Joe Manchin (D-W.Va.),\u200d and a group of Republican lawmakers.<\/p>\n<p>The <a href=\"https:\/\/www.theepochtimes.com\/heres-whats-in-the-debt-ceiling-deal-and-who-benefits_5299920.html\">deal to increase\u200d the U.S. debt limit<\/a> last month included a provision to approve the construction of the Mountain Valley Pipeline, a natural gas \u2063project set to run between\u2064 Virginia and \u2064West Virginia. An environmental group known\u200b as the\u2063 Wilderness Society has challenged the pipeline\u2019s construction, winning\u2064 a July 11 order from the Fourth Circuit\u2064 Court of Appeals that halts the\u200d pipeline\u2019s construction for now.<\/p>\n<p>The developers behind the Mountain Valley Pipeline project have since asked (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A35\/272104\/20230714161603813_MVP%20Application%20to%20Vacate%20Stays.pdf\">pdf<\/a>) the U.S. Supreme \u200cCourt to overturn the Fourth \u2064Circuit\u2062 Court\u2019s decision and allow \u2062the\u2063 pipeline to go \u2063forward.<\/p>\n<p>On Tuesday, \u2064 <strong>Senator Manchin<\/strong> filed a \u201cfriend of the court\u201d amicus\u200b curiae brief (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A35\/272252\/20230718113225558_MVP%20amicus%20brief%207%2018%2023.pdf\">pdf<\/a>) backing the Mountain \u200bValley \u2063Pipeline\u2019s request.<\/p>\n<p>Senator Manchin\u2019s amicus brief\u2062 was followed the next day by\u200c an\u2064 amicus brief (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A35\/272351\/20230719114802756_23A35%20Amicus%20Brief%20in%20Support%20of%20Emergency%20Application.pdf\">pdf<\/a>) brought by nine \u2063Republican lawmakers. In their brief, \u200bSen. Shelley Moore Capito (R-W.Va.) and Reps. Guy Reschenthaler (R-Pa.), Jeff Duncan (R-S.C.), Bill Johnson \u2063(R-Ohio), John Joyce (R-Pa.), Mike \u200dKelly (R-Pa.), Dan\u200c Meuser (R-Pa.), Carol Miller (R-W.Va.) and Alex Mooney (R-W.Va.) all expressed their support for overturning \u200cthe\u2063 appeals court order and letting the pipeline\u200c project proceed.<\/p>\n<p>On Friday, the \u200cBiden administration\u2062 also\u200c weighed in, lending its support \u2064for \u200cthe pipeline project. Writing on the administration\u2019s behalf, U.S. \u2064Solicitor General\u2063 Elizabeth Prelogar argued (<a href=\"https:\/\/www.supremecourt.gov\/DocketPDF\/23\/23A35\/272550\/20230721113753170_23A35%20MVP%20Govt%20Resp%20in%20Supp%20of%20Appl%20to%20Vacate%20Stay.pdf\">pdf<\/a>) that the deal cut during the passage of the \u200d<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/democrats-to-raise-debt-ceiling-by-2-5-trillion-with-funding-to-reach-past-2022-midterms\/\" title=\"Democrats to Raise Debt Ceiling by .5 Trillion\u00a0with Funding to Reach Past 2022 Midterms\">debt limit bill<\/a>, the Fiscal\u200d Responsibility Act of\u2064 2023,\u2062 had taken the power \u2063to stop the pipeline\u2019s\u2064 construction out of \u200dthe jurisdiction of the lower courts.<\/p>\n<p>The relevant section of the debt limit\u2064 bill\u2063 states, \u2062\u201cNo court\u201d\u2014up \u2064to and including the \u2062Fourth Circuit\u2014\u201dshall have\u2062 jurisdiction to\u2062 review any action taken by \u2064 [the relevant agencies] that grants \u2026 any \u2026 approval necessary for\u200b the construction and initial operation at full capacity of the \u200cMountain Valley Pipeline.\u201d<\/p>\n<p>Ms. Prelogar \u2064added that the Wilderness Society\u2019s \u2062legal challenges \u200d\u201ccannot \u200bsucceed because Congress ratified the agency\u200d actions that they challenge \u200band \u2063superseded\u2063 any provision \u2062of law inconsistent with the issuance of those approvals.\u201d<\/p>\n<p>NTD News reached out to the Wilderness\u200d Society for comment \u200bbut did not\u200d receive a \u2064response by the time \u200cthis\u2064 article was published.<\/p>\n<h2>Fossil \u200cFuel Projects Divide Democrats<\/h2>\n<p>While Senator Manchin and \u2064the Biden\u200b administration find themselves aligned with Republican\u200c lawmakers supporting the Mountain Valley\u2062 Pipeline, several Democratic lawmakers have backed the Wilderness\u200d Society\u2019s opposition to\u200b the \u200dpipeline\u2062 project.<\/p>\n<p>On July 5, Democratic\u2064 Virginia Reps. Jennifer McClellan, Don Beyer, Gerry Connolly, Robert C. \u201cBobby\u201d Scott, and Jennifer Wexton submitted an\u2062 amicus \u2062brief \u200din the Fourth Circuit\u200b Court, siding with the \u200dWilderness \u2063Project in \u200dopposition to the pipeline.<\/p>\n<p>In their brief (<a href=\"https:\/\/mcclellan.house.gov\/sites\/evo-subsites\/mcclellan.house.gov\/files\/evo-media-document\/23-1592_members-of-congress-amicus-brief-in-support-of-petitioner-as-filed.pdf\">pdf<\/a>), \u2064the five Democratic lawmakers argued that the <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/biden-sen-manchin-gop-lawmakers-defend-gas-pipeline-chellenged-by-environmental-group\/\" title=\"Biden, Manchin, GOP Back Gas Pipeline Amid Environmental Group Opposition.\">pipeline\u200d risks damaging streams<\/a> and wetlands \u200band would \u201crequire \u2064a taking of private property from many Virginia f<\/p>\n<\/div>\n","protected":false},"excerpt":{"rendered":"<p>A legal dispute in West Virginia over a new gas pipeline has united President Biden, Senator Manchin, and Republican lawmakers.
