U.S. District \u2062Judge Maryellen\u2062 Noreika adjourned the hearing\u200b so the \u2063Department of Justice and Hunter\u200d Biden\u2019s \u200blegal team could rework \u200dthe deal \u2064to her liking. <\/p>\n<div id=\"div-gpt-ad-1663871513696-art-1\" style=\"min-width: 320px; min-height: 50px;  text-align: center;\">  \t<script>  \t\tgoogletag.cmd.push(function() { googletag.display('div-gpt-ad-1663871513696-art-1'); });  \t<\/script>  <\/div>\n<div class=\"ad-slot__ad-label\">Advertisement<\/div>\n<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201c[Judge Noreika] had\u2064 a lot of courage, because neither side wanted her to make \u200cthat decision,\u201d criminal defense\u2062 attorney, Alan Dershowitz, said. \u201cAnd she made the decision, because she doesn\u2019t represent either\u200b side. She\u2019s not the government\u2019s lawyer, and she\u2019s not the defense lawyer. She\u2019s our lawyer. She\u2019s the judge\u200b for the public. And the \u2063public interest mandated that she not \u2063accept\u2064 this plea.\u201d<\/p>\n<\/blockquote>\n<p>Hunter Biden \u2063planned to plead guilty to two misdemeanor tax charges,\u200d and\u200b avoid punishment on a felony gun charge through a pretrial diversion agreement. \u200dHowever, prosecutors and Biden\u2019s attorneys\u200b disagreed about the scope of immunity that the deal offered. Noreika then expressed concerns about her own role in the deal. Dershowitz says there was too much confusion for a judge to\u200b feel\u2062 comfortable \u2063accepting \u200cthe agreement.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWe have \u200bAttorney General\u200c Garland saying [U.S. attorney David Weiss] was open\u200c to \u200cinvestigate anything from \u2063Los Angeles, District of Columbia,\u2064 Ukraine, China,\u201d Dershowitz said. \u201cThe\u200c U.S. attorney himself, David Weiss, says, \u2018No, no, \u2062no, no, I\u200c was limited only to\u200b Delaware.\u2019 Well, somebody is not conveying \u200dthe right information to the court.\u201d <\/p>\n<\/blockquote>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cAnd\u2063 then of course, there\u2019s the\u200d ambiguity,\u201d Dershowitz continued. \u201cCan he\u2063 be continually\u2064 investigated?\u200d And what if other crimes are found? Does \u2064this\u200b close\u2062 the book as his lawyer said it does, or does it, uh, maintain\u200d the \u2062possibility of more investigation as the U.S. attorney\u2019s office said it was.\u201d<\/p>\n<\/blockquote>\n<p>Dershowitz says this \u200dambiguity is disrespectful to\u200d the American\u2063 public.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThat is \u2062not\u200d the kind of transparency that the\u2063 Constitution\u200b requires \u2064and that the American\u2062 public rightfully demands,\u201d Dershowitz told One \u200cAmerica \u2064News.<\/p>\n<\/blockquote>\n<p>The First Son ended up pleading not guilty \u2063to all three \u2064charges. Hunter Biden could withdraw that plea if Noreika approves a deal down the road.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWill [Judge Noreika] \u200daccept a resolution that both sides agree to, even if \u200cthere are no ambiguities,\u201d Dershowitz questioned.\u200b \u201cBut if she\u2019s not \u200bsatisfied that \u2062there was an investigation\u2063 that covered all possible\u200d crimes outside of \u200bDelaware, I think that\u2019s \u2064the remaining issue.\u201d<\/p>\n<\/blockquote>\n<p>Republican lawmakers celebrated Noreika\u2019s decision. House\u200b Oversight Committee Chairman James Comer saying that she did the \u201cright thing by refusing to\u200c rubberstamp Hunter Biden\u2019s sweetheart plea deal.\u201d<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote data-service=\"twitter\" data-category=\"marketing\" data-placeholder-image=\"https:\/\/c3.oann.com\/wp-content\/plugins\/complianz-gdpr\/assets\/images\/placeholders\/twitter-minimal.jpg\" class=\"cmplz-placeholder-element twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">\ud83d\udea8\ud83d\udea8\ud83d\udea8<\/p>\n<p>Today District Judge Noreika did the right thing by refusing to\u2062 rubberstamp Hunter \u200dBiden\u2019s \u2063sweetheart\u200b plea deal. <\/p>\n<p>But let\u2019s be clear: Hunter\u2019s sweetheart plea\u2063 deal belongs in the trash. <\/p>\n<p>The DOJ must be held accountable for its Biden family\u200d coverup.<\/p>\n<p>My full statement\ud83d\udc47 <a href=\"https:\/\/t.co\/E03QBr4hX7\">pic.twitter.com\/E03QBr4hX7<\/a><\/p>\n<p>\u2014 Rep. \u2064James Comer (@RepJamesComer) <a href=\"https:\/\/twitter.com\/RepJamesComer\/status\/1684267360398499841?ref_src=twsrc%5Etfw\">July 26,\u2064 2023<\/a><\/p><\/blockquote>\n<p><script type=\"text\/plain\" data-service=\"twitter\" data-category=\"marketing\" async data-cmplz-src=\"https:\/\/platform.twitter.com\/widgets.js\" charset=\"utf-8\"><\/script> <\/div>\n<\/figure>\n<p>Dershowitz argued that the deal was fair if the extent of the deal focused \u2062on the tax and gun charges exclusively.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cIt \u2064was \u2062not\u2062 a sweetheart \u2063deal if all he\u2063 was\u2062 guilty \u2064of was the tax \u200devasion, he \u200dpaid the taxes back, and the gun charge,\u201d Dershowtiz said. \u201cIf those were the only crimes, then the appropriate resolution was putting him \u2064in a program, \u200callowing him to plead.\u201d <\/p>\n<\/blockquote>\n<p>Dershowitz says if the deal did <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/dershowitz-judge-noreika-showed-courage-in-decision-to-nix-hunter-biden-plea-deal\/\" title=\"Dershowitz praises Judge Noreika for rejecting Hunter Biden plea deal.\">include broad global immunity<\/a>, something that \u2063Hunter Biden\u2019s\u200b legal team reportedly wanted, then\u200c it would have \u200dbeen a sweetheart deal.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cBut if there\u2019s more, whether \u2063or not there was extortion,\u2064 whether\u2063 or not there was improper conduct with \u200dUkraine, whether there were improper dealings with China, then clearly it\u200d was a sweetheart deal,\u201d Dershowitz argued.\u200b \u201cSo I\u2019ll put it this way, the sweetheart part of the deal was to \u2062end \u2062the investigation, but the prosecution said we didn\u2019t agree to that.\u201d<\/p>\n<\/blockquote>\n<p>Reports say the prosecution admitted on the record that the investigation into Hunter Biden was \u200congoing. \u200bThis could be significant since Iowa Republican Senator Chuck\u200c Grassley released an FD-1023 form alleging Burisma Oil executive Mykola\u200c Zlochevksy\u2063 paid \u200cboth Hunter and then-Vice President \u2062Joe Biden $5 million each to shut down\u2063 an investigation by\u200b then-Prosecutor General Viktor\u2063 Shokin.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cThe allegations\u2064 are\u2064 damning if truthful,\u201d \u200dDershowitz said. \u201cBut remember that whistleblowers\u2064 are not\u2063 necessarily truth tellers. Just because\u2064 you\u2019re a whistleblower doesn\u2019t mean you\u2019re \u200ctelling the truth.\u201d<\/p>\n<\/blockquote>\n<p>Dershowitz asserted the American people deserved to know \u200cthe truth about the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/bureaucrats-are-hell-bent-on-congress-rubber-stamping-fisa-so-they-can-snoop-without-warrants-or-consequences\/\" title=\"Officials want FISA approved to spy without warrants or consequences.\">confidential human source\u2019<\/a>s \u2064claims in the FD-1023.<\/p>\n<blockquote class=\"wp-block-quote\">\n<p>\u201cWe can\u2019t allow these kinds of allegations, which are so serious, to lay out\u200d there unproven,\u201d Dershowitz said. \u201cSo that the Republicans can say we believe it. And the Democrats can say, we don\u2019t.
