Version: 4.0.47--><h2>Attorneys to Ask U.S. Supreme Court to Review Derek Chauvin&#8217;s Murder Charge<\/h2>\n<blockquote>\n<p>Attorneys representing former Minneapolis police officer <a href=\"https:\/\/www.dailywire.com\/topic\/derek-chauvin\" target=\"_blank\" rel=\"noopener\">Derek Chauvin<\/a> plan to ask the U.S. Supreme Court to review \u200bhis second<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/minneapolis-reconsiders-drops-program-to-pay-social-media-influencers-during-chauvin-trial\/\" title=\"Minneapolis Reconsiders, Drops Program To Pay Social Media Influencers During Chauvin Trial\">-degree murder charge<\/a> in the death of \u2062George Floyd in 2020.<\/p>\n<\/blockquote>\n<p>Chauvin is currently\u200c serving a 22.5-year prison sentence he received in June 2021 after \u200ba jury found him guilty on charges of second<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/judge-threatens-mistrial-in-chauvin-case-after-prosecutors-attempt-to-present-last-minute-evidence\/\" title=\"Judge Threatens Mistrial In Chauvin Case After Prosecutors Attempt To Present Last-Minute Evidence\">-degree unintentional murder<\/a>, third-degree murder, and second-degree manslaughter in\u200d the death of Floyd that sparked months of civil unrest resulting in 25 additional deaths and billions of dollars of property damage \u2062in cities nationwide.<\/p>\n<p>The Minnesota Supreme Court \u200ddeclined to hear the case on Tuesday that lawyers argued deprived their client of the right to a fair trial by holding the proceedings in Minneapolis, according to <a href=\"https:\/\/apnews.com\/article\/george-floyd-derek-chauvin-minneapolis-minnesota-3fc979708c2db136df8c3054d754c359\" target=\"_blank\" rel=\"noopener\">The Associated Press<\/a>, leaving Chauvin\u2019s \u200clegal team \u201cobviously disappointed.\u201d<\/p>\n<p>Attorney William Morhman argued that Chauvin\u2019s criminal trial generated the most pretrial publicity in history.<\/p>\n<p>\u201cMore concerning are the riots which occurred after George Floyd\u2019s\u2063 death (and) led the jurors to\u200b all express concerns for their safety in the event they acquitted Mr. Chauvin \u2014 safety concerns which were fully evidenced\u2064 by surrounding the courthouse in barbed wire and National Guard troops during the trial and deploying the National Guard\u2062 throughout Minneapolis prior to jury deliberations,\u201d he said, according to <a href=\"https:\/\/thehill.com\/regulation\/court-battles\/4107930-chauvin-to-ask-supreme-court-to-review-conviction-in-george-floyd-murder\/#:~:text=Judge%20Peter%20Cahill%20wrote%20in,owed%20to%20all%20human%20beings.%E2%80%9D\" target=\"_blank\" rel=\"noopener\">The Hill<\/a>.<\/p>\n<p>Minnesota Attorney General Keith Ellison \u2064said\u2063 that denial from the state\u2019s highest court \u201cmeans that the Court of Appeals was correct \u2064in finding that his trial was properly conducted and he was properly convicted under the \u2064law.\u201d<\/p>\n<p>\u201cThis \u2062development definitively holds Chauvin accountable and closes this chapter of the murder of George Floyd,\u201d he added.<\/p>\n<p>In the time since his conviction, Chauvin\u2019s legal team has now been denied by the state\u2019s top court and the Minnesota Court of Appeals to\u2062 hear \u200bthe appeal. Mohrman called Hennepin County Judge \u200dPeter Cahill\u2019s decision to hold the trial in Minneapolis \u201cpervasive\u201d because of the pretrial publicity,\u2062 which \u200cput courthouse\u200d security at risk\u200d of pretrial effects.<\/p>\n<p><b data-stringify-type=\"bold\"><\/b><\/p>\n<p>Cahill criticized Chauvin\u200d in his ruling, writing\u2064 in a memorandum the former police officer \u201cabused his position of trust and authority\u201d\u2064 and treated Floyd \u201cwithout respect and denied him the dignity owed to \u2064all human beings.\u201d<\/p>\n<p>Video of the arrest showed Floyd resisting officers\u2019 commands until they subdued him on the \u2062ground moments before he died after Chauvin kneeled on Floyd\u2019s shoulders and neck for\u2063 roughly nine minutes.<\/p>\n<p>The Hennepin Medical County Examiner ruled Floyd\u2019s \u200ddeath\u200c a homicide caused by \u201ccardiopulmonary arrest\u200d complicating law enforcement subdual, restraint, and neck \u2062compression,\u201d according to <a href=\"https:\/\/www.reuters.com\/article\/uk-minneapolis-police-autopsy-idUKKBN2383JU\" target=\"_blank\" rel=\"noopener\">Reuters<\/a>. The report also noted methamphetamine and fentanyl in his system at the time of his death, along with\u2064 hypertension and <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/wipeout-reboot-contestant-died-of-heart-attack-says-coroner\/\" title=\"\u2018Wipeout\u2019 Reboot Contestant Died Of Heart Attack, Says Coroner\">coronary artery disease<\/a>.<\/p>\n<p>Floyd\u2019s\u2062 family commissioned a separate autopsy report that ruled his death as a homicide by asphyxia due to neck and back compression, \u200bruling out any other\u200b medical issues\u200c noted \u200bby\u2062 the county coroner.<\/p>\n<p>The U.S. \u200bSupreme Court only hears approximately \u2064150 of the 7,000 requested appeals annually.<\/p>\n<p>Chauvin, who is\u200b currently serving his two-decade sentence in Arizona, is one of four other\u2064 officers involved in the case.<\/p>\n<p>Former Minneapolis Police Officer Thomas Lane was <a href=\"https:\/\/www.dailywire.com\/news\/former-minneapolis-police-officer-sentenced-to-2-and-a-half-years-in-prison-for-violating-george-floyds-civil-rights\" target=\"_blank\" rel=\"noopener\">found guilty<\/a> and sentenced to two and a half years in prison by a federal jury last year for depriving Floyd of his constitutional right by his \u201cdeliberate indifference to serious medical\u200d needs\u201d when he saw Chauvin\u2062 kneeling on \u200bFloyd\u2019s back. Lane later pleaded guilty to a state charge\u2063 of aiding and abetting second-degree manslaughter and was sentenced to three years in prison, according to\u2062 <a href=\"https:\/\/www.npr.org\/2022\/09\/21\/1124247012\/george-floyd-thomas-lane-sentenced-three-years-minneapolis-police\" target=\"_blank\" rel=\"noopener\">NPR<\/a>.<\/p>\n<p>Former officers J.
