Doug Ducey, <a href=\"https:\/\/www.azleg.gov\/viewdocument\/?docName=https:\/\/www.azleg.gov\/ars\/15\/00120-02.htm\">ensuring<\/a> that \u201c\u2026athletic teams \u200bor\u2064 sports designated for \u2018females,\u2019 \u200c\u2018women,\u2019 or \u2018girls\u2019 may not be open to \u200bstudents of the male sex.\u201d<\/p>\n<p>Prior\u2063 to the law\u2019s passage in 2022, the Arizona Interscholastic Association (AIA) had a policy <a href=\"https:\/\/www.nclrights.org\/wp-content\/uploads\/2023\/07\/2023.07.20.-Dkt.-127.-Order-Granting-Pltfs-Mtn-for-PI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">allowing<\/a> males to play on girls\u2019 sports teams if they \u200bsubmitted a\u2064 request that was approved by a \u201ccommittee of medical and psychiatric experts, and \u200bconsistent with AIA health and safety policy and if not motivated by an improper purpose.\u201d<\/p>\n<div class=\"fdrlst__b89e9-paragraph-2-long d-flex justify-content-center\" style=\"margin-left: auto; margin-right: auto; text-align: center; \" id=\"fdrlst__b89e9-145176627\">\n<div id=\"div-gpt-ad-1379703300879-0\" class=\"mb-30\"><\/div>\n<\/div>\n<div class=\"fdrlst__b89e9-c0a1e5e2b3163925e1d38a42c6232d33 fdrlst__b89e9-paragraph-2\" id=\"fdrlst__b89e9-c0a1e5e2b3163925e1d38a42c6232d33\"><\/div>\n<p>Arizona is not the only state to pass a\u2064 law protecting girls\u2019 sports. At least 20 other states have <a href=\"https:\/\/tennesseelookout.com\/2023\/04\/20\/u-s-house-approves-bill-banning-transgender-student-athletes-in-girls-sports\/\" target=\"_blank\" rel=\"noreferrer noopener\">passed<\/a> similar laws, most of which are also <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/nine-states-and-d-c-still-have-mask-mandates-in-place\/\" title=\"Nine States and D.C. Still Have Mask Mandates in Place\">facing legal challenges<\/a>.<\/p>\n<p>A preliminary injunction is an\u200d extreme legal\u200d remedy. It prevents\u2062 a law from going into \u200beffect\u2063 and it is \u2064only \u2063granted if\u2063 the plaintiffs can prove the following <a href=\"https:\/\/www.nclrights.org\/wp-content\/uploads\/2023\/07\/2023.07.20.-Dkt.-127.-Order-Granting-Pltfs-Mtn-for-PI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">elements<\/a>:<\/p>\n<ol>\n<li>They are likely to succeed on the merits \u2064of their \u2064claims.<\/li>\n<li>They are likely to suffer irreparable harm in the absence of preliminary relief.<\/li>\n<li>The\u2064 balance of equities tips \u200bin their favor.<\/li>\n<li>An injunction is in the \u2062public interest.<\/li>\n<\/ol>\n<p>However, the <a href=\"https:\/\/www.nclrights.org\/wp-content\/uploads\/2023\/07\/2023.07.20.-Dkt.-127.-Order-Granting-Pltfs-Mtn-for-PI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">order<\/a>, written by Obama-appointed \u2064Judge Jennifer <a href=\"https:\/\/obamawhitehouse.archives.gov\/the-press-office\/2011\/06\/23\/president-obama-nominates-two-united-states-district-court-bench\" target=\"_blank\" rel=\"noreferrer noopener\">Zipps<\/a>, makes numerous \u201cfindings of facts and conclusions \u2062of law,\u201d most \u200cof\u200c which sound like gobbledygook pulled <a href=\"https:\/\/www.tandfonline.com\/doi\/pdf\/10.1080\/26895269.2022.2100644\" target=\"_blank\" rel=\"noreferrer noopener\">straight<\/a> from \u2064the World Professional Association for Transgender Health (WPATH) <a href=\"https:\/\/www.wpath.org\/\" target=\"_blank\" rel=\"noreferrer noopener\">website<\/a>.<\/p>\n<p>According to Judge Zipps, the\u200c plaintiffs are likely to succeed on their\u2063 claims that the Arizona law is unconstitutional because\u200c the\u200b two transgender\u200b plaintiffs, 11 and\u2064 15 years old, \u200crespectively, have taken medication that \u2062prevents them \u2062from going through male puberty.\u2062 Or, as Judge Zipps puts it:<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>The testimony by Drs. Brown and Hilton that boys have some biological \u2064advantages\u200d related to physical fitness before puberty does not\u200c support a conclusion that Plaintiffs [who are biological males], who have not experienced male puberty, have any athletic advantage over other girls \u2064or pose a safety risk to other girls by playing on girls\u2019 sports teams.<\/p>\n<\/blockquote>\n<p>The order also finds\u200c it necessary to make \u2064a finding of fact\u2064 the typical bogeyman\u2064 used by <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/tennessee-state-police-estimate-up-to-3000-people-attended-matt-walsh-rally-to-end-child-mutilation\/\" title=\"Tennessee State Police Estimate Up To 3,000 People Attended Matt Walsh \u2018Rally To End Child Mutilation\u2019\">pro-trans advocates<\/a>, which is that the risks to children\u2063 if not\u2063 allowed to \u201ctransition\u201d include \u201canxiety,\u200d depression, eating disorders, substance abuse, \u2062self-harm, and suicide,\u201d as well as discrimination and harassment. These statistics are arguably <a href=\"https:\/\/www.transgendertrend.com\/the-suicide-myth\/\" target=\"_blank\" rel=\"noreferrer noopener\">exaggerated<\/a> at the very least.<\/p>\n<p>The order finally holds that unless the \u2064plaintiffs are \u2063allowed \u2062to play girls\u2019\u200b sports, they will suffer \u2064\u201cirreparable harm,\u201d\u2063 not\u200d just because their \u2062constitutional rights are being violated, but\u200d because it would be\u2063 humiliating and painful if they\u2062 are not allowed to \u201clive as girls in all aspects of their lives,\u201d including athletics. Apparently\u200b living as \u2062girls in all aspects of their lives is an essential part of the treatment for \u200dtheir\u2063 gender dysphoria.<\/p>\n<p>Now that the court has ruled, the defendants in the case \u2014 which include\u2062 the state school superintendent, the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/arizona-federal-judge-temporarily-rules-males-can-compete-in-girls-sports\/\" title=\"Arizona judge allows males to participate in girls' sports temporarily.\">local school district superintendent<\/a>,\u2062 the two schools and school\u2062 districts involved, and the AIA \u2014 state that they plan to <a href=\"https:\/\/apnews.com\/article\/arizona-transgender-school-sports-law-injunction-2017dce4143c07ad5ff83f3a43639c72\" target=\"_blank\" rel=\"noreferrer noopener\">appeal<\/a> \u200dthe ruling. While\u200b the decision will likely be upheld by a liberal Ninth Circuit, State School\u2062 Superintendent Tom Horne thinks the ultimate decision will be <a href=\"https:\/\/apnews.com\/article\/arizona-transgender-school-sports-law-injunction-2017dce4143c07ad5ff83f3a43639c72\" target=\"_blank\" rel=\"noreferrer noopener\">made<\/a> by \u2063the United States Supreme Court.<\/p>\n<p>It\u2019s easy to mock the Orwellian language \u2063that allows \u200btwo males\u200d to participate in girls\u2019 sports \u2063in\u200b an ironic mockery of the\u200c original Title IX, the \u2064federal \u2064guidance <a href=\"https:\/\/www.historians.org\/research-and-publications\/perspectives-on-history\/summer-2022\/title-ix-at-50-approaches-to-womens-sports-history\" target=\"_blank\" rel=\"noreferrer noopener\">created<\/a> in \u200dlarge part to protect girls\u2019 \u2062sports.<\/p>\n<p>However, at the \u2064center of this lawsuit \u2062are two children who are \u2063victims \u2014\u200d both\u2064 males\u2064 who have believed they are girls since a young age. Both \u201cknew they were a girl,\u201d have either been taking medication to stop puberty, or are about to start taking medication. Both\u2064 have been constantly\u200c <a href=\"https:\/\/www.nclrights.org\/wp-content\/uploads\/2023\/07\/2023.07.20.-Dkt.-127.-Order-Granting-Pltfs-Mtn-for-PI.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">affirmed<\/a> in their\u200d new identity by\u200d parents, teachers, peers, and now a federal court. Tragically, \u2064that\u2019s the true irreparable harm.<\/p>\n<hr class=\"wp-block-separator\">\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Last week, a Tucson federal judge granted a preliminary injunction against Arizona&#8217;s Save Women&#8217;s Sports Act.
