Version: 4.0.47--><h2>Bad News for the Biden Administration: \u200bFederal Judge Blocks New Border Policy<\/h2>\n<p>There is\u2063 more bad news for the \u200bBiden administration.<\/p>\n<p>On Tuesday, a U.S. federal judge in California blocked a new rule aimed at limiting asylum access along \u200dthe U.S.-Mexico border, overturning a crucial aspect of President Joe Biden\u2019s failing strategy to try and\u200d control the ongoing illegal immigration crisis \u2014 particularly after the COVID-era Title 42 restrictions ceased\u200b in May, \u200c <a href=\"https:\/\/www.reuters.com\/world\/us\/us-judge-blocks-bidens-new-border-asylum-restrictions-2023-07-25\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> reported.<\/p>\n<p>The ruling from U.S. District Judge Jon Tigar came as a response to a legal challenge initiated by the American Civil Liberties Union and other <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-hollows-out-trump-era-covid-protections-at-the-border\/\" title=\"Biden Hollows Out Trump-Era COVID Protections at the Border\">left-wing advocacy groups<\/a>, resurrecting\u2063 a 2018 \u2064case that\u200d had been filed \u2064against <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-blocks-bidens-new-border-policy-after-challenge-from-aclu\/\" title=\"ACLU challenges Biden's border policy, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-blocks-ind-abortion-reversal-law\/\" title=\"Federal judge blocks Ind. \u2018abortion reversal\u2019 law\">federal judge blocks<\/a> it.&#8221;>similar asylum restrictions imposed<\/a> by the Trump administration.<\/p>\n<p>The\u2062 regulations \u2063had come into effect\u200d on May 11 following\u2062 the <a href=\"https:\/\/www.westernjournal.com\/biden-takes-page-right-trumps-policy-playbook-title-42-comes-end\/\" target=\"_blank\" rel=\"noopener\">end of Title 42<\/a>.<\/p>\n<p>The rule stated the presumption is that most migrants are not \u200deligible for asylum\u2064 if they \u200dtraveled\u2064 through\u2064 other countries without first seeking protection there or if they refused to employ legal pathways\u2062 for entering the United States.<\/p>\n<p>Following the implementation of\u200b the said\u200d regulation, there has \u2064been\u200b a decline in the number of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-admin-reinstates-fast-tracked-deportation-flights\/\" title=\"Biden admin. reinstates fast-tracked deportation flights\">migrants caught crossing<\/a> the\u200b border illegally, although the numbers are still incredibly high, <a href=\"https:\/\/www.nytimes.com\/2023\/07\/03\/us\/politics\/migrants-mexico-border.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported.<\/p>\n<p>Whether this\u2064 trend will now persist remains uncertain.<\/p>\n<h3>Legal Challenge and \u2064Ruling<\/h3>\n<p>In\u200b a 35-page ruling,\u2062 Tigar, an Obama appointee, emphasized that U.S. law explicitly indicates that crossing the\u200c border illegally should \u200dnot serve as a barrier\u200c to seeking asylum,\u200c according to \u200bReuters.<\/p>\n<p>Tigar argued that finding refuge \u2062in a countries such as \u2062Belize, Mexico or Colombia would be \u2064\u201cinfeasible\u201d \u2064due to their lack of processing capacity.<\/p>\n<p>He also\u2063 claimed that U.S. law only allows for restricting migrants\u2019 access to asylum if they pass through a country that genuinely provides a \u200dsafe option.<\/p>\n<p>Contrary \u200cto the Biden administration\u2019s stance, which claimed that migrants could\u2063 enter the\u2063 U.S.\u200d from abroad through \u2064various programs \u2014 such as\u2062 the one for\u2063 certain migrants with U.S. sponsors \u2063\u2014 Tigar said these\u2063 programs were\u200d not \u2063accessible to everyone and were \u201cirrelevant to \u200cthe availability of asylum.\u201d<\/p>\n<p>U.S. officials recently\u2063 informed migrants at the border that they can use an\u2064 <a href=\"https:\/\/www.westernjournal.com\/bidens-controversial-asylum-seeker-mobile-app-abruptly-halted-officials-maintain-steady-flow-illegals\/\" target=\"_blank\" rel=\"noopener\">app<\/a> named CBP One\u200c to request a designated time \u2062to approach a legal crossing.
