Tigar ruled against\u2063 the Biden administration order,\u2062 which mirrors the Trump-era \u201ctransit ban\u201d policy requiring migrants entering through the southern border to apply online first for protection \u200din other\u2063 countries they traveled \u200bthrough.<\/p>\n<p>Tigar, a\u200c federal judge in California appointed by former President Obama, wrote in his <a href=\"https:\/\/immigrantjustice.org\/sites\/default\/files\/content-type\/press-release\/documents\/2023-07\/187-East%20Bay-v-Biden_Order-granting-motion-for-SJ_7-25-23.pdf\" target=\"_blank\" rel=\"noopener\">35-page decision<\/a> that the\u200d rule violates a <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/state-lawmakers-want-to-turn-wisconsin-into-second-amendment-sanctuary\/\" title=\"State Lawmakers Want To Turn Wisconsin Into \u2018Second Amendment Sanctuary\u2019\">federal law allowing<\/a> anyone to claim\u200d asylum while in the United States.<\/p>\n<p>\u201cThe\u200d Court concludes that the Rule is contrary to law because it presumes ineligible for asylum noncitizens who enter between ports of entry, using a \u200cmanner of entry \u200bthat Congress expressly intended\u200d should not \u200caffect access to asylum,\u201d Tigar wrote.<\/p>\n<p>Tigar added that\u2064 Biden\u2019s rule also contradicts federal law \u201cbecause it presumes ineligible for asylum noncitizens\u200d who fail to apply for protection in \u2063a transit\u200d country, despite Congress\u2019s clear intent that such a factor should only limit access to asylum where the transit country actually\u2064 presents a safe option.\u201d<\/p>\n<p>Millions of illegal immigrants have entered\u200c the U.S. under the Biden administration,\u2062 forcing\u200d the president to\u200d change \u2063tactics in dealing\u200d with the influx\u2064 at the southern border.<\/p>\n<p>According to U.S. Customs and Border Protection \u200ddata, more than \u20631.<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-blocks-biden-administration-border-policy-limiting-access-to-illegal-immigrants-seeking-asylum\/\" title=\"Judge halts Biden's border policy restricting asylum for illegal immigrants.\">7 million migrant \u200cencounters occurred<\/a> in \u200cfiscal\u200c 2021. Last year, <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/secy-mayorkas-if-you-come-illegally-you-will-be-returned\/\" title=\"Secy.
