Other examples abound. More recently, Democratic prosecutors in Austin, the seat of ultra-liberal Travis County,\u200c have filed\u200b baseless criminal charges against a series of Republican elected officials, including then-state Treasurer (and later U.S. Sen.) Kay\u2064 Bailey Hutchison, House Majority Leader Tom DeLay, and even sitting\u200c Gov. Rick Perry.<\/p>\n<blockquote>\n<p>Not all of the attempts to kneecap political opponents involve\u200c Democrats attacking Republicans.\u2062 Some of the nastiest donnybrooks were initiated \u200bby \u201cestablishment\u201d or \u201cmoderate\u201d Republicans against\u2064 conservatives.<\/p>\n<\/blockquote>\n<p>The establishment worried that Paxton,\u200d thrice elected as AG, would become the frontrunner to succeed Abbott as governor, decided to double down on its\u200c lawfare campaign. Provoked by \u2064Paxton\u2019s claim that Texas Speaker Dade\u2064 Phelan should resign for appearing on the House floor \u200bwhile intoxicated, in May the House voted to impeach Paxton on additional charges \u2064of \u2064doing favors for a wealthy campaign donor (Austin real estate investor Nate Paul) \u2062and terminating four\u2062 staffers who claimed to be \u201cwhistleblowers.\u201d<\/p>\n<p>Under Texas law, the impeachment vote resulted\u200b in the immediate suspension of Paxton from\u200c his duties as AG, pending the outcome of his trial in the Texas Senate, scheduled to begin on Sept. 5. A two-thirds vote of the Senate \u2014\u2063 a more conservative body than the Texas House \u2014 is needed to convict Paxton. Lt. Governor Dan \u200dPatrick, a conservative stalwart who endorsed Paxton in the 2022 primary\u2062 election, will serve as presiding officer at the impeachment trial. The Texas Republican\u200d Party supports \u2063Paxton.<\/p>\n<p>The impeachment proceedings reassemble antagonists from previous skirmishes. One of Paxton\u2019s lawyers is Tony \u2062Buzbee, \u200bwho represented Rick Perry in the frivolous charges\u200b filed while he \u200cwas governor. The team advocating for conviction includes Houston lawyers Rusty Hardin (who played\u2062 a similar role\u200b in the futile campaign against\u200b Wallace Hall) and\u2063 Dick DeGuerin (who previously defended Kay Bailey\u2064 Hutchison and Tom DeLay). DeGuerin also achieved\u2064 notoriety for representing David Koresh during the Waco \u2064standoff.<\/p>\n<p>What will happen at \u200dPaxton\u2019s impeachment trial on Sept. 5? In November 2022, the ultimate jury in Texas \u2062politics \u2014 the voters \u2014 marked 4,278,986 ballots for Paxton. Will a cabal of vindictive establishment hacks succeed in overturning the election? Texas is a popular democracy, not a parliamentary\u200c system. Executive officials are chosen by the voting public, not the legislature. A strong argument can\u2063 be made that under Texas law, an elected official cannot be removed from\u200d office for misconduct if the predicate \u200coffenses antedated an election\u2064 and were a matter of public record known to the electorate.<\/p>\n<p>The rationale, in the words\u200d of the Texas Supreme Court, is that \u201cthe\u2063 public, as \u200cthe ultimate judge and jury in a democratic society, \u2062can choose to forgive the misconduct of\u2064 an elected official \u2062if\u2062 the public knows \u2064about such misconduct prior to the\u200c election.\u201d To\u2062 the dismay of the RINO establishment in Texas, their campaign to besmirch Paxton has not diminished his popular support. The voters selected him \u2063despite extensive public airing of various\u2064 allegations about him. As Americans witnessed during the presidency of Donald Trump, impeachment is the last resort of <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/the-establishments-paxton-impeachment-sham-undermines-the-will-of-texas-voters\/\" title=\"The Paxton impeachment sham by The Establishment undermines Texas voters' will.\">frustrated political opponents unable<\/a> to get their way\u200d through the\u2064 democratic\u200b political process.<\/p>\n<p>In Texas, as \u200din the nation\u2019s\u2063 capital, impeachment is just another form of lawfare. Convicting Paxton would bar him from <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/mitch-mcconnells-betrayal-hurts-the-nation-goodwin\/\" title=\"Mitch McConnell\u2019s betrayal hurts the nation\">holding public office<\/a> in the future \u2014 precisely the establishment\u2019s goal, \u200bcontrary to the voters\u2019 mandate. Such a\u200c result would be tantamount to a \u200dbanana republic coup unworthy of\u2063 the Lone Star\u200d State.<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>Texas politics have a history of being contentious, unethical, and lately, tainted by legal battles that manipulate election outcomes.
