This is a stacking of inferences that\u2062 cannot support a finding of falsehood,\u201d judge Singhal <a href=\"https:\/\/storage.courtlistener.com\/recap\/gov.uscourts.flsd.621239\/gov.uscourts.flsd.621239.31.0_1.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">wrote<\/a>.<\/p>\n<\/blockquote>\n<p>The \u200c45<sup>th<\/sup> \u2063 President argued \u2063that the use of the term \u201cthe Big Lie\u201d was defamatory\u200d as they\u200d \u201ccreated a false and incendiary association\u201d \u200cwith Hitler. The term is usually \u2064associated with the \u200bNazi regime \u200dof Germany, with the origin\u2063 of the term associated with Adolf Hitler\u2019s accusation of wrongdoing against \u2063the Jewish people.<\/p>\n<p>The lawsuit had cited five \u2064different instances when the term \u201cthe Big Lie\u201d was used. January 25, \u200c2021, CNN \u2062opinion article by Ruth Ben-Ghiat; July 5 and September 15 pieces by Chris Cillizza; a January 16 reference to \u201cthe \u2064Big Lie\u201d by Jake Tapper\u2064 on State of the Union; and another Cillizza piece from February 11.\u200c The lawsuit also listed other \u2062moments when guests \u2063on CNN had made\u200d the comparison as well,\u2063 including one such instance where Linda Ronstadt made the comparison during \u200dan interview with Anderson Cooper in 2019.<\/p>\n<p>Singhal wrote that \u201cbad \u2063rhetoric is not\u2063 defamation when it does \u2062not include false statements of \u2064fact,\u201d adding\u2064 that\u200d no \u201creasonable viewer\u201d could\u2062 make the reference that president Trump \u201cadvocates for \u200cthe persecution and genocide\u200d of Jews or\u200c any other group \u2063of people.\u201d<\/p>\n<p>Although Singhal dismissed the suit,\u200d he made it clear \u2064that he was not a fan of CNN using the \u200cphrase. He said that\u2063 it was\u200b \u201codious and repugnant\u201d to use\u2062 that or any other potential references to \u200cHitler and the Holocaust \u200cin any news stories.  <\/p>\n<p>The lawsuit was filed in the Southern District of Florida, the jurisdiction that covers Mar-a-Lago,\u200c the Palm Beach estate.<\/p>\n<p>Stay\u200d informed!
