The hearing, however, did not \u200bgo\u200d as \u2063planned when Judge \u2062Noreika, rather than rubberstamping the sweetheart deal the Biden administration had entered into with the president\u2019s son,\u200d quizzed the attorneys and Hunter Biden on the terms of the\u200d agreement and their respective understanding\u2063 of\u200d the government\u2019s promise not to further prosecute Hunter. <\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-1738466825\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-e782358b86f483f28ef9e0149d500623 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-e782358b86f483f28ef9e0149d500623\"><\/div>\n<p>When Noreika questioned Hunter Biden about the $1 million Patrick Ho paid Owasco LLC on March 22, 2018, \u2062purportedly\u200c for\u200b legal representation, the president\u2019s\u200b son was\u200c cornered. With the government and the defendant both telling\u2064 the court that money \u2064represented fees for legal services, Hunter Biden had to explain how: \u201cI think\u2062 Owasco PC acted as a law firm entity, yeah.\u201d That\u2019s how Hunter replied initially, but\u2064 then immediately equivocated: \u201cI \u2063believe that\u2019s the case, but \u200dI don\u2019t know that for a fact.\u201d <\/p>\n<p>Hunter\u2019s hedge\u2062 was a tell that what he had \u2063just told the court was not the truth. But it \u200bwas\u2064 imperative that the president\u2019s son caveat his prior statement that his law firm \u2062entity\u200b was retained to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/virginia-based-voter-suppression-group-paid-thousands-to-voting-rights-champion-marc-elias\/\" title=\"Virginia-Based Voter Suppression Group Paid Thousands to Voting Rights \u2018Champion\u2019 Marc Elias\">provide legal services<\/a> for Ho \u2064because the judge had made clear that Hunter\u200b Biden was under oath and that \u201cany false answers may be used \u200cagainst [him] \u200b in a separate prosecution for perjury.\u201d<\/p>\n<p>While Hunter\u2019s backtracking may have saved his\u2064 backside from a perjury conviction, it may well blow up his plea deal because it highlighted that the\u2063 \u201cStatement of Facts\u201d the \u200bgovernment incorporated into the plea\u200d agreement contained a near-certain false \u2064representation: that \u2063the $1 million Patrick Ho transferred to Hunter\u2064 Biden was \u201cpayment for\u200c legal fees.\u201d<\/p>\n<h2 class=\"wp-block-heading\">Statement of Facts?<\/h2>\n<p>While the government did not file the plea agreement or the exhibits incorporated into that deal\u200c on the\u2063 public docket, during last week\u2019s hearing\u200c the prosecutor and \u200bthe court read excerpts on the record. Among \u200dother things,\u2064 in the plea \u2064agreement, Hunter Biden \u201cadmits to the information contained in the Statement \u2064of Facts,\u201d which was\u200d attached as \u2064Exhibit\u200c 1. And the Statement of Facts, as read by\u2064 the prosecution, declared: <\/p>\n<div class=\"fdrlst__b89e9-c1892d01fd94c050aa4f7b8350319399 fdrlst__b89e9-paragraph-6\" id=\"fdrlst__b89e9-c1892d01fd94c050aa4f7b8350319399\"><\/div>\n<blockquote class=\"wp-block-quote\">\n<p>On or about March 22, 2018, Biden received \u2064a \u200c$1 million payment into his Owasco, LLC bank account as payment for legal fees\u200d for Patrick Ho, and $939,000 \u200cremained available as of \u200ctax day. \u2063Over the \u200dnext six months Biden would spend almost the entirety of this balance on personal expenses, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/are-the-doj-and-hunter-biden-attempting-to-commit-fraud-in-federal-court\/\" title=\"Is DOJ and Hunter Biden plotting federal court fraud?\">including\u200c large cash \u200bwithdrawals<\/a>, transfers to his personal account, travel, and\u200b entertainment.<\/p>\n<\/blockquote>\n<p>After commenting that\u200c having \u200dthe U.S. \u2063attorney\u2019s office read the Statement of Facts \u201cinto the \u2064record\u201d \u201cis \u200bnot common in my experience,\u201d Judge \u2063Noreika proceeded to question Hunter Biden on the facts to which\u200b he was admitting, engaging in this <a href=\"https:\/\/media.marcopolousa.org\/pdf\/20230726hearingtranscript.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">colloquy<\/a>: <\/p>\n<p><strong>COURT:<\/strong> All right. In the third paragraph, which\u2062 is actually the second full paragraph, it \u200csays on or about March 22, 2018, you received a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-says-illegal-border-crossers-separated-from-families-by-trump-deserve-compensation\/\" title=\"Biden says illegal border crossers separated from families by Trump deserve compensation\">million-dollar payment<\/a> into your \u2062Owasco \u200bbank\u200b account as payment for \u200clegal fees \u200dfor Patrick Ho. <\/p>\n<p><strong>DEFENDANT:<\/strong> \u2063 Yes, Your\u200c Honor. <\/p>\n<p><strong>COURT:<\/strong> Who is that payment received from, was that the law firm? <\/p>\n<div class=\"fdrlst__b89e9-368d39115febf41397522cd0195e6763 fdrlst__b89e9-paragraph-10\" id=\"fdrlst__b89e9-368d39115febf41397522cd0195e6763\"><\/div>\n<p><strong>DEFENDANT:<\/strong> Received from Patrick Ho,\u2062 Your\u200b Honor. <\/p>\n<p><strong>COURT:<\/strong> Mr.\u200c Ho himself? <\/p>\n<p><strong>DEFENDANT:<\/strong> Yes. <\/p>\n<p><strong>COURT:<\/strong> \u2063Were \u2064you doing legal work for him separate and apart from the \u200claw firm? <\/p>\n<p><strong>DEFENDANT:<\/strong> Yes, Your Honor. Well \u2014 <\/p>\n<p><strong>MR. CLARK:<\/strong> That\u2062 wasn\u2019t through Boies Schiller, Your Honor, Mr. Biden\u2063 was engaged as an attorney. <\/p>\n<p><strong>COURT:<\/strong> Right. So that\u2019s why I asked. You were doing work for him \u2014 <\/p>\n<p><strong>DEFENDANT:<\/strong> My own law firm, not as counsel. <\/p>\n<p><strong>COURT:<\/strong> So \u2062you had your own law\u200d firm as well? <\/p>\n<p><strong>DEFENDANT:<\/strong> I think Owasco PC acted as a law firm entity, yeah. <\/p>\n<p><strong>COURT:<\/strong> OK. <\/p>\n<p><strong>DEFENDANT:<\/strong> \u2063I believe that\u2019s the case, but I don\u2019t know that for a fact.<\/p>\n<p>The court then moved on to the next\u200d section of the Statement of Facts, and the hearing continued. It shouldn\u2019t have, however. Rather, Judge\u200c Noreika \u200cshould have questioned Hunter Biden more fully to ensure the representation \u2063attested to by both \u200dthe government and the defendant and incorporated into the \u200cplea\u200b agreement\u2063 \u2014 that Ho paid Hunter $1 million \u200cas payments for\u2064 legal\u200d fees \u2014 \u200dwas true. For \u2064the overwhelming evidence \u2064indicates\u2062 that was a \u2063lie \u200band that the money, at best, represented payment for \u200cinfluence peddling and, at worst,\u2062 was\u200d a\u200c bribe.<\/p>\n<h2 class=\"wp-block-heading\">Doesn\u2019t Add Up<\/h2>\n<p>Of course, President Biden\u2019s DOJ didn\u2019t tell that \u200cto Judge Noreika nor provide her any evidence related to the $1\u200d million payment. Instead, the DOJ declared the payment was \u2064for\u2062 \u201clegal fees,\u201d and Hunter\u2019s\u200c legal team\u2063 enthusiastically nodded. But that\u2019s not what the \u2063evidence indicates.<\/p>\n<p>First, there\u2019s\u200c the problem that the $1 million payment on March 22, 2018, was made not to Hunter Biden\u2019s law firm, Owasco PC, but to Owasco LLC. And if you are going to pay $1 million for legal representation, you kinda want to pay the law firm supposedly providing those services. <\/p>\n<p>Second, according to Delaware corporate records, Owasco LLC didn\u2019t \u200beven exist at the time of the March 22, 2018, payment, with\u2064 its date of incorporation <a href=\"https:\/\/opencorporates.com\/companies\/us_pa\/6786461\" target=\"_blank\" rel=\"noreferrer noopener\">listed<\/a> as Oct. 18, 2018. <\/p>\n<p>Third, \u200bnot only did Ho not pay Hunter\u2019s law firm, Owasco PC, Ho didn\u2019t even pay Owasco LLC \u2014 something you\u2063 could possibly chalk up to confusion of the business entities, although since Owasco LLC \u2063didn\u2019t exist at the time, that would still be inexplicable. <\/p>\n<p>Rather, Ho paid Hudson West III\u2063 LLC $1 million on Nov. \u20642, 2017 \u2064\u2014 mere weeks before federal prosecutors charged Ho with bribing foreign officials to advantage\u200d the Chinese \u2064communist energy company CEFC. Then on\u200d March 22, 2018, Hudson West III LLC transferred that $1 \u2064million to Owasco LLC \u2063with a <a href=\"https:\/\/www.grassley.senate.gov\/news\/remarks\/grassley-johnson-release-bank-records-tying-biden-family-to-ccp-linked-individuals-and-companies\" target=\"_blank\" rel=\"noreferrer noopener\">notation<\/a> that\u2063 it was for \u201cDr\u2062 Patrick Ho Chi Ping Representation.\u201d <\/p>\n<p>According to a U.S. Senate Committee on\u2062 Homeland Security and \u200dGovernmental Affairs finance <a href=\"https:\/\/www.hsgac.senate.gov\/wp-content\/uploads\/imo\/media\/doc\/HSGAC_Finance_Report_FINAL.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">report<\/a>, Hunter \u201cBiden stated\u200b that the incoming wire amounting to $1MM on 11\/2\/2017 from CEFC Limited\u2062 foundation should have gone to\u200c Owasco LLC, however, he provided the wrong wire instructions, and due to the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mi-judge-orders-dem-sec-of-state-to-release-all-communications-with-dominion-facebook-apple-amazon-and-google\/\" title=\"MI Judge Orders Dem Sec of State To Release All Communications With Dominion, Facebook, Apple, Amazon and Google\">large amount<\/a>\u200d the transaction\u200d was not corrected until 3\/22\/2018, which\u200b consisted of an outgoing wire for the same amount benefiting Owasco LLC.\u201d <\/p>\n<p>The Senate report further explained that Biden had stated that \u201cBoies Schiller\u200c Flexner is co-counsel for Dr.\u2064 Patrick Ho\u2019s case. Hudson West III LLC has no involvement with Patrick Ho Chi Ping[\u2019s] case and won[\u2019t] expect further transaction related to\u200b Dr. Patrick Ho Chi Ping trail [sic] for Hudson West III LLC. \u200bOwasco LLC\u200c and co-Counsel Boies Schiller Flexner will represent Dr. Patrick Ho \u2064Chi Ping [at] \u200ctrial.\u201d<\/p>\n<p>But again, Owasco LLC \u2064was <em>not<\/em> Hunter Biden\u2019s law firm; Owasco PC was. And even in hedging to the court last week, Hunter Biden claimed, \u201cOwasco PC acted \u2064as a law firm entity.\u201d<\/p>\n<p>Saying he made a mistake during last \u200bweek\u2019s \u2063plea hearing and that it \u2062was actually Owasco \u200dLLC that \u200cacted as the law firm, however, won\u2019t extricate Hunter Biden from the mess. Again, Owasco LLC <em>did not exist<\/em> at the time, and as the president\u2019s son stated \u2064in response to the court\u2019s question of whether he was \u201cdoing work for [Ho]\u201d: \u201cMy own law firm, \u200bnot as counsel.\u201d <\/p>\n<p>So who\u2063 was part of Hunter Biden\u2019s Owasco LLC nonexistent law firm at the time, if Hunter\u2064 did not \u200cserve as counsel? And how did Owasco LLC\u2062 pay\u2064 its lawyers given that the\u200c government said over the\u2063 next six months Biden would spend almost the entirety of the $1 million \u201con personal expenses, including large cash withdrawals, transfers to his \u2062personal account, travel, and entertainment?\u201d<\/p>\n<p>Then there is the Attorney Engagement Letter\u2063 reportedly <a href=\"https:\/\/nypost.com\/2022\/10\/07\/the-laptop-evidence-fbi-could-use-to-charge-hunter-biden\/\" target=\"_blank\" rel=\"noreferrer noopener\">recovered<\/a> from Hunter Biden\u2019s laptop, dated September 2017, between Patrick Ho and Hunter Biden, which provided for a $1 million retainer for legal representation. Significantly, this agreement was not entered into between Ho and any of \u200dthe Owasco <a href=\"https:\/\/twitter.com\/ProfMJCleveland\/status\/1685072955372429312\/photo\/1\">entities<\/a>, formed or \u200bcreated after\u2064 the fact, but with Hunter Biden personally. Yet on Wednesday, Biden told Judge Noreika his law firm \u2062was doing the work for Ho. But what law firm that was, Biden seemed not to know.<\/p>\n<p>Of course, Hunter didn\u2019t know because no\u200b \u201clegal\u201d representation was provided to Ho \u2064and none was expected. Yet that\u2019s precisely what the government and Hunter Biden represent as true in the Statement of Facts, and they may have gotten away with the \u2064deception had Judge Noreika accepted the plea agreement \u2062without question. But she didn\u2019t. <\/p>\n<p>Instead, the judge asked the parties to brief the issue of whether\u200b the\u2063 government could include its promise not to \u2064prosecute\u2062 Hunter Biden for other crimes in a side\u2063 diversion agreement, stressing she needed to make sure\u2064 the plea \u2063agreement got Hunter Biden what he \u2062believed it got him, but also to make\u200c \u201csure \u2064that I do justice as\u200b I\u2019m required to do in\u2062 this court.\u201d<\/p>\n<p>There\u200c will \u200bbe no justice, however, if the court \u2062allows the government and \u2064Hunter \u2063Biden to pretend\u2064 the $1 million payment from Ho was for legal representation. At the next hearing, Judge Noreika must\u2064 question both Hunter Biden and the\u200d government on \u200dthis representation \u2014 because if it is false, \u2064as the \u2062overwhelming\u200c evidence indicates, it would be a fraud on the \u2064court and the country to accept the plea \u2064agreement.<\/p>\n<p>In advance of that hearing, the House of Representatives should \u2063consider \u2062filing a supplemental brief detailing the above \u2062evidence because the\u200d U.S. attorney\u2019s office has \u200bproven itself unwilling to \u200bprovide an honest assessment of\u2063 the evidence to \u2063the court.
