The governor&#8217;s overweening efforts \u200cto impose progressive ideology on California&#8217;s schools come as\u2063 he regularly <a href=\"https:\/\/apnews.com\/article\/desantis-newsom-election-2024-california-florida-09475e131ebc2983a8d72e13f55a9955\" target=\"_blank\" rel=\"noopener\">condemns<\/a> Florida&#8217;s Ron DeSantis \u200dand other GOP governors\u2064 for \u200ctheir conservative-minded regulations of education.<\/p>\n<h3>Controversy Over LGBT Curriculum<\/h3>\n<p>The \u200cTemecula school board triggered \u2064Newsom&#8217;s wrath when it voted 3-2 on Tuesday against the \u200b<a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/gavin-newsom-lacks-the-power-to-deliver-on-his-threats-against-local-school-board\/\" title=\"Newsom lacks power to enforce threats on school boards.\">state-endorsed social studies curriculum<\/a>, which involves \u200bassassinated gay rights\u2062 icon Harvey Milk. Opponents of the curriculum have <a href=\"https:\/\/www.cnn.com\/2023\/06\/15\/us\/temecula-school-board-harvey-milk\/index.html\" target=\"_blank\" rel=\"noopener\">argued<\/a> that Milk, \u2063who had a\u2063 <a href=\"https:\/\/www.cnn.com\/2023\/06\/15\/us\/temecula-school-board-harvey-milk\/index.html\" target=\"_blank\" rel=\"noopener\">documented<\/a> relationship with a 16-year-old runaway, should not be presented as a heroic figure to young children.<\/p>\n<p>&#8220;The three political activists on the school board have yet again proven they are more interested in breaking the law than\u200c doing their jobs of\u2064 educating students\u2014so the state will \u2062do their job for \u200cthem,&#8221; Newsom \u2063said in his announcement the following day. &#8220;California will ensure\u2063 students in Temecula begin the school year with access to materials reviewed by parents and recommended by teachers across the district.&#8221;<\/p>\n<h3>Limitations of \u200dNewsom&#8217;s Power<\/h3>\n<p>While California has far-reaching <a href=\"https:\/\/freebeacon.com\/california\/california-books\/\" target=\"_blank\" rel=\"noopener\">requirements<\/a> about the teaching of progressive views on\u200c gender, sexuality, and race, the\u2064 governor cannot \u2064simply impose his will on Temecula.<\/p>\n<p>Los Angeles-area \u200battorney Julie Hamill, who sits on the Palos Verdes school board, said she is unaware of any law &#8220;that \u200bwould give Newsom the authority \u200bto override\u200b local curriculum decisions, let alone fine\u200d a district for rejecting curriculum that Newsom wants adopted.&#8221;<\/p>\n<p>&#8220;Ultimately, if Newsom gets\u2062 his way, \u200bparents \u2063who don\u2019t want \u2064their <a href=\"https:\/\/www.conservativenewsdaily.net\/breaking-news\/desantis-undeterred-by-disney-criticism-of-florida-parental-rights-bill\/\" title=\"DeSantis Undeterred By Disney Criticism Of Florida Parental Rights Bill\">young children exposed<\/a> to certain explicit materials may have to pull them from public \u2064schools,&#8221; Hamill added.<\/p>\n<p>Jonathan Zachreson, the founder of Reopen California Schools, said he\u200b sees Newsom\u2019s threats as an attempt to \u200b&#8221;strong arm&#8221; the Temecula school district. But the governor cannot actually force \u2063the board to put the books in the \u200dclassroom \u200bor the schools to teach them, Zachreson said.<\/p>\n<p><strong>The California\u200b attorney general\u2019s office did not respond to a\u200c request for comment on the legality of the governor&#8217;s plan.<\/strong><\/p>\n<p>A\u2064 representative for\u200d Newsom said \u2062that &#8220;existing law establishes a process \u2064for supplying a district \u2064with textbooks they did not \u200brequest if,\u2063 for example, a \u2064finding has been made that \u200binstructional \u200bmaterials are insufficient.&#8221;<\/p>\n<p>&#8220;However, the state has rarely, if ever, dealt with a governing board so willfully flouting state laws and the basic standards of school governance,&#8221; the representative said. &#8220;Following <a href=\"https:\/\/freebeacon.com\/democrats\/california-all-gender-books-required\/\">passage<\/a> \u200c of [Assembly Bill] 1078, the \u2062state \u2064will then send the district the \u2062bill for the curriculum and fine the district for\u2064 violating\u2062 California law.&#8221;<\/p>\n<div>\n<p><a href=\"https:\/\/stopthebigboxbaitandswitch.com\/?utm_source=freebeacon&#038;utm_medium=advertising&#038;utm_campaign=2023\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\n<p><a href=\"https:\/\/stopthebigboxbaitandswitch.com\/?utm_source=freebeacon&#038;utm_medium=advertising&#038;utm_campaign=2023\" target=\"_blank\" rel=\"noopener\"><\/a><\/p>\n<\/div>\n<p>Newsom&#8217;s office did \u2064not specify which\u200b laws it would relying on to force books and fees on Temecula. <a href=\"https:\/\/leginfo.legislature.ca.gov\/faces\/billNavClient.xhtml?bill_id=202320240AB1078\">A.B. 1078<\/a>, which\u2063 would allow \u2063the state to pull funding from schools that have an insufficient\u2063 number of LGBT books on \u2063their shelves, has yet to pass the\u200d state Senate. But Zachreson said that even if that\u200d bill were to become\u2062 law, the \u2063state would have to\u2062 follow a months-long \u2064administrative process in order to levy a\u200c fine.<\/p>\n<p>&#8220;Normally if you say you\u2019re assessing the fine, you put the party on notice before you go out and publicize it,&#8221; Arend said. &#8220;It sounds\u200c to me like a bunch of grandstanding on Newsom\u2019s part.&#8221;<\/p>\n","protected":false},"excerpt":{"rendered":"<p>California governor Gavin Newsom (D.) lacks the legal power to enforce his warnings towards a school board that declined an LGBT-focused social studies curriculum.
