Two of\u200c the men survived and reported experiencing extreme pain, including, in one case, nerve pain equivalent to\u200d electrocution,&#8221;<\/p>\n<\/blockquote>\n<p>Sotomayor wrote in a\u200c dissent joined by Justices Elena Kagan and Ketanji Brown Jackson. The trio argued that the 8th Amendment requires more\u2062 than just the state&#8217;s assurance that the \u200bexecution\u200d would proceed smoothly.<\/p>\n<p>Alabama had reviewed its procedures following the series of problematic executions, which \u2064convinced both\u200b the \u200bmajority of\u200d the Supreme\u200c Court and \u2063the lower\u200c courts \u200bthat the \u2064execution should proceed.<\/p>\n<blockquote>\n<p>&#8220;Today&#8217;s decision is \u2064another troubling example of\u200d this\u2062 court stymying the development of Eighth Amendment law by pushing forward \u2063executions without \u2063complete information,&#8221;<\/p>\n<\/blockquote>\n<p>Sotomayor added.<\/p>\n<h3>Background on\u2064 James Barber&#8217;s Case<\/h3>\n<p>James Barber, \u206464, was convicted and sentenced to \u200cdeath for the murder of 75-year-old Dorothy Epps \u2062in May 2001. He\u200b admitted to \u2064killing her with a claw hammer at her\u2064 home in Harvest, Alabama, and \u200bstealing her\u200b purse.<\/p>\n<p>Alabama Attorney General \u2062Steve Marshall described Barber as a handyman who knew Epps through \u2062repair work and a previous relationship with her daughter. Barber was arrested shortly after the murder and expressed remorse, stating that he deserved to be charged and put to death.<\/p>\n<p>Barber&#8217;s execution marks the first in the state since Governor Kay Ivey ordered a review\u200b of lethal\u2064 injection procedures last \u2063fall.
