Warren\u2064 \u2013 Pool\/Getty Images)<\/figcaption><\/figure>\n<h2>OAN\u2019s <a href=\"https:\/\/www.oann.com\/tag\/sophia-flores\">Sophia Flores<\/a><br \/>10:38 AM \u2013 Friday, July 28, 2023<\/h2>\n<p>Attorneys for Bryan Kohberger, the prime \u2064suspect in the killings of four \u2062University of Idaho students,\u200c are fighting back. \u200cThis time, they are trying to \u2064get his indictment dismissed.<\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<p>In a <a rel=\"noreferrer noopener\" href=\"https:\/\/s3.us-west-2.amazonaws.com\/isc.coi\/CR29-22-2805\/072523-PUBLIC-Motion-to-Dismiss-Indictment-on-Grounds-of-Error-GJ-Inst-Alt-Remand.pdf\" target=\"_blank\">court filing<\/a> dated July 25<sup>th<\/sup>, which was released on Thursday, it \u2062was revealed that his defense team is claiming that the grand jury should\u2019ve granted the 28-year-old a preliminary hearing instead of indicting him, as \u2063the grand \u2063jury was \u201cmisled as to the standard of proof required for an indictment.\u201d<\/p>\n<p>The defense team of the Idaho murders suspect believes that the \u2062jury had a much lower standard than the typical instructions \u2064that are \u200crequired for a judge to toss out a preliminary hearing. The standard of proof based on what is\u2062 presented is typically \u201cbeyond a reasonable doubt.\u201d\u2062 However, in this case, the grand jury was able to proceed with an indictment based\u2063 on a \u201creasonable ground for believing\u2064 that a particular individual \u2026 has \u2064committed\u201d a \u2063certain offense. <\/p>\n<p>If his proposition is not granted by\u200d the judge, his team is asking for\u2063 a new preliminary hearing \u200din front of a magistrate to \u2064determine if the case \u2063should \u2063move forward. <\/p>\n<p>This news\u200b comes days after Kohberger\u2019s attorneys \u2063announced that \u2064they plan to\u2062 present \u2062an alibi as \u200bpart of their defense strategy.
