The impasse often seen in partisan politics, paired with the vast \u200demergency\u200b powers <a href=\"https:\/\/reason.com\/2022\/09\/09\/after-975-days-washingtons-governor-will-finally-relinquish-his-emergency-pandemic-powers\/\" target=\"_blank\" rel=\"noreferrer noopener\">leveraged during Covid<\/a>, has resulted in an <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/ending-administrative-state-uphill-necessary-battle-free-nation\/?fbclid=IwAR1sPGfFEySWXbNoXCHDkQF0dBgzj3MuJOk2h3-TUkYRkNlFLa8dglyn8Fk\" target=\"_blank\" rel=\"noreferrer noopener\">increasing<\/a> number of directives being issued\u2062 by unelected anonymous agency personnel rather than our elected \u200brepresentatives.<\/p>\n<p>Those who believe the premise\u2062 that legislation is the sole domain of the legislative branch are poised for a \u2062<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/real-wages-are-in-decline\/\" title=\"Real Wages Are in Decline\">harsh reality check<\/a>. Perhaps\u200d it\u2019s \u2062high time\u2063 we\u200b revise \u2064\u201cSchoolhouse\u2062 Rock\u2019s\u201d \u201cI\u2019m Just a Bill\u201d to the more truthful, albeit considerably less memorable, \u201cI\u2019m Just a Regulatory\u200b Mandate.\u201d<\/p>\n<blockquote>\n<p>If you look closely, however,\u200d a glimmer of hope is faintly shining through the cracks as the administrative state faces\u200b its most significant\u200b opposition \u200cin decades. Without a doubt, the \u200badministrative state is a formidable foe, and one should\u2063 certainly temper his enthusiasm. Nevertheless, there is room for cautious optimism as a three-pronged attack,\u200c one from each branch of government, is\u200b emerging against the reign of bureaucratic supremacy.<\/p>\n<\/blockquote>\n<h3 class=\"wp-block-heading\">Judicial Branch<\/h3>\n<p>The judicial branch shows the most promise, of course, as the\u200c Supreme Court \u2064has <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-454_4g15.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">delivered serious blows \u2063with recent opinions<\/a> \u2014 and is poised\u200d to significantly rein in <em><a href=\"https:\/\/thefederalist.com\/2023\/07\/26\/republican-lawmakers-call-on-scotus-to-rein-in-the-administrative-state\/\" target=\"_blank\" rel=\"noreferrer noopener\">Chevron<\/a><\/em> deference.<\/p>\n<p>Last year, in <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\" target=\"_blank\" rel=\"noreferrer noopener\"><em>West\u2062 Virginia v. EPA<\/em><\/a>, the court rightly <a href=\"https:\/\/www.supremecourt.gov\/opinions\/21pdf\/20-1530_n758.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">concluded<\/a> what many common-sense\u2062 observers have known for years, which\u2064 is that federal \u2062agencies cannot \u2064simply \u200bgrant to themselves any power they please simply because they claim to be pursuing valuable goals. While reasonable\u200c people can \u200dargue about the merits of various environmental \u200claws, most Americans would hopefully agree it\u2019s the job of\u200d Congress, not unelected \u2063officials in the Environmental Protection Agency, \u200cto decide whether \u200bthe agency\u2019s \u200dregulatory powers should be expanded.<\/p>\n<p>The\u200d EPA <a href=\"https:\/\/www.supremecourt.gov\/opinions\/22pdf\/21-454_4g15.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">took another hit \u2062in May when the court ruled in <em>Sackett v. EPA<\/em><\/a> that the agency could not\u200c unilaterally redefine the definition of navigable waters in a way that vastly increased\u200d its regulatory \u2062reach\u200c over millions more acres. To be clear, these were \u2064not\u200b battles \u2064on what \u2062is good \u2062environmental policy but rather on who gets to call the shots: the people\u2019s \u200brepresentatives or unelected government \u2064bureaucrats.<\/p>\n<h3 class=\"wp-block-heading\">Executive Branch<\/h3>\n<p>While\u200c the judicial\u2064 branch is racking up wins, the\u2062 executive branch proves to\u2064 be the \u2063weakest \u2064of the three-pronged attack with no substantive action. Understandably, the\u2064 home of the administrative state\u2064 is unlikely \u2062to relinquish its power. Nevertheless,\u2064 the rhetoric on the campaign trail \u2062is hopeful. Former\u2062 President Trump, Florida Gov. Ron DeSantis, and political newcomer Vivek Ramaswamy have made dismantling the administrative state <a href=\"https:\/\/www.wsj.com\/articles\/2024-candidates-run-against-the-administrative-state-desantis-ramaswamy-twitter-bureaucrats-reagan-trump-7d535e5\" target=\"_blank\" rel=\"noreferrer noopener\">part of their \u200bplatforms<\/a>.<\/p>\n<p>This may only be rhetoric,\u200d and we\u2019ll \u2062see if any of them \u2064follow through if elected. Once in office, politicians find it challenging to relinquish power while keeping and fulfilling all of the promises they\u2019ve \u200dmade on the campaign\u200b trail.<\/p>\n<h3 class=\"wp-block-heading\">Legislative Branch<\/h3>\n<p>Finally, there\u2019s the legislative branch \u2014 which has been far too complicit\u2063 in allowing the administrative state to expand\u2064 without accountability. Congress\u200b willingly punts tough decisions that necessarily demand \u200dtradeoffs\u2064 between competing goods, and <a href=\"https:\/\/www.nationalreview.com\/bench-memos\/ending-administrative-state-uphill-necessary-battle-free-nation\/?fbclid=IwAR1sPGfFEySWXbNoXCHDkQF0dBgzj3MuJOk2h3-TUkYRkNlFLa8dglyn8Fk\" target=\"_blank\" rel=\"noreferrer noopener\">allows <\/a><a href=\"https:\/\/www.nationalreview.com\/bench-memos\/ending-administrative-state-uphill-necessary-battle-free-nation\/?fbclid=IwAR1sPGfFEySWXbNoXCHDkQF0dBgzj3MuJOk2h3-TUkYRkNlFLa8dglyn8Fk\">unelected bureaucrats<\/a> \u2062to decide those tradeoffs \u200cinstead.<\/p>\n<p>It\u2019s the\u200b job of agency technicians to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-courts-lawmakers-and-the-next-potus-could-rein-in-the-administrative-state\/\" title=\"Courts, lawmakers, and the next POTUS can limit the power of the administrative state.\">implement congressional laws governing forest protection<\/a>, for example, or energy conservation. It\u2019s the job of Congress, meanwhile,\u200d to represent the people when passing those laws, doing their best to balance, say, economic growth with environmental\u200b protection.<\/p>\n<p>When Congress avoids making those decisions, it \u200cleaves it \u2064up to people\u2063 nobody elected. That\u2019s not how a republic is supposed\u2064 to work, and it\u2019s not what lawmakers were hired to do.<\/p>\n<p>Thankfully, we are finally seeing lawmakers taking steps to \u2064regain \u2063their constitutional authority. The House <a href=\"https:\/\/cammack.house.gov\/media\/press-releases\/rep-cammacks-landmark-legislation-reins-act-passes-us-house\" target=\"_blank\" rel=\"noreferrer noopener\">recently passed the Regulations from \u2063the Executive in Need of \u200bScrutiny\u2063 Act<\/a>, or the REINS Act. This would require\u2062 congressional approval before\u2063 implementing a regulation with \u201can annual effect on the economy of $100\u2062 million or more.\u201d<\/p>\n<p>Although the REINS Act is <a href=\"https:\/\/ballotpedia.org\/REINS_Act\" target=\"_blank\" rel=\"noreferrer noopener\">unlikely<\/a> to pass the Senate or receive a signature from President Biden this year, this is the most sizable legislative movement\u2064 against the administrative state \u2062in years.<\/p>\n<p>Further, as \u200cis often the case with policy movements, state capitals contain even more optimism, with state lawmakers continuing to\u2062 lead\u2062 the way in fighting back against administrative \u200crule. <a href=\"https:\/\/ballotpedia.org\/REINS-style_state_laws\" target=\"_blank\" rel=\"noreferrer noopener\">Florida and Wisconsin<\/a> have passed\u200d state-level REINS Acts, with\u2064 <a href=\"https:\/\/heartland.org\/publications\/research-commentary-tennessee-looks-to-rein-in-cost-of-state-regulations\/\" target=\"_blank\" rel=\"noreferrer noopener\">more<\/a> states poised to follow\u2063 suit.<\/p>\n<p>The fight\u2064 against the federal behemoth is far from \u2063over, but\u200c those who believe \u2063in the separation of powers have good \u2062reason to hope. The administrative state is losing ground in the courts, and momentum is gaining in the legislature.<\/p>\n<p>Good \u200dnews in politics \u200bis rare.
