Bowe Bergdahl, who spent five years with the Taliban after walking off a U.S. Army post in Afghanistan in 2009.<\/p>\n<blockquote>\n<p>Judge\u2062 Reggie B. Walton of the U.S. District Court for the District of Columbia issued an order Tuesday vacating Bergdahl\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/san-francisco-public-schools-renaming-plan-rife-with-historical-errors\/\" title=\"San Francisco Public Schools Renaming Plan \u2018Rife With Historical Errors\u2019\">court-martial<\/a> proceedings and reversing his <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/report-hunter-biden-used-anti-black-racial-slurs-in-multiple-messages-to-white-845-per-hour-lawyer\/\" title=\"Report: Hunter Biden Used Anti-Black Racial Slurs In Multiple Messages To \u2018White, 5-Per-Hour Lawyer\u2019\">dishonorable discharge<\/a>, <a href=\"https:\/\/www.nytimes.com\/2023\/07\/25\/us\/politics\/bowe-bergdahl-conviction-overturned.html\" target=\"_blank\" rel=\"noopener\">The New York Times<\/a> reported.<\/p>\n<\/blockquote>\n<p>Walton,\u200b a George W. Bush appointee,\u2064 found that the military judge\u200c in\u200d the\u200c case, Army Col.\u200c Jeffery R. Nance, had\u2064 applied for a job with then-President Donald Trump\u2019s Justice Department without disclosing that \u200bfact.<\/p>\n<blockquote>\n<p>Walton wrote in his <a href=\"https:\/\/int.nyt.com\/data\/documenttools\/bergdahl-decision\/f32af7e7e7307b1f\/full.pdf\" target=\"_blank\" rel=\"noopener\">ruling<\/a> that Nance\u200d \u201cshould \u200chave disclosed his job \u2064application as a potential ground for his \u2063disqualification.\u201d<\/p>\n<\/blockquote>\n<p>Trump was among many Americans who called Bergdahl a traitor and suggested that \u2064he should be\u2063 executed, the Times reported.<\/p>\n<p>In\u2063 2009, Bergdahl\u200b walked off\u200b an Army post in <a href=\"https:\/\/www.westernjournal.com\/interpreter-survived-alongside-us-army-afghanistan-made-america-now-dead-fatal-encounter-dc-youth\/\" target=\"_blank\" rel=\"noopener\">Afghanistan<\/a> \u200band disappeared. He later claimed he intended to hike to another military\u2063 post to report leadership problems.<\/p>\n<p>A <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/federal-judge-throws-out-bowe-bergdahls-desertion-conviction-and-dishonorable-discharge\/\" title=\"Judge throws out Bergdahl's desertion conviction and discharge.\">massive \u2063manhunt ensued<\/a>, with U.S. troops sent out to comb the dangerous countryside for the missing man.<\/p>\n<p>They failed to find Bergdahl, who had reportedly been captured by the \u2063Taliban\u2063 within\u2064 hours. During \u2062the search effort, many soldiers were exposed to enemy fire.<\/p>\n<p>Several were injured, including Master Sgt. Mark Allen, who was shot in the head in an \u2062ambush, leaving him paralyzed and unable to speak,\u2064 the <a href=\"https:\/\/nypost.com\/2019\/10\/15\/mark-allen-retired-soldier-injured-in-search-for-bowe-bergdahl-dies-at-46\/\" target=\"_blank\" rel=\"noopener\">New York Post<\/a> reported. Allen <a href=\"https:\/\/www.westernjournal.com\/hero-paralyzed-search-coward-bergdahl-dies-injuries-46\/\" target=\"_blank\" rel=\"noopener\">died<\/a> in 2019 of complications from\u2063 the\u2062 injury.<\/p>\n<p>Bergdahl was freed when President Barack Obama\u2019s administration, in a controversial move, traded him for five high-level \u200c <a href=\"https:\/\/www.westernjournal.com\/4-prisoners-obama-exchanged-bowe-bergdahl-just-named-senior-taliban-government-roles\/\" target=\"_blank\" rel=\"noopener\">Taliban \u2062leaders<\/a> who were being held at Guantanamo\u2064 Bay, <a href=\"https:\/\/www.reuters.com\/world\/us\/bowe-bergdahls-court-martial-conviction-voided-by-us-judge-2023-07-26\/\" target=\"_blank\" rel=\"noopener\">Reuters<\/a> reported.<\/p>\n<p>Bergdahl pleaded guilty in 2017 and was demoted to private, receiving a dishonorable discharge instead of prison time, <a href=\"https:\/\/www.military.com\/daily-news\/2023\/07\/25\/bowe-bergdahls-sentence-thrown-out-judge-case-takes-new-turn.html\" target=\"_blank\" rel=\"noopener\">Military.com<\/a> reported.<\/p>\n<p>He based part of his \u200bappeal on statements by Trump and the late Sen. John McCain \u201cpublicly impugning him and declaring his guilt,\u201d according to the report.<\/p>\n<p>The U.S. \u2063Court of Appeals for the Armed Forces <a href=\"https:\/\/www.westernjournal.com\/appeals-court-shuts-bowe-bergdahls-attempt-blame-trump\/\" target=\"_blank\" rel=\"noopener\">upheld<\/a> the conviction at that time, citing Bergdahl\u2019s <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/breaking-president-trump-to-pardon-gen-michael-flynn-per-report\/\" title=\"BREAKING: President Trump to Pardon Gen. Michael Flynn, Per Report\">guilty plea<\/a> in the court-martial.<\/p>\n<p>This week\u2019s dismissal\u200d of the verdict\u2064 may allow the Army to retry \u2063the case.\u200c The decision \u200bmay be appealed, Military.com reported.<\/p>\n<p>Bergdahl\u2019s legal team said they are studying Walton\u2019s ruling, and the Justice\u2063 Department\u200d and\u200c the Army did not respond to requests for \u200dcomment, according \u2064to the outlet.<\/p>\n<p>Reuters \u200bquoted military law expert Geoffrey Corn, a retired Army officer, as saying\u200d the \u2062future of the Army\u2019s case is uncertain.<\/p>\n<p>\u201cDo they bring him back to \u200cactive duty and retry him?
