Under President Barack Obama,\u200d Bergdahl was traded for five Taliban leaders\u200b who\u2063 had been detained in Guantanamo Bay. <\/span><\/p>\n<p><span style=\"font-weight: 400\">According to Walton, because <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/voir-dire-begins-in-case-of-architects-of-9-11\/\" title=\"Voir dire begins in case of architects of 9\/11\">military judge<\/a> Jeffrey Nance \u2064did not \u200bdisclose his application \u200bto be an immigration judge under then-President Donald\u200b Trump, Nance\u2019s presiding over Bergdahl\u2019s trial could \u200bbe construed as a conflict of \u200binterest because \u200cTrump had been vocally \u2064critical of Bergdahl. <\/span><\/p>\n<blockquote>\n<h3>Judge Walton&#8217;s Ruling<\/h3>\n<p><span style=\"font-weight: 400\">\u201cNamely, the military judge\u200b in this case submitted \u2063a writing \u2063sample along with his application, consisting of an order \u200din which he denied the\u200b plaintiff\u2019s [Bergdahl] unlawful-command-influence motion which \u2062was based on President Trump\u2019s statements, \u2063and ruled against\u200b the plaintiff \u2014 both actions that a reasonable person might \u2062view as\u200c serving the president\u2019s \u200binterest in this case,\u201d Walton\u2019s ruling said. <\/span><\/p>\n<\/blockquote>\n<p><span style=\"font-weight: 400\">Bergdahl was imprisoned and tortured \u200cby \u200bthe Taliban\u2064 for five years after \u200bwalking away from his post in 2009. Bergdahl escaped jail time but was made\u200d to\u2062 forfeit $10,000 in pay and was\u200b dishonorably discharged. <\/span><\/p>\n<p><span style=\"font-weight: 400\">While campaigning for the GOP presidential \u200bnomination, Trump <a href=\"https:\/\/www.reuters.com\/article\/us-usa-defense-bergdahl-trump\/bergdahl-lawyer-slams-candidate-trump-over-traitor-comments-idUKKCN0QP29X20150820\" target=\"_blank\" rel=\"noopener\">called<\/a> Bergdahl a \u200b\u201cdirty rotten \u2063traitor.\u201d Trump also said\u200b that\u200b Bergdahl\u2019s\u2062 sentence was not strong enough, <a href=\"https:\/\/www.dailywire.com\/news\/trump-blasts-bergdahl-decision-complete-and-total-hank-berrien\" target=\"_blank\" rel=\"noopener\">saying<\/a> that it was \u201ca\u200c complete and total disgrace to our \u200bCountry and to our Military.\u201d<\/span><\/p>\n<p><span style=\"font-weight: 400\">Four\u200b of the five Taliban members <a href=\"https:\/\/www.dailywire.com\/news\/four-taliban-members-released-from-gitmo-in-trade-for-bowe-bergdahl-now-part-of-hardline-afghan-government\" target=\"_blank\" rel=\"noopener\">released<\/a> in exchange for Bergdahl joined the Taliban\u2019s hardline government in Afghanistan after the\u200d group took over in the fall of 2021. <\/span><\/p>\n","protected":false},"excerpt":{"rendered":"<p>Bowe Bergdahl, the American soldier captured in Afghanistan and exchanged for Taliban leaders, had his desertion conviction overturned.
