Version: 4.0.47--><h2>Judge Hands Trump a Win, Says Stolen Election Claims Protected by Presidential Immunity<\/h2>\n<p>A Pennsylvania state judge ruled Monday that a county election\u200d worker cannot sue\u2064 former President Donald Trump for statements he made\u200d while in office questioning the integrity of the 2020 election.<\/p>\n<p>James Savage, a\u200c voting machine supervisor in Delaware County, Pennsylvania, outside of Philadelphia, filed two <a href=\"https:\/\/www.documentcloud.org\/documents\/21098745-savage-v-trump-et-al\" target=\"_blank\" rel=\"noopener\">lawsuits<\/a> against Trump\u2063 arguing statements Trump made \u2063via Twitter in November 2020 regarding\u200d the election\u2019s integrity defamed him and\u200d subjected him to \u201chatred\u201d \u2063and death threats, \u200dresulting in him experiencing two heart attacks.<\/p>\n<p>Trump\u200d made\u2062 the statements during a GOP-led Pennsylvania\u2062 State Senate Majority\u2064 Policy\u2064 Committee in Gettysburg reviewing claims of election\u2063 fraud.<\/p>\n<p>Savage alleged that Trump,\u200c his personal attorney <a href=\"https:\/\/www.westernjournal.com\/new-york-issues-punishment-rudy-giuliani-false-misleading-statements-election\/\" target=\"_blank\" rel=\"noopener\">Rudy Giuliani<\/a>, two Delaware County poll watchers, and others \u201cconspired\u2064 to defame him and place him\u200d in \u2062a false light by publicly\u200d and falsely claiming that he\u200d tampered with the 2020 Presidential election results,\u201d according to <a href=\"https:\/\/www.breitbart.com\/politics\/2023\/07\/31\/judge-grants-donald-trump-immunity-pennsylvania-election-workers-lawsuit\/\" target=\"_blank\" rel=\"noopener\">Breitbart<\/a>.<\/p>\n<blockquote>\n<p>\u201cA Nov. 27, 2020, Trump tweet \u200cthat was referenced in the suit made claims of missing USB\u2063 drives \u200band tens of thousands of votes uploaded for\u200b [Democrat Joe] Biden,\u201d the news \u2062outlet said.<\/p>\n<\/blockquote>\n<p>Savage\u2019s legal complaint asserts that\u200b Trump and the other \u200bdefendants in the suit \u201cactively and maliciously disseminated the facially absurd claim that Plaintiff individually somehow changed the vote \u200ctabulation by uploading 50,000 votes for Joe Biden from suspiciously collected \u2063USB v-cards.\u201d<\/p>\n<p>\u201cThe Defendants knew that\u200d what\u2064 they were \u2062describing\u2064 was\u2062 an absolute impossibility, namely because Mr. Savage was not trained\u200d to use the \u2062software that uploads data from the USB\u200b v-cards.\u201d<\/p>\n<h3>Presidential Immunity Protects \u2063Trump&#8217;s Statements<\/h3>\n<p>Philadelphia County\u2062 Court of Common \u200dPleas Judge Michael Erdos ruled Monday \u2062that <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-kyle-rittenhouse-could-sue-media-outlets-for-defamation\/\" title=\"Report: Kyle Rittenhouse Could Sue Media Outlets for Defamation\">presidential immunity<\/a> covers Trump\u2019s statements.<\/p>\n<blockquote>\n<p>\u201cHere, then-President Trump\u2019s Gettysburg remarks \u2063and his\u200b tweet were public,\u201d Erdos wrote, \u2063according to\u2063 <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4130582-judge-rules-trump-false-election-claims-while-in-office-covered-by-presidential-immunity\/\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<\/blockquote>\n<p>\u201cMoreover, \u200bthe\u2063 topic of these statements \u2014 claims from third parties and the President himself about irregularities in the Presidential election which on\u200d their face called \u200cinto question\u200d the integrity of the election and whether now-President Joseph Biden had been duly elected \u2014\u2062 was \u2064undoubtedly a matter of\u200d great public \u2062concern,\u201d the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-scores-win-on-first-amendment-grounds-in-case-over-fake-news-meme\/\" title=\"Trump Scores Win On First Amendment Grounds In Case Over \u2018Fake News\u2019 Meme\">judge continued<\/a>.<\/p>\n<p>\u201cOther legal proceedings may examine the propriety of\u2063 his \u2062statements and actions while he was the President and\u2064 whether, as the \u2064plaintiffs in this and other cases contend, it was this conduct which served\u2062 as the\u2062 actual threat \u200dto our democracy,\u201d Erdos \u200cfurther\u200b wrote. \u201cBut this case\u200b is not the proper place to do so. Here, Trump is entitled \u200bto\u200c Presidential immunity.\u201d<\/p>\n<p>While presidential\u200d immunity is\u2063 not directly addressed in the Constitution, the doctrine has developed over time through \u200cSupreme \u2062Court rulings concerning <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-hands-trump-a-win-says-stolen-election-claims-protected-by-presidential-immunity\/\" title=\"Judge rules in favor of Trump, says stolen election claims protected by presidential immunity.\">constitutionally granted executive authority<\/a>, according to \u2064 <a href=\"https:\/\/constitution.findlaw.com\/article2\/article-ii--presidential-immunity-to-criminal-and-civil-suits.html\" target=\"_blank\" rel=\"noopener\">FindLaw<\/a>.<\/p>\n<p>Under the doctrine, the president is\u2062 immune from civil liability from \u2063suits arising from actions related to his official duties.<\/p>\n<p>Savage \u200dalso sued Trump for a <a href=\"https:\/\/thehill.com\/policy\/national-security\/3688097-trump-skirts-testimony-question-in-blistering-14-page-jan-6-response\/\" target=\"_blank\" rel=\"noopener\">letter<\/a> he submitted to the House Jan. \u200d6 Committee in October 2022.<\/p>\n<p>\u201cTrump\u2063 is \u2062not \u2063immune from as it was written after leaving office,\u201d The Hill \u200dreported.<\/p>\n<p>The 45th \u200bpresident\u2019s legal \u200cspokeswoman <a href=\"https:\/\/www.westernjournal.com\/trumps-lawyer-reveals-advice-given-plea-deal-docs-case\/\" target=\"_blank\" rel=\"noopener\">Alina\u200d Habba<\/a> \u200b responded to Erdos\u2019 ruling with a statement \u200cMonday.<\/p>\n<p>\u201cWe are pleased with the Court\u2019s decision \u200dto honor the \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/another-international-sport-bans-biologically-male-trans-athletes-from-competing-against-women\/\" title=\"Another International Sport Bans Biologically Male Trans Athletes From Competing Against Women\">long-standing principle<\/a> of Presidential Immunity,\u201d she said.<\/p>\n<p>\u201cToday, the Court made it \u2064clear\u2064 that it is well within the President\u2019s\u2063 discretion to address the integrity \u2063of our election without fear of liability,\u201d Habba\u200b continued. \u201cWe expect that the rest of Mr. Savage\u2019s\u2063 claims will similarly be disposed of as they are without merit.\u201d<\/p>\n<p>Trump wrote in a Truth Social post that he is anticipating\u200c being indicted by special counsel <a href=\"https:\/\/www.westernjournal.com\/trump-responds-special-counsel-jack-smith-hits-new-charges-says-way-general-election\/\" target=\"_blank\" rel=\"noopener\">Jack Smith<\/a> soon for statements he made in a speech on Jan.\u2062 6 questioning\u2063 the integrity of\u200c the 2020 election.<\/p>\n<p>\u201cI assume \u200bthat\u200d an Indictment from Deranged Jack\u200d Smith and his\u200c <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/trump-jan-6-indictment-could-be-forthcoming-as-former-president-renews-warnings\/\" title=\"Possible indictment for Trump on Jan. 6 as ex-president issues renewed warnings.\">highly partisan gang<\/a> of Thugs, pertaining to my\u200d \u201cPEACEFULLY &#038; PATRIOTICALLY Speech, will be coming out \u200dany day now, as yet another attempt\u200b to cover up all of the bad news about bribes, payoffs,\u200b and extortion, coming from the Biden \u2018camp,&#8217;\u201d he wrote.<\/p>\n<p>\u201cThis\u2063 seems to be the way they do it.
