These investigators, who had been working on the \u200dHunter Biden\u200b case for years, also stated that\u2062 Weiss was prevented from bringing charges \u200bagainst Hunter Biden in California \u200dand Washington, D.C., before filing charges \u2064in Delaware.<\/p>\n<p>Weiss, however, \u2064testified before Congress in\u2062 early June,\u200d asserting that he had &#8220;ultimate authority&#8221; over the \u2063case. He later mentioned that although he was &#8220;geographically limited&#8221; to Delaware, he had been informed that \u200bhe could request &#8220;special\u200b attorney&#8221; status from Attorney General Merrick Garland to bring\u200c charges in an outside\u200b jurisdiction \u2063if \u200dnecessary.<\/p>\n<p>The Heritage Foundation&#8217;s appeal follows U.S. District Judge Dabney Friedrich&#8217;s denial of \u2064their initial request for a broader set \u2063of documents.\u200b This broader request included all communications from Weiss&#8217;s office regarding\u200b &#8220;special counsel\u2063 status&#8221; and any communications his office may have had with other U.S. attorneys&#8217; offices that \u2064had the\u200c jurisdiction \u2062to bring charges\u2064 against Hunter Biden.<\/p>\n<p>The Department of Justice opposed this request, citing the\u200c extensive number of records that needed to be reviewed. They stated \u200cthat they had over 2,500 &#8220;potentially\u200b responsive records&#8221; that\u2064 met Heritage&#8217;s criteria, as well \u200das numerous other requests for expedited \u2063FOIA processing on U.S. attorney-related matters.<\/p>\n<p>In her order denying Heritage&#8217;s initial request, Judge Friedrich determined that the group had not \u200ddemonstrated the necessary\u2064 urgency. She emphasized that the public debate surrounding Hunter Biden&#8217;s actions \u2063and\u2063 his criminal \u200dprosecution, \u200dincluding any involvement by the President of the United States, would\u2063 continue beyond the plea hearing date.<\/p>\n<p>Mike Howell,\u200d a director at Heritage overseeing the case, emphasized that the group is seeking these documents for the sake of transparency. \u200dHe stated,\u2064 &#8220;The country deserves to see whether Weiss\u200d had the independence that Garland said he did.&#8221; Howell also mentioned that the group plans to file an amicus brief before \u200cHunter Biden&#8217;s hearing next week to discourage Weiss from proceeding with it.<\/p>\n<p>In response to Heritage&#8217;s new request for emergency relief, the \u2063D.C. Circuit Court of Appeals has asked the DOJ to file its response by Sunday evening.<\/p>\n<h3>Hunter Biden&#8217;s Plea Deal and\u200b Charges<\/h3>\n<p>Hunter Biden is scheduled to enter a \u200bplea deal in court\u200d on Wednesday with U.S. Attorney\u2064 David\u200d Weiss.
