 be unsuccessful.<\/p>\n<blockquote><p>&#8220;It shouldn&#8217;t work, and it likely won&#8217;t work,&#8221; the \u200battorney said. &#8220;And that&#8217;s because they\u200c spent the \u2064last year enforcing this law, stopping people from engaging \u2064with sidewalk counselors, and you can&#8217;t just erase all that \u2062at the last minute.\u200c And for\u200c another thing, as soon\u200b as the case goes away, they could just turn around and reenact the same\u200c law.&#8221;<\/p><\/blockquote>\n<p>The Becket Fund attorney believes that the legislators in Westchester are considering \u2063the national implications and\u200d do not want to be the case that overturns the existing precedent.<\/p>\n<blockquote><p>&#8220;It really only underscores that everybody knows these kinds of laws \u200dare unconstitutional and that it&#8217;s time for the court to \u200dstep in and make that official,&#8221; Davis concluded.<\/p><\/blockquote>\n<p>Planned Parenthood \u2062did not respond to a\u200c request\u2064 for comment.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>A New York county may change a law creating a 100-foot buffer zone outside abortion clinics, coinciding with the U.S. Supreme Court&#8217;s decision on whether to hear a case questioning its constitutionality.
