The Court should rein in the power of\u200c unelected\u2064 bureaucrats and restore the separation of \u200bpowers.\u201d<\/p>\n<p>In May, the Supreme Court granted certiorari\u200b in\u200b <em>Loper Bright Enterprises v. Raimondo<\/em>, setting \u2062the \u200cstage for a landmark \u2062decision that \u2062could narrow\u200b the \u200cscope of bureaucratic agencies to unilaterally impose\u2064 burdensome rules \u2062and regulations. The \u2064conservative majority on the court led by Chief \u2063Justice John Roberts already signaled its willingness \u200dto \u201crein \u200bin\u201d the\u2062 administrative state last summer with its decision in\u200b <em><a href=\"https:\/\/thefederalist.com\/2022\/06\/30\/supreme-court-strikes-blow-to-administrative-state-narrows-epa-authority-to-cap-carbon-emissions\/\" target=\"_blank\" rel=\"noreferrer noopener\">EPA\u2064 v. West Virginia<\/a><\/em>.\u2064 In that case, justices struck down\u200b the Obama administration\u2019s Clean Power Plan, ruling the Constitution\u2063 did not allow <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/im-kind-of-a-jerk-carlson-mocks-implosion-of-2-gop-hopefuls-during-interview-with-beck\/\" title=\"Carlson ridicules downfall of 2 GOP candidates in chat with Beck\">federal\u200d agencies<\/a> to \u200bcircumvent Congress \u2063by implementing \u2064broad \u2063regulations to <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/how-a-trial-in-finland-could-have-worldwide-effects-on-government-persecution-of-religion\/\" title=\"How A Trial In Finland Could Have Worldwide Effects On Government Persecution Of Religion\">wide effect<\/a>.<\/p>\n<p>In 1984, the\u2064 Supreme Court established <em>\u201cChevron<\/em> deference\u201d in <em>Chevron\u200d v. Natural Resources \u2064Defense Council<\/em>, <a href=\"https:\/\/www.law.cornell.edu\/wex\/chevron_deference#:~:text=The%20scope%20of%20the%20Chevron,made%20by%20the%20administrative%20agency.\" target=\"_blank\" rel=\"noreferrer noopener\">broadly \u2063defined<\/a> as allowing administrative agencies to substitute their own interpretation \u2063of congressional statutes when a particular issue is implicit. Justices on the \u2063current court \u2064have <a href=\"https:\/\/fedsoc.org\/commentary\/fedsoc-blog\/chevron-is-dead-long-live-chevron\" target=\"_blank\" rel=\"noreferrer noopener\">debated <\/a>whether the 1984 case law has been properly interpreted. Regardless, Republicans say its application\u200d has\u200d been abused \u2064by \u2064a burgeoning\u200d administrative state run by unelected bureaucrats.<\/p>\n<p>Three dozen lawmakers, led by Sen. Ted Cruz,\u200d R-Texas, \u2064and Rep. Mike Johnson, R-La., filed another <a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/22\/22-451\/272700\/20230724124856016_22-451%20Amicus%20Brief%20of%20U.S.%20Senator%20Ted%20Cruz%20et%20al..pdf\" target=\"_blank\" rel=\"noreferrer noopener\">brief<\/a> on Monday in \u2063support of a challenge\u2063 to the <em>Chevron\u2064 <\/em>ruling. The \u200cbrief includes 18 total \u200dsignatories\u200d from the upper chamber, including Minority Leader Mitch McConnell, and 18 from the House.<\/p>\n<p>\u201cDecades\u200c of application of Chevron deference have facilitated the exercise of functions by\u200d the executive branch that more\u2062 properly belong \u200dto the\u2063 legislative and \u200djudicial branches,\u201d the brief reads. \u201cAgencies exploit general or broad\u200b terms in statutes to engage in \u200cpolicymaking functions of questionable legality with the assumption that\u200c courts will grant deference and not independently evaluate the lawfulness of those agency interpretations.\u201d<\/p>\n<p>The court will revisit\u2064 the nearly four-decade-old doctrine in <em>Loper Bright Enterprises v. Raimondo<\/em>, with \u2063New Jersey fishermen objecting to\u2064 rules from the Commerce Department that would <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/republican-lawmakers-call-on-scotus-to-rein-in-the-administrative-state\/\" title=\"GOP Lawmakers Urge SCOTUS to Limit Administrative State\">force commercial fishing vessels<\/a> \u2063to pay federal observers.\u200d Such on-board monitoring could cost \u2062more than $700 a day and about a fifth of fishermen\u2019s profits, <a href=\"https:\/\/causeofaction.org\/our-work\/loper-bright-v-raimondo\/\" target=\"_blank\" rel=\"noreferrer noopener\">according <\/a>to the Cause of Action Institute, which is representing the \u2062plaintiffs.<\/p>\n<hr>\n<p>Tristan \u2062Justice is\u2064 the \u2062western correspondent for The Federalist \u200dand the author of Social Justice Redux, a conservative \u2062newsletter on culture, health, and wellness.
