A judge has granted an emergency request, allowing them to refer patients out-of-state for abortion \u2062access without \u200cfear of prosecution. U.S. District Judge B. Lynn Winmill placed an injunction on \u2063Idaho Attorney General Raul\u2064 Labrador&#8217;s office, protecting \u2062doctors who make these referrals and ruling that the\u2064 restriction infringes on their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/states-push-to-rein-in-big-tech-as-federal-gears-grind-slow\/\" title=\"States Push to Rein in Big Tech as Federal Gears Grind Slow\">free speech rights<\/a>.<\/p>\n<h3>Protecting Healthcare Providers&#8217; Rights<\/h3>\n<p>The injunction, filed on Monday, specifically applies to Labrador, who previously stated that doctors who <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/idaho-attorney-general-cannot-prosecute-out-of-state-abortion-referrals-judge\/\" title=\"Idaho judge rules out-of-state abortion referrals beyond attorney general's jurisdiction.\">provide abortion\u200b pills<\/a> or refer patients across state lines could face prosecution. This restriction came into effect\u2063 after the end of Roe \u200bv. Wade triggered Idaho&#8217;s \u200cnear<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/all-lives-matter-arkansas-gov-signs-near-total-abortion-ban-that-supporters-hope-will-force-scotus-to-revisit-roe-v-wade\/\" title=\"\u2018All Lives Matter\u2019: Arkansas Gov. However, exceptions for cases of rape, incest, and the life\u2064 of the\u2063 mother were included.<\/p>\n<p>Planned Parenthood Great Northwest, along \u200bwith\u200c two Idaho \u2062physicians, Caitlin Gustafson and Darin Weyhrich, filed a\u2062 lawsuit against Labrador, the Idaho State Board of Medicine, and \u2063other defendants in April. They argued that prosecuting doctors for referrals violated their First Amendment rights, due process laws, and the commerce clause.<\/p>\n<h3>Ensuring Access\u2063 to Care<\/h3>\n<p>Typically, medical professionals in Idaho refer patients to neighboring states such as Washington, Oregon, and Montana, where abortion remains legal. Violating Idaho&#8217;s abortion law can \u200cresult\u200b in the suspension or revocation of a healthcare provider&#8217;s license, as well as a prison sentence \u2064of two \u200bto five years.<\/p>\n<p>However, while the case is ongoing, Labrador&#8217;s \u200doffice is prohibited from bringing\u200c any charges against Idaho medical providers for\u2064 referring patients for \u200dabortion access, as ruled by Judge Winmill.<\/p>\n<h2>Standing Up for Patients&#8217; Rights<\/h2>\n<p>Rebecca Gibron, CEO \u2063of Planned Parenthood Great Northwest, expressed relief at\u2063 the\u2063 outcome, but emphasized that it should never have reached this point. She \u200dstated, &#8220;In case there\u2019s any doubt: Planned Parenthood will not quietly let rights get sloppily stripped one \u200cby one until there\u2019s nothing left. We will fight for Idaho patients every step of the way.&#8221;<\/p>\n<p>Labrador initially wrote the legal opinion \u2064in March at the request of Republican \u200bstate \u200dRep. Brent Crane, on behalf of Idaho anti-abortion clinic Stanton Healthcare.
