in Bid to \u200b&#8217;Hold\u200b Off&#8217; Congress<\/h2>\n<p>George Washington \u2063University Law School professor Jonathan Turley persuasively argued the Biden Justice Department was being too cute by half when prosecutors crafted a\u200c very lenient plea deal for Hunter Biden.<\/p>\n<blockquote>\n<p>But the judge overseeing the\u2062 case would not let the deceptive gamesmanship stand.<\/p>\n<\/blockquote>\n<p>Biden was expected\u200c to <a href=\"https:\/\/www.westernjournal.com\/bank-records-dont-lie-gop-reps-uncovered-disturbing-findings-hunter-biden-case\/\" target=\"_blank\" rel=\"noopener\">plead guilty<\/a> Wednesday \u200bin a\u2062 federal courthouse in\u2062 Wilmington, Delaware, to two <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/hunter-biden-plea-deal-cannot-be-the-final-word-grassley-says\/\" title=\"Grassley: Hunter Biden plea not the final say.\">misdemeanor tax evasion charges<\/a> and one <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/top-law-professor-hunter-biden-court-debacle-a-case-of-the-doj-being-hoisted-on-its-own-petard-in-bid-to-hold-off-congress\/\" title=\"Law professor: Hunter Biden court issue is DOJ's own problem in trying to delay Congress.\">illegal \u2063gun possession charge<\/a> and likely do little or no jail time.<\/p>\n<p>The deal \u2062appeared\u2064 to come \u200dtogether quickly in June as \u200bthe GOP-controlled \u200bHouse Oversight Committee\u2019s hearings\u200d into Biden\u2019s <a href=\"https:\/\/www.westernjournal.com\/bank-records-dont-lie-gop-reps-uncovered-disturbing-findings-hunter-biden-case\/\" target=\"_blank\" rel=\"noopener\">overseas business \u200cdealings<\/a> \u200c continued to heat up.<\/p>\n<blockquote>\n<p>However, the deal fell through \u200dWednesday when U.S. District Court Judge \u200cMaryellen Noreika <a href=\"https:\/\/www.westernjournal.com\/breaking-hunter-bidens-original-sweetheart-plea-deal-falls-apart-appears-court\/\" target=\"_blank\" rel=\"noopener\">called into\u2064 question<\/a> the blanket immunity from future prosecution that Biden\u2019s attorneys believed\u200c the agreement involved.<\/p>\n<\/blockquote>\n<p>Under questioning from the judge, federal prosecutors denied the agreement that offered immunity\u200c from future prosecution.<\/p>\n<p>Biden then withdrew \u2064from the plea \u200ddeal and pleaded <a href=\"https:\/\/www.westernjournal.com\/hunter-biden-changes-plea-original-sweetheart-deal-falls-apart-court\/\" target=\"_blank\" rel=\"noopener\">not guilty<\/a> to the crimes.<\/p>\n<p>\u201cThe problem \u2063with cutting a \u2062sweetheart \u200cdeal is that you can\u2019t \u2063put everything\u2062 into the deal that \u200cis really on your mind,\u201d Turley told\u200d Fox News on Wednesday.<\/p>\n<p>\u201cThis is really a\u200b case of the Department of Justice being\u2063 hoisted on its\u200d own\u200b petard, because the Justice Department needs to \u200bsay that\u2064 there\u2019s an ongoing \u200cinvestigation to stop giving information, holding back witnesses to Congress. \u2063They need\u200c that element,\u201d he argued.<\/p>\n<p>Watch the latest video at <a href=\"https:\/\/www.foxnews.com\">foxnews.com<\/a><\/p>\n<p>\u201cBut \u200cthis judge immediately called them on \u2062it and said, \u2018Well, \u2062what \u200cis it?\u2019 The Hunter Biden team said \u2063publicly that they believe this was a closed-out plea agreement, which is what\u200b I would have negotiated as defense counsel,\u201d \u200dTurley said.<\/p>\n<p>The law professor explained that a close-out plea \u200ddeal is\u200b the only type he would accept on behalf of anyone he would represent in court.<\/p>\n<p>\u201cOtherwise,\u2064 you\u2019ve got Damocles\u2019 \u200csword hanging over your client\u2019s head,\u201d Turley\u2062 said.<\/p>\n<p>That\u2019s what Biden\u2019s attorneys thought \u2062they \u2062had that all matters related\u200b to his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-secret-service-intervened-in-hunter-biden-gun-incident-lied-on-background-check-form-report-says\/\" title=\"BREAKING: Secret Service Intervened In Hunter Biden Gun Incident; Lied On Background Check Form, Report Says\">overseas business dealing<\/a> are \u200bexempt from further prosecution.<\/p>\n<p>\u201cBut that\u2019s inconsistent\u2063 with the\u200b DOJ, which\u200d is using \u2064the ongoing element to hold off Congress,\u201d Turley said.<\/p>\n<p>So they\u2019re trying to have it both ways: protect Biden from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/white-house-says-hunter-investigation-handled-independently-after-judge-rejects-dojs-favorable-plea-deal\/\" title=\"White House claims Hunter investigation 'handled independently' despite DOJ's plea deal rejection.\">future criminal charges<\/a> from past overseas \u200dbusiness deals and protect the \u200dBiden family from damaging \u200dinformation\u200c coming out through Congress.<\/p>\n<p><a href=\"https:\/\/www.westernjournal.com\/page-2-hunter-bidens-conditions-release-orders-get-job-not\/\" target=\"_blank\" rel=\"noopener\">Noreika<\/a> wouldn\u2019t\u200d let it fly.<\/p>\n<p>\u201cAnd so this is really a problem \u2063of the DOJ\u2019s making,\u201d\u200b Turley said. \u201cThey\u2064 want \u2064to cap off this case\u200c and end it,\u200c but they also want to pretend that \u200cit\u2019s ongoing. And you can\u2019t \u2064have that ambiguity with a federal judge.\u201d<\/p>\n<p>\u201cThe problem with this is it \u2064was a wink and a nod agreement, but\u200c courts don\u2019t do that. \u200dThey\u2062 don\u2019t conclude these types of \u200cplea bargains with \u2064a wink and a \u2062nod.
